CORRECTION ORDER

Dear Salah Mohamud Ahmed:

On March 30 through April 02, 2026, a Department of Human Services (DHS) licensors conducted a licensing review at your facility, Reliance Recovery Center LLC located at 1821 University Ave W STE 128, St. Paul, MN 55104-2891. This review was conducted to determine compliance with state and federal laws and rules governing the provision of Substance Use Disorder Treatment under Minnesota Statute, chapter 245G. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that your program did not follow licensing rules and statutes, as described below.

Policies, Procedures, and Practices

1. Violation: The license holder did not meet requirements for receiving public funding reimbursement from the commissioner. Five hours of group counseling were billed for; however, there was no supporting documentation in the client file (client file numbered 5).

Statutes Violated: Minnesota Statues, section 245A.167.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure and document that services are provided in the amount and type for which they were billed. Additionally, the noncompliance identified above may result in nonpayment of claims submitted by the license holder for public program reimbursement; recovery of payments made for the service; disenrollment in the public payment program; or other administrative, civil, or criminal penalties as provided by law.

2. Violation: The license holder did not develop program policies and procedures necessary to maintain compliance with licensing requirements. The license holder’s service termination policy was not updated to include current titles of each staff member authorized to terminate services for a client. The policy included the name of a staff person who no longer works at the program.

Statute Violated: Minnesota Statues, sections 245A.04, subdivision 14, paragraph (a) and 245G.14, subdivision 3, clause (7).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that program policies and procedures meet all applicable requirements. Within 30 days of receipt of this order, submit a service termination policy that meets all applicable requirements.

3. Violation: The license holder did not meet requirements governing client rights protection. The license holder’s policy did not include the rights identified in Minnesota Statutes, sections 144.651 and 148F.165.

Statute Violated: Minnesota Statutes, section 245G.15, subdivision 1.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that client rights protection meet all applicable requirements. Within 30 days of receipt of this order, submit a client rights policy that meets all applicable requirements.

4. Violation: The license holder did not meet requirements governing the provision of telehealth services. The license holder did not meet the requirements in Minnesota Statutes, section 256B.0625, subdivision 3b.

Statute Violated: Minnesota Statutes, section 245G.07, subdivision 4, paragraph (c), clause (2).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that telehealth services meet all applicable requirements. Within 30 days of receipt of this order, submit a telehealth policy that meets all applicable requirements.

5. Violation: The license holder did not meet requirements governing the reporting of maltreatment vulnerable adults. The license holder’s policy did not identify a secondary person responsible for forwarding internal reports to the common entry point.

Statute Violated: Minnesota Statutes, sections 245A.65, subdivision 1, paragraph (a), clause (2) and 245G.12, clause (9).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the reporting of maltreatment of vulnerable adults meets all applicable requirements. Within 30 days of receipt of this order, submit a maltreatment of vulnerable adult policy that meets all applicable requirements.

6. Violation: The license holder did not meet requirements governing personnel policies and procedures as follows:

a. Job descriptions did not meet requirements. The job descriptions did not contain the following:

i. Responsibilities;

ii. The degree of authority to execute job responsibilities; and

iii. Qualification requirements; and

b. The personnel policies did not provide for a job performance evaluation, including a written annual review.

Statute Violated: Minnesota Statutes, section 245G.13, subdivision 1, clauses (2) and (3).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that personnel policies meet all applicable requirements. Within 30 days of receipt of this order, submit revised personnel policies that meets all applicable requirements.

7. Violation: The license holder did not follow their policy for reporting a death in the program. There was no documentation that the program notified the commissioner within 24 hours of receiving knowledge of the death on December 01, 2025.

Statute Violated: Minnesota Statutes, section 245A.04, subdivision 16.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that reporting a death in the program meets all applicable requirements.

8. Violation: The license holder did not meet requirements governing the plan for transfer of clients and records upon closure. There was no documentation of a signed agreement or other documentation indicating that a county or a similarly licensed provider has agreed to accept and maintain the program's closed case records and to provide follow-up services as necessary to affected clients.

Statute Violated: Minnesota Statutes, section 245A.04, subdivision 15a, paragraph (c).

Corrective Action Order: Immediately and on an ongoing basis, the license holder must ensure that transfer of clients and records meet all applicable requirements. Within 30 days of receipt of this order, submit a transfer of clients and records policy and signed agreement that meets all applicable requirements.

9. Violation: The license holder did not meet requirements governing client property management. The license holder did not monitor the implementation of their client property management policy. The policy stated that the program did not take possession of any client property; however, it was identified through staff and client interviews that the program’s practice is to take possession of client’s cell phones and would not document the receipt or disbursement.

Statute Violated: Minnesota Statute, section 245A.04, subdivisions 13, paragraph (c), clause (1) and 14, paragraph (b), clause (3).

Corrective Action Order: Immediately and on an ongoing basis, the license holder must ensure that transfer of clients and records meet all applicable requirements. Within 30 days of receipt of this order, submit a client funds and property policy that meets all applicable requirements.

Personnel Files

10. Violation: One personnel file reviewed for requirements governing treatment director qualifications (personnel file numbered 4) did not meet requirements. There was no documentation that the treatment director knew and understood the implication of Minnesota Statutes, chapter 245G, sections 626.557 and 626.5572, and chapters 245A and 260E.

Statute Violated: Minnesota Statutes, section 245G.11, subdivision 3, clause (3).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the treatment director meets all applicable qualifications.

