CORRECTION ORDER
An investigation of Kalis Adult Foster Care/Infinity Home was completed regarding report number 202510188, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned abuse. The disposition of the investigation report is inconclusive. One violation was noted.
VIOLATION AND CORRECTION ORDER
The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violation within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
Citation: Minnesota Statute 245D.06, subdivision 5
Violation: For one client (C) the license holder did not prohibit the use of mechanical restraints for a behavioral or therapeutic program to reduce or eliminate behavior or as punishment or for staff convenience.
On unspecified dates, staff tied the C to his/her wheelchair using a gait belt with the intention of minimizing the C’s risk of injury and helping the C to “calm down.” This was done while waiting for a seatbelt for the wheelchair that was ordered to arrive.
Corrective Action Ordered: Immediately upon receiving this order, you must ensure that prohibited actions or procedures are not used as a substitute for adequate staffing, for a behavioral or therapeutic program to reduce or eliminate behavior, as a punishment, or for staff convenience. On an ongoing basis, you must maintain compliance throughout your program as required in this rule.
If you believe the citation is in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
