CORRECTION ORDER
Dear Thomas Beckers: On February 23 through 25, 2026, Department of Human Services (DHS) licensors conducted a licensing review at your facilities located at the following: · Vinland National Center, 3675 Ihduhapi Rd., Independence, MN, 55357, license number 802601
· Vinland National Center, 675 Stinson Blvd., Minneapolis, MN, 55413-2759, license number 1039413
As a result of this visit, DHS determined that you are in violation of the substance use disorder treatment statutes under Minnesota Statutes, chapter 245G. As a result, DHS is issuing this order which requires you to take the corrective action as described under each violation. LICENSING VIOLATIONS
DHS determined that your program failed to follow licensing rules and statutes, as described below. Policies, Practices, and Procedures
1. Violation: The license holder (802601 and 1039413) did not meet the requirements governing client rights protections. The license holder did not have policies and procedures that protect client rights as identified in Minnesota Statutes, sections 144.651, 148F.165, and 253B.03.
Statute Violated: Minnesota Statutes, sections 245G.12, clause (5) and 245G.15, subdivision 1.
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that client rights policies and procedures are followed and meet all requirements. Within 30 days of receipt of this order, submit client rights that meet all applicable requirements. 2. Violation: The license holder (802601) did not meet requirements governing grievance procedures. The grievance procedure did not include the current address for the Department of Human Services, Licensing Division.
Statute Violated: Minnesota Statutes, section 245G.15, subdivision 2, clause (2). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that grievance procedures meet all applicable requirements. Within 30 days of receipt of this order, submit a grievance procedure that meets all applicable requirements. 3. Violation: The license holder (880601) did not monitor the implementation of their own policies and procedures as required for the following:
a. The written policy regarding the use of any personal electronic device that can record, transmit, or make images of another client conflicted with the cell phone use policy;
b. The license holder did not post visiting hours that included evening times although they did have visiting hours in the evening;
c. The policies and procedures did not contain procedures for reporting the maltreatment of vulnerable adults. The policy referenced definitions from repealed statute requirements; and
d. The manual did not include hours of operation.
Statute Violated: Minnesota Statute, sections 245A. 04, subdivision 14, paragraph (b), clause (3), 245G.12, clause (12), 245G.15, subdivision 3, paragraph (b), and 245G.21, subdivision 2. Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that policies and procedures are followed and meet all requirements. Within 30 days of receipt of this order, submit a personal electronics policy and visiting hours posting that meets all applicable requirements. 4. Violation: The license holder did not meet requirements governing policy and procedure manuals in the following ways:
a. The description of treatment services did not:
i. Include the amount and type of services provided (licenses 802601 and 1039413);
ii. Identify which services meet the definition of group counseling (license 802601); and
iii. Define the program’s treatment week (license 802601).
Statute Violated: Minnesota Statutes, section 245G.12, clause (10).
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that the treatment service description meets all requirements. Within 30 days of receipt of this order, submit a treatment services description that meets all applicable requirements. 5. Violation: The license holder (80601) did not meet requirements governing the provision of telehealth services. The license holder did not have written policies and procedures that meet all requirements for the provision of telehealth in Minnesota Statute, section 254B.0652, subdivision 3b.
Statute Violated: Minnesota Statutes, section 245G.07, subdivision 4, paragraph (b), clause (2). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that telehealth policies meet all applicable requirements. Within 30 days of receipt of this order, submit a telehealth policy that meets all applicable requirements. 6. Violation: The license holder (802601) did not meet requirements governing health services in the following ways:
a. The administration of medication policy did not include guidelines for when to inform a nurse of problems with self-administration of medication, including a client's failure to administer, refusal of a medication, adverse reaction, or error; and
b. The control of drugs policy did not include a procedure for monitoring the available supply of an opiate antagonist.
Statute Violated: Minnesota Statutes, section 245G.08, subdivisions 5, paragraph (c), clause (8) and 6, clause (7). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that policies regarding health services meet all applicable requirements. Within 30 days of receipt of this order, submit a health services policy that meets all applicable requirements. 7. Violation: The license holder (802601) did not meet requirements governing behavioral emergency procedures. The behavioral emergency procedure did not include staff members authorized to implement behavioral emergency procedures
Statute Violated: Minnesota Statutes, section 245G.16, paragraph (a), clause (5). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that behavioral emergency procedures meet all applicable requirements. Within 30 days of receipt of this order, submit a behavioral emergency procedure that meets all applicable requirements. 8. Violation: The license holder (802601 and 1039413) did not meet requirements governing program abuse prevention plans. The license holder’s governing body or the governing body’s delegated representative did not review the program abuse prevention plan for calendar years 2024 and 2025.
