Dear Joshua Schott:
CORRECTION ORDER
An investigation of JD Home Healthcare was completed regarding report number 202601753 which alleged violation of Minnesota Statutes, Chapter 245D and Minnesota Rules, pat 9544.0060. This maltreatment allegation concerned physical abuse. The disposition of the investigation report is inconclusive. Two violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violation within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes, section 245D.04, subdivision 3, paragraph (a), clause (6).
Violation: The license holder did not ensure that a consumer’s (C) protection-related rights, including being treated with courtesy and respect as required, were followed.
Information provided was consistent that on February 19, 2026, a staff person (P) put the C in a restraint and pushed the C which may have caused bruising to the C.
Corrective Action Required: Immediately upon receiving this order, you must ensure all staff persons are trained on the facility’s policy on Rights of Persons Served, and
on an ongoing basis, you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Rules, part 9544.0060, subpart 2, item x.
Violation: The license holder did not ensure that the P utilized actions or procedures prohibited from being used by the facility as behavioral intervention for the C.
Information provided was consistent that on February 19, 2026, the P utilized physical restraint as behavioral intervention with the C which was not consistent with the C’s plans or facility policies and procedures.
Corrective Action Required: Immediately upon receiving this order, you must ensure all staff persons are trained on the facility’s policy on Rights of Persons Served, and on an ongoing basis, you must maintain compliance as required in this subdivision.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
