Dear Sadia Muhumed,

On November 11, 2025, the Minnesota Department of Children Youth and Families (DCYF), Division of Licensing, received your request for reconsideration regarding Citations 4 and 18 in the Correction Order issued to you on October 22, 2025. You did not request review for Citations 1 through 3, 5 through 17, and 19 through 23. Therefore, Citations 1 through 3, 5 through 17, and 19 through 23 are not under the scope of review.

Reconsideration Determination

Citation 4

Violation. Menus did not comply with the nutritional requirements of the USDA. Menus did not include the type of milk (whole, 1%, skim).

Applicable Law. When the license holder provides food, menus must comply with the nutritional requirements of the United States Department of Agriculture, Food and Nutrition Service, Code of Federal Regulations, title 7, section 226.20.Minnesota Rules, part 9503.0145, subpart 2.

Each meal must contain fluid milk that meet the fat content for each age group. United States Department of Agriculture, Food and Nutrition Service, Code of Federal Regulations, title 7, section 226.20.

Your Response. You provided a menu used at the center since licensure. You stated that the menu meets all the USDA requirements. You stated that the menu is in your administrative folder. Finally, you also stated that the menu has been reviewed and approved by the licensor.

Reconsideration Determination. Citation 4 pertains to the posted menu not the menu that you provided on reconsideration. During the site visit, the Licensor noted that the posted menu at the program did not specify the type of milk (fat content of milk). On reconsideration, you stated that the approved menu in your administrative folder complies with the USDA requirements. You are correct, but Citation 4 relates to the posted menu at your program.

The Licensor noted that the posted menu at your program did not specify a milk type. The menu you provided on reconsideration includes “Milk (1%/skim),” but the menu that was posted on the day of the site visit stated “Milk.” Citation 4 is affirmed because the posted menu did not comply with the USDA requirements.

Citation 18

Violation. The program did not have documentation on site to show that 1 of 4 (SP13) staff persons met the experience requirements of the teacher job classification for which the staff person was employed (SP13).

Applicable Law. A teacher must meet the education and experience requirements. Minnesota Rules, part 9503.0032, subpart 2.

The license holder must ensure that a personnel record for each staff person is maintained at the center contains the staff person's documentation indicating that the staff person meets the requirements of the staff person's job position and the education and experience requirements. Minnesota Rules, part 9503.0120, item B.

The commissioner must be given access without prior notice and as often as the commissioner considers necessary if the commissioner is investigating alleged maltreatment, conducting a licensing inspection, or investigating an alleged violation of applicable laws or rules. (emphasis added). Minnesota Statutes, section 245A.04, subdivision 5(a).

Your Response. You stated that “SP13 is only qualified as a teacher aid.” You included SP13's PIP, and stated that the form has always been a part of SP13's employment file.

Reconsideration Determination. Citation 18 relates to SP13, and not SP5. On reconsideration, you provided SP5’s PIF. You did not provide any supporting documentation for SP13. SP13 was classified as a teacher on his/her PIF, however, the 1500 required hours of experience was missing. You are required to maintain a personnel file for SP13 at the center that contains documentation indicating that SP13 meets the requirements of a teacher classification. SP13’ s PIF did not show that SP13 met the1500 experience requirements of a teacher, therefore, Citation 18 is affirmed.

Disposition

The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citations 4 and 18 are affirmed. You did not request review for Citations 1 through 3, 5 through 17, and 19 through 23. Therefore, Citations 1 through 3, 5 through 17, and 19 through 23 are not under the scope of review. This is a final agency decision.

Previously Ordered Corrective Action. In the original Correction Order issued to you on August 11, 2025, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