Statute Violated: Minnesota Statutes, section 245A.65, subdivision 2, paragraph (a), clause (5). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that maltreatment of vulnerable adult policies and procedures meet all applicable requirements. 9. Violation: The license holder (802601) did not meet requirements governing the reporting of maltreatment of vulnerable adults. There was no documentation that an internal review was completed within 30 days when the facility had reason to know that an internal or external report of alleged or suspected maltreatment had been made for the following dates:
a. September 8 and December 19, 2023;
b. March 6, 2024; and
c. September 5, 2025.
Statute Violated: Minnesota Statutes, sections 245A.65, subdivision 1, paragraph (b), clause (1) and 245G.12, clause (9). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that maltreatment of vulnerable adult policies and procedures meet all applicable requirements. 10. Violation: The license holder (802601) did not meet requirements governing maltreatment of minors reporting. The policy did not document that a person mandated to report child maltreatment occurring within a licensed facility shall report the information to the agency responsible for licensing or certifying the facility.
Statute Violated: Minnesota Statutes, section 245G.12, clause (9).
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that maltreatment of minors policies meet all applicable requirements. Within 30 days of receipt of this order, submit a maltreatment of minors policy that meets all applicable requirements. 11. Violation: The license holder (802601) did not meet requirements governing personnel policies. The personnel policies did not include orientation within 24 working hours of starting for each new staff member based on a written plan that, at a minimum, must provide training related to client needs.
Statute Violated: Minnesota Statutes, section 245G.13, subdivision 1, clause (7). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that personnel policies meet all applicable requirements. Within 30 days of receipt of this order, submit personnel policies that meet all applicable requirements. 12. Violation: The license holder (802601 and 1039413) did not meet requirements governing plan for transfer of clients and records upon closure. There was no documentation of a controlling individual of the program annually reviewing and signing the plan for;
a. 2024 (802601 and 1039413); and
b. 2025 (1039413).
Statute Violated: Minnesota Statutes, section 245A.04, subdivision 15a, paragraph (a). Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that the plan for transfer of clients and records upon closure meets all applicable requirements. Personnel Files
Personnel files reviewed are identified in the following manner: · License Number 802601: Personnel files numbered 1 through 6
· License Number 1039413: Personnel files numbered 8 and 10
· License Numbers 802601 and 1039413: Personnel files numbered 7 and 9
13. Violation: One of ten personnel files reviewed for requirements governing background studies did not meet requirements. The license holder relied on a background study that was completed for license number 802601 and did not affiliate a staff member (personnel file numbered 9) to roster 1039413 before allowing direct contact with persons served by the program.
Statute Violated: Minnesota Statutes, section 245C.07, paragraph (a), clause (2).
Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure background studies meet all applicable requirements.
14. Violation: Five of six personnel files reviewed for requirements governing staff orientation did not meet requirements. There was no documentation of the following orientation:
a. Within 24 working hours related to:
i. Policies and procedures (personnel files numbered 3, 5, and 10);
ii. Client confidentiality (personnel file numbered 3); and
iii. Client needs (personnel files numbered 3, 5, and 10);
b. Within 72 working hours on:
i. HIV minimum standards (personnel file numbered 5);
c. Within 72 hours of first providing direct contact services on:
i. The license holder’s program abuse prevention plan (personnel files numbered 3,5, and 10); and
ii. All internal policies and procedures related to the reporting of maltreatment of individuals receiving services (personnel files numbered 3,5, and 10);
d. Maltreatment of minors reporting requirements and definitions in Minnesota Statute, chapter 260E before a mandatory reporter has direct contact (personnel file numbered 5);
e. Emergency overdose treatment before the employee has direct contact (personnel file numbered 6); and
f. Twelve hours of training on co-occurring disorders within six months of employment (personnel files numbered 1 and 10).
Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b), 245A.242, subdivision 2, paragraph (a), 245A.65, subdivision 3, 245G.08, subdivision 3, and 245G.13, subdivisions 1, clause (7), and 2, paragraphs (d) through (f).
Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that staff orientation meets all applicable requirements. Within 30 days of receipt of this order, submit documentation which demonstrates that the above personnel meet all applicable orientation requirements. 15. Violation: Six of ten personnel files reviewed for requirements governing annual training did not meet requirements. There was no documentation of the following annual training:
a. Mandatory reporting as specified in Minnesota Statutes, sections 245A.65, 626.557, and 626.5572, and chapter 260E for the calendar years:
i. 2024 (personnel files numbered 2, 4, 7, and 9);
ii. 2025 (personnel file numbered 10); and
iii. 2026 (personnel file numbered 5);
b. Program Abuse Prevention Plan for calendar years:
i. 2024 (personnel files numbered 2, 4, 7, and 9); and
ii. 2026 (personnel file numbered 5);
c. Internal policies and procedures related to the prevention and reporting of maltreatment of individuals receiving services for calendar years:
i. 2024 (personnel files numbered 2, 4, 7, and 9);
ii. 2025 (personnel file numbered 10); and
iii. 2026 (personnel file numbered 5); and
d. HIV minimum standards for calendar years:
i. 2024 (personnel files numbered 2, 4, 7, and 9);
ii. 2025 (personnel file numbered 2); and
iii. 2026 (personnel file numbered 5).
Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b), 245A.65, subdivision 3, and 245G.13, subdivision 2, paragraphs (c) and (d). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that annual trainings meet all applicable requirements. 16. Violation: Two of two personnel files reviewed for requirements governing medication administration training did not meet requirements. There was no documentation that a staff member who is delegated by a licensed practitioner the task of administration of medication or assistance with self-medication (personnel files numbered 5 and 6) demonstrated to a registered nurse competency to perform the delegated activity.
Statute Violated: Minnesota Statutes, section 245G.08, subdivision 5, paragraph (b), clause (3).
Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that medication administration training meets all applicable requirements. Within 30 days of receipt of this order, submit documentation which demonstrates that the above personnel meet all applicable medication administration training requirements. 17. Violation: Nine of ten personnel files reviewed for requirements governing personnel file contents did not meet requirements. The personnel file did not contain:
a. The first date that a background study subject had direct contact with a person served (personnel files numbered 1, 3, and 5);
b. A completed application for employment signed by the staff member (personnel files numbered 1, 5, and 10); and
c. A written annual review for calendar year:
i. 2024 (personnel files numbered 2, 4, 6, 7, and 8);
ii. 2025 (personnel file numbered 2, 4, 6, 7, and10); and
iii. 2026 (personnel file numbered 5).
Statute Violated: Minnesota Statutes, sections 245A.041, subdivision 6 and 245G.13, subdivisions 1, clause (3) and 3, clause (1). Corrective Action Required: Immediately and on an on-going basis, the license holder must ensure that personnel file contents meet all applicable requirements. Client Files
Client files reviewed are identified in the following manner: · License Number 802601: Client files numbered 1 through 5 and 9
· License Number 1039413: Client files numbered 6 through 8
18. Violation: Nine of nine client files reviewed for requirements governing client orientation did not meet requirements. There was no documentation that the client received:
a. Orientation to HIV minimum standards within 72 hours of admission to the program (client files numbered 6 through 8);
b. Orientation to maltreatment of vulnerable adult internal and external reporting procedure within 72 hours of admission to the program (client files numbered 1 through 9); and
c. Orientation to the program abuse prevention plan within 72 hours of admission (client files numbered 1 through 6, 8, and 9).
Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b), 245A.65, subdivisions 1, paragraph (c) and 2, paragraph (a), clause (4), 245G.09, subdivision 3, paragraph (a), clause (1), and 245G.15, subdivisions 1.
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that client orientation meets all applicable requirements. Within 30 days of receipt of this order, submit orientation documents that meet all applicable requirements. 19. Violation: Eight of nine client files reviewed for requirements governing initial service plans (ISP) did not meet requirements. The ISP was not:
a. Completed within 24 hours of the day of service initiation (client files numbered 1, 2, and 8); and
b. Person-centered and client specific (client files numbered 1 through 5, 7, and 9).
Statute Violated: Minnesota Statutes, section 245G.04, subdivision 1. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that service initiation meets all applicable requirements. Within 30 days of receipt of this order, submit two initial service plans that meet requirements. 20. Violation: Three of five client files reviewed for requirements governing individual abuse prevention plans (IAPP) (client files numbered 1, 3, and 5) did not meet requirements. There was no documentation in the IAPP of the following:
a. Statements of the specific measures to be taken to minimize the risk to the vulnerable adult and other vulnerable adults when the individual assessment indicates the need; and
b. A determination that a specific risk reduction measure is not needed in addition to those identified in the Program Abuse Prevention Plan .
