Dear Asad Hassan:
On March 23, 2026, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of the citation in the Correction Order issued to you by the Department of Human Services on March 11, 2026. Citation: The license holder did not report alleged or suspected maltreatment as required. Specifically, on January 17, 2026, and after, staff persons at multiple levels of authority were aware of possible maltreatment and that a client (C) at the facility left the facility without supervision and passed away in the community, but a report was not made as required. The Department of Human Services received a report on January 24, 2026.
Request for Reconsideration
You submitted a letter in which you indicated the language used in the violation description is not accurate because the facility was “fully transparent and proactive in notifying state authorities immediately upon learning of the incident.” You indicated that on January 17, 2026, at 2:40 p.m., which was within 34 minutes of learning of the VA’s passing, an administrative staff person (P1) completed and submitted a Critical Incident Reporting Form to DHS Licensing. You also indicated that on the same date, the facility submitted a death report to the Ombudsman for Mental Health and Developmental Disabilities (OMHDD).
You also acknowledged that a report to the Minnesota Adult Abuse Reporting Center (MAARC) was not submitted until January 24, 2026, and that the delay was a “procedural misstep” based on the understanding that immediate reports to DHS Licensing and the OMHDD would meet the notification requirements. You noted that the Maltreatment Investigation Memorandum for the same report acknowledges that facility staff sent a Critical Incident Report form to DHS on January 17, 2026, and you are requesting that the violation narrative in the citation be amended to reflect that the facility submitted reports to DHS Licensing and the OMHDD on January 17, 2026. Applicable Law
Under Minnesota Statutes, section 626.557, subdivision 3, paragraph (a), a mandated reporter who has reason to believe that a vulnerable adult is being or has been maltreated shall immediately report the information to the common entry point.
Reconsideration Determination
You acknowledged in the reconsideration request that the report was not made to MAARC as required until January 24, 2026, and that the facility learned of the VA’s passing on January 17, 2026. Although the facility did submit forms to DHS Licensing and OMHDD on January 17, 2026, there is no dispute that a report was not immediately made to the common entry point as required by the statute. Also, the facility’s Missing Client policy indicated staff were to immediately contact the Program Director (PD), Treatment Director (TD) and/or facility health care professional (HCP) when a client was determined to be missing, and one of those persons was to then complete both an Incident Report and a report to MAARC.
The language as currently stated in the violation description is correct because the report was not made as required. There is therefore sufficient evidence to support the citation, and it is affirmed.
Disposition: The Commissioner has reviewed the license holder’s request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support the citation, and it is affirmed.
This is a final agency decision.
