April 30, 2026 Kos Hassan, Authorized Agent Sumsun Inc 5701 Shingle Creek Parkway Suite 210C Minneapolis, Minnesota 55430-6604 License Number: 1107876 (245D – HCBS) CORRECTION ORDER Dear Kos Hassan: On April 21, 2026, a licensing review of Sumsun Inc, located at 5701 Shingle Creek Parkway, Minneapolis, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245A.65, subdivision 3. Violation: For one of two staff persons whose records were reviewed (SP2), the license holder did not provide orientation on the maltreatment of vulnerable adults as required. The license holder did not provide SP2 with an orientation on reporting requirements, definitions in 626.557 and 626.5572, and all internal policies and procedures related to the prevention and reporting of maltreatment of vulnerable adults receiving services within 72 hours of first providing direct contact services. SP2 first had direct contact with a vulnerable adult on November 7, 2025. SP2 received this orientation on December 31, 2025. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.09, subdivision 4. Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide SP2 with orientation training as required. The license holder hired SP2 on October 24, 2025. The license holder did not provide SP2 with orientation within 60 calendar days in the following areas: · the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04. SP2 received this training on December 28, 2025; · the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person. As of the date of this review, SP2 had not received this orientation; · the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint. SP2 received this training on January 4, 2026; · staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint. SP2 received this training on January 4, 2026; · basic first aid. SP2 received this training on December 28, 2025; and · strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities. SP2 received this training on December 31, 2025. Repeat Violation: In a Correction Order that DHS issued on February 20, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP2 with orientation to the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person. Documentation of this training must be maintained in the personnel record, including the date the training is completed, the number of hours per subject area, and the name of the trainer or instructor. On an ongoing basis, you must maintain compliance as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.09, subdivision 5. Violation: For one staff person whose record was reviewed (SP1), the license holder did not provide annual training as required. The license holder did not provide SP1 with annual training on the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by SP1 in 2025. SP1 last received this training in May 2024. Repeat Violation: In a Correction Order that DHS issued on February 20, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1 with training on the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by SP1. Documentation of this training must be maintained in the personnel record including the date the training is completed, the number of hours per subject area, and the name of the trainer or instructor. On an ongoing basis, you must maintain compliance as required in this subdivision. 4. Citation: Minnesota Statutes, section 245D.061, subdivision 9. Violation: The license holder did not maintain an emergency use of manual restraints policy and procedure as required. The license holder provided two policies and procedures regarding the emergency use of manual restraints, one that allowed the emergency use of manual restraints and one that did not allow the emergency use of manual restraints. The license holder did not develop, document, and implement a policy and procedure regarding the emergency use of manual restraint. Corrective Action Ordered: Within 30 days of receiving this order, you must: · develop, document, and implement a policy and procedure that either allows or does not allow the emergency use of manual restraints; · provide all service recipients, legal representatives, and case managers with the updated policy and procedure; · maintain documentation of the updated policy and procedure being provided to service recipients, legal representatives, if applicable, and case managers in the service recipient record; · provide training to all staff on the updated policy and procedure; and · maintain documentation of this training in the personnel file, including the date the training is completed, the number of hours per subject area, and the name of the trainer or instructor. On an ongoing basis, you must maintain compliance as required in this subdivision. 5. Citation: Minnesota Statutes, section 245D.11, subdivision 2. Violation: The license holder did not maintain policies and procedures related to providing intensive support services as required. The license holder did not establish, enforce, and maintain the following policies: · safe transportation; · a plan for ensuring the safety of persons served by the program in emergencies as defined in section 245D.02, subdivision 8, and procedures for staff to report emergencies to the license holder; · a plan for responding to all incidents as defined in section 245D.02, subdivision 11, and reporting all incidents required to be reported according to section 245D.06, subdivision 1; · a procedure for the review of incidents and emergencies to identify trends or patterns and corrective action as needed. Corrective Action Ordered: Within 30 days of receiving this order, you must: · establish a policy and procedure for safe transportation, including provisions for handling emergency situations according to the requirements in section 245D.06, subdivision 2, clauses (2) to (4); · establish a plan to ensure the safety of persons served by the program in emergencies and procedures for staff to report emergencies to you; · establish a plan for responding to all incidents and reporting incidents required to be reported. The plan must: o include the contact information of a source of emergency medical care and transportation; and o require staff to first call 911 when the staff believes a medical emergency may be life threatening or call the mental health crisis intervention team or similar mental health response team or service when such a team is available and appropriate when the person is experiencing a mental health crisis; · establish a procedure for the review of incidents and emergencies to identify trends or patterns and corrective action if needed; · establish and maintain a record keeping system for the incident and emergency reports; and · provide all staff with training on the updated safe transportation policy, emergency response and reporting policy, and incident response, reporting, and review policy. Documentation of this training must be maintained in the personnel record including the date the training is provided, the number of hours per subject area, and the name of the trainer or instructor. On an ongoing basis, you must maintain compliance as required in this subdivision. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
