Dear Anthony Riccardi:
On December 10, 2025, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citation 1 in the Correction Order issued to you on date. You did not request reconsideration of any other citations; therefore, they are not under review.
Reconsideration Determination
Citation 1: The required staff-to-child ratios were not maintained. It was determined through conversations with staff persons that the Iceland classroom has been over ratio for
· Up to 30 minutes with 16 children and 3 staff persons on October 10th.
· All day for three days in early September with 14 children and 3 staff persons. (Iceland classroom: Infant classroom)
Your Request for Reconsideration. You provided a schedule for the Iceland classroom for October 10, 2025. You provided a report from the Kindertales account showing which children were in the Iceland classroom and what time the children were in the room, and which staff members were in the Iceland room that day. You also provided the time stamps and check-in times for staff members. You stated that you had five staff members in the Iceland classroom until the final morning moves were made by 9:15am, which left the Iceland room at seven children for the day with two staff members. Finally, you also asked for reconsideration for the accusations of being out of ratio in early September.
Applicable Law. Staff-to-child ratios and maximum group size. Minnesota Rules, part 9503.0040, subpart 1. Except as provided in subpart 2, the minimally acceptable staff-to-child ratios and the maximum group size within each age category are:

Reconsideration Determination. Regarding being out of staff to child ratio up to 30 minutes with 16 children and three staff persons on October 10th, the Licensor interviewed three staff persons who are regularly in the infant classrooms. Two of three staff persons stated that the Iceland classroom had been out of ratio multiple times in September and October 2025, including October 10, 2025. Citation 1 is affirmed because there is sufficient evidence to show that the required staff-to-child ratios were not maintained in the Iceland classroom: · Up to 30 minutes with 16 children and 3 staff persons on October 10th.

Regarding the documentation that you provided on reconsideration, your plan indicated where staff were scheduled to be not whether staff were present. The Licensor noted during the staff interviews that staff stated that other staff person(s) were not always where they were supposed to be, which caused the classroom to be out of ratio. Citation 1 is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all of the information you submitted in response to the Correction Order. Citation 1 is affirmed. You did not request reconsideration of any other citations; therefore, they are not under review. This is a final agency decision.
Previously Ordered Corrective Action. In the original Correction Order, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