Statute Violated: Minnesota Statutes, sections 245A.65, subdivision 2, paragraph (b), clause (1), 245G.04, subdivision 2, paragraph (b), and 245G.21, subdivision 6. Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that individual abuse prevention plans meet all applicable requirements. 21. Violation: Seven of nine client files reviewed for requirements governing comprehensive assessments did not meet requirements. The comprehensive assessment:
a. Was not completed by the end of the fifth day on which a treatment service was provided (client file numbered 8); and
b. There was no documentation of:
i. The client’s current medications (client files numbered 1 through 5 and 9); and
ii. The client's evaluation of the quality of each relationship (client files numbered 2 and 5).
Statute Violated: Minnesota Statutes, section 245G.05, subdivisions 1, paragraph (a) and 3.
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that comprehensive assessments meet all applicable requirements. 22. Violation: Nine of nine client files reviewed for requirements governing individual treatment plans (ITP) did not meet requirements in the following ways:
a. The ITP was not completed within ten days from the day of service initiation (client files numbered 3, 4, and 9); and
b. The ITP did not document a treatment strategy (client files numbered 1 through 9).
Statute Violated: Minnesota Statutes, sections 245G.06, subdivisions 1 and 1a, paragraph (a), clause (3).
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that individual treatment plans meet all applicable requirements. Within 30 days of receipt of this order, submit one individual treatment plan that meets all requirements. 23. Violation: Seven of nine client files reviewed for requirements governing client record documentation did not meet requirements in the following ways:
a. Documentation was not completed within seven days of providing a treatment service on:
i. July 17, 21, and 22, 2025 (client file numbered 3);
ii. November 20 and 21, 2025 (client file numbered 6);
iii. December 19 and 23, 2025 (client file numbered 1); and
iv. January 15, 27, and 29, 2026 (client file numbered 5);
b. Documentation of treatment services did not include:
i. Client response for:
1. October 7, 2025 (client file numbered 6);
2. January 15, 16, 19 through 22, and 26 through 29, 2026 (client file numbered 5); and
3. February 5 and 6, 2026 (client file numbered 9);
ii. Correct amount of treatment service for:
1. December 8, 2025 (client file numbered 2); and
2. December 19, 2025 (client file numbered 1).
iii. Signature of the staff person making the entry for:
1. July 3, 2025 (client file numbered 3);
2. December 5, 2025 (client file numbered 2);
3. December 19, 2025 and January 9, 2026 (client file numbered 1);
4. January 8, 22, and 29, 2026 (client file numbered 5); and
5. January 15 and February 6, 2026 (client file numbered 4); and
iv. Job title of the staff person making the entry for:
1. January 15, 17, 18, and 21, 2026 (client file numbered 5); and
2. February 4, 5, 6, 8, 11, and 12, 2026 (client file numbered 4).
Statute Violated: Minnesota Statutes, section 245G.06, subdivisions 2a and 2b, paragraph (c).
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that client record documentation meets all applicable requirements.
24. Violation: Five of six client files reviewed for requirements governing the provision of telehealth did not meet requirements. Documentation of treatment services provided by telehealth did not include:
a. The license holder’s basis for determining that telehealth is an appropriate and effective means for delivering treatment service on:
i. July 17 and 24, 2025 (client file numbered 3); and
ii. January 22 and 20, 2026 (client file numbered 5);
b. The mode of transmissions used to deliver the service through telehealth on:
i. July 17 and 24, 2025 (client file numbered 3); and
ii. January 22 and 20, 2026 (client file numbered 5); and
c. The location of the originating site and the distant site on:
i. July 7, 17, and 24, 2025 (client file numbered 3);
ii. November 24, 2025 (client file numbered 2);
iii. December 19, 2025 (client file numbered 1);
iv. January 9, 22, and 29, 2026 (client file numbered 5); and
v. January 16, 2026 (client file numbered 4).
Statute Violated: Minnesota Statutes, section 245G.07, subdivision 4, paragraph (c), clause (2).
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that telehealth treatment service documentation meets all applicable requirements.
25. Violation: Three of nine client files reviewed for requirements governing treatment plan reviews did not meet requirements as follows:
a. The treatment plan review did not document:
i. Client goals addressed since the last treatment plan review (client file numbered 3); and
ii. Monitoring of any physical and mental health problems and include toxicology results (client files numbered 1 and 3); and
b. A treatment plan review was not completed every 14 days for a client receiving ASAM level 3.5 high intensity residential. The treatment plan review was due on February 12, 2026, however, was not completed until February 16, 2026 (client file numbered 5).
Statute Violated: Minnesota Statutes, section 245G.06, subdivisions 3, clauses (1) and (2) and 3a, paragraph (b).
Corrective Action Required: Immediately, and on an ongoing basis, the license holder must ensure that treatment plan reviews meet all applicable requirements. Written Response Required
