May 12, 2026 Abdurahman Jama, Authorized Agent Mercy Link LLC 7400 Metro Boulevard Suite 150 Minneapolis, Minnesota 55439 License Number: 1080519 (245D – HCBS) CORRECTION ORDER Dear Abdurahman Jama: On April 23, 2026, a licensing review of Mercy Link LLC, located at 7400 Metro Boulevard, Minneapolis, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245D.05, subdivision 2 and 4. Violation: For one of four persons whose record was reviewed (P3), the license holder did not document, review and report medication administration as required. The license holder was assigned responsibility of administering P3’s medications. The license holder did not ensure the following information was documented in P3’s medication administration record (MAR) over 700 instances between October 2025 and April 2026: · notation of any occurrence of a dose of medication not being administered or treatment not performed as prescribed, whether by error by the staff or the person or by refusal by the person, or of adverse reactions, and when and to whom the report was made; and · notation of when a medication or treatment is started, administered, changed, or discontinued. Additionally, the license holder completed MAR reviews from October 2025 to March 2026. The medication reviews that did not identify medication administration errors. Corrective Action Ordered: Within 30 days of receiving this order, you must: · ensure the information mentioned above is documented on P3’s MARs; · document any errors on the MAR review; · report any errors to P3’s legal representative and P3’s case manager On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.07, subdivision 1. Violation: For one person whose record was reviewed (P3), the license holder did not comply with the requirements of the federal waiver plan as required. The license holder did not provide services as assigned in P3’s support plan. P3 has a rate exception that details, “Staff have been trained more extensively by Mercy Link and outside training provided by St Peters Hospital and DHS Metro Mobile team who have created training programs”. The license holder did not provide the required training to staff that provided services to P3. Corrective Action Ordered: Within 30 days of receiving this order, you must train all your staff that provide services to P3 according to P3’s support plan and rate exception. On an ongoing basis, you must maintain compliance as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.071, subdivision 4, paragraph (b). Violation: For one person whose record was reviewed (P3), the license holder did not document service outcomes and supports as required. The license holder did not document the supports and methods to be implemented to support P3 and to accomplish outcomes related to acquiring, retaining, or improving skills and physical, mental, and emotional health and well-being, including: · the methods or actions that will be used to support the person and to accomplish the service outcomes, including information about any changes or modifications to the physical and social environments necessary when the service supports are provided; and · the measurable and observable criteria for identifying when the desired outcomes had been achieved. Repeat Violation: In a Conditional Order that DHS issued on August 28, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must: · develop and document supports and methods that include the information listed above in P3’s support plan addendum; · provide training to all staff that work with P3 on the updated support plan addendum; and · maintain documentation of staff training according to Minnesota Statutes, section 245D.095, subdivision 5. On an ongoing basis, you must maintain compliance as required in this subdivision. 4. Citation: Minnesota Statutes, section 245A.04, subdivision 1, paragraph (c). Violation: For one of six staff persons whose record was reviewed (SP4), the license holder did not provide orientation on the program’s drug and alcohol policy as required. The license holder did not provide orientation to the program’s drug and alcohol policy to SP4, prior to having direct contact with a person served by the program. Corrective Action Ordered: Within 30 days of receiving this order, you must provide training on your drug and alcohol policy to SP4. On an ongoing basis, you must maintain compliance as required in this subdivision. 5. Citation: Minnesota Statutes, section 245D.09, subdivisions 4 and 4a. Violation: For one staff person whose records were reviewed (SP4), the license holder did not provide orientation as required. a. The license holder did not provide SP4 basic first aid within 60 days of SP4’s hire date. b. The license holder did not provide SP4 with orientation to individual service recipients to achieve and demonstrate an understanding of the person as a unique individual, and how to implement the plans including: · the person’s support plan or support plan addendum as it relates to the responsibilities assigned to the license holder; and · the person’s individual abuse prevention plan. Repeat Violation: In a Conditional Order that DHS issued on August 28, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP4 with orientation to: · basic first aid; · individual service recipient needs as detailed above; and · document this orientation in SP4’s personnel record. On an ongoing basis, you must maintain compliance as required in this subdivision. 6. Citation: Minnesota Statutes, section 245D.09, subdivision 5. Violation: For two staff persons whose records were reviewed (SP1 and SP3), the license holder did not provide annual training as required. 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year. a. The license holder did not provide SP1 with annual training in the following areas in 2026: · the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person; · the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint in; and · staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe. b. The license holder did not provide SP3 with basic first aid training annually in 2026. Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1 and SP3 with the above-mentioned annual training and document the training in their personnel records. On an ongoing basis, you must maintain compliance as required in this subdivision. 7. Citation: Minnesota Statutes, section 245D.95, subdivision 5. Violation: For two staff persons whose records were reviewed (SP2 and SP5), the license holder did not maintain personnel records as required. The license holder did not maintain personnel records that included: · documentation of SP2’s training that included the number of hours per subject area; and · documentation of SP5’s training that included the number of hours per subject area and the name of the trainer or instructor. Repeat Violation: In a Conditional Order that DHS issued on August 28, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