11. Violation: One of two files reviewed for requirements governing individuals with a temporary permit (personnel file numbered 2) did not meet requirements as follows:

a. There was no documentation of weekly supervision for the weeks of July 14, 2025 through October 31, 2025 and February 01, 2026 through March 30, 2026; and

b. Documentation of weekly supervision did not include the amount of supervision provided for the weeks of February 06, 2025 through July 07, 2025.

Statute Violated: Minnesota Statutes, section 245G.11, subdivision 11, paragraph (a).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that individuals with temporary permits meet all applicable requirements. Within 30 days of receipt of this order, submit documentation of two weeks of supervision that meets all applicable requirements.

12. Violation: Four of four files reviewed for staff orientation requirements did not meet requirements. There was no documentation of the following:

a. Within 24 working hours (personnel files numbered 1 through 4):

i. Specific job responsibilities;

ii. Policies and procedures;

iii. Client needs; and

b. Before direct client contact, training in emergency overdose treatment (personnel files numbered 1 through 4);

c. Within six months of employment, twelve hours of training in co-occurring disorders (personnel file numbered 2).

Staute Violated: Minnesota Statutes, sections 245A.242, subdivision 2, paragraph (a), 245G.08, subdivision 3, and 245G.13, subdivisions 1, clause (7) and 2, paragraph (f).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that staff orientation meets all applicable requirements. Within 30 days of receipt of this order, submit orientation documentation for the staff identified above that meets all applicable requirements.

13. Violation: Two of two personnel files reviewed for requirements governing annual training requirements. There was no documentation of annual reviews completed for the following:

a. The program abuse prevention plan for calendar year:

i. 2025 (personnel file numbered 4); and

ii. 2026 (personnel files numbered 2);

b. All internal policies and procedures related to the prevention and reporting of maltreatment of vulnerable adults for calendar year 2026 (personnel file numbered 2);

c. Mandatory reporting requirements as specified in Minnesota Statutes, chapter 260E for calendar year 2026 (personnel file numbered 2); and

d. HIV Minimum Standards for calendar year:

i. 2025 (personnel file numbered 4); and

ii. 2026 (personnel file numbered 2).

Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b), 245A.65, subdivision 3, and 245G.13, subdivision 2, paragraphs (c) and (d).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that annual staff training meets all applicable requirements. Within 30 days of receipt of this order, submit documentation that the staff identified above completed all annual training requirements.

14. Violation: Three of four personnel files reviewed for requirements governing personnel file contents did not meet requirements. There was no documentation of the following:

a. Staff member qualifications for employment (personnel files numbered 2 through 4); and

b. The first date that a background study subject had direct contact (personnel files numbered 1 and 3).

Statute Violated: Minnesota Statutes, sections 245A.041, subdivision 6 and 245G.13, subdivision 3, clause (1).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that personnel file contents meet all applicable requirements.

Client Files

15. Violation: One of five client files reviewed for requirements governing client orientation (client file numbered 4) did not meet requirements. There was no documentation as follows:

a. On day of service initiation:

i. A written statement of client rights and responsibilities as identified in Minnesota Statutes, sections 148F.165 and 144.651;

ii. Grievance procedure; and

iii. Opioid education material; and

b. Within 24 hours of admission to the program:

i. The internal and external reporting policies for maltreatment of vulnerable adults; and

ii. Program abuse prevention plan; and

c. Within 72 hours of admission to the program:

i. HIV minimum standards; and

ii. Tuberculosis and tuberculosis screening.

Statute Violated: Minnesota Statute, sections 245A.19, paragraph (b), 245A.65, subdivisions 1, paragraph (c) and 2, paragraph (a), clause (4), 245G.04, subdivision 3, 245G.09, subdivision 3, paragraph (a), clause (1) 245G.15, subdivisions 1 and 2.

Correction Action Required: Immediately, and on an ongoing basis, the license holder must ensure that client orientation meets all applicable requirements.

16. Two of five client files reviewed for requirements governing initial service plans (ISP) did not meet requirements as follows:

a. The ISP was not completed within 24 hours of the day of service initiation (client file numbered 4); and

b. The ISP did not identify treatment needs to be addressed during the time between the day of service initiation and development of the individual treatment plan (client file numbered 1).

Statute Violated: Minnesota Statutes, section 245G.04, subdivision 1.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure initial services plans meet all applicable requirements.

17. Violation: One of five client files reviewed for requirements governing vulnerable adult assessment and determination (client file numbered 4) did not meet requirements. The vulnerable adult assessment and determination was not completed within 24 hours of service initiation.

Statute Violated: Minnesota Statutes, section 245G.04, subdivision 2, paragraph (a).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure vulnerable adult assessment and determinations meet all applicable requirements.

18. Violation: Four of four client files reviewed for requirements governing comprehensive assessments did not meet requirements as follows:

a. There was no documentation of a comprehensive assessment review and update completed by the end of the fifth day on which a treatment service was provided (client files numbered 1 through 3); and

b. The comprehensive assessment did not document the following (client file numbered 4):

i. The client’s description of the client’s symptoms;

ii. The client’s resources; and

iii. A recommendation for the ASAM level of care identified in Minnesota Statutes, section 254B.19, subdivision 1.

Statute Violated: Minnesota Statutes, section 245G.05, subdivisions 1, paragraph (c) and 3.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure comprehensive assessments meet all applicable requirements.

19. Violation: Four of four client files reviewed for requirements governing individual treatment plans (ITP) did not meet requirements as follows:

a. The ITP was not completed by the end of the tenth day on which a treatment session had been provided (client files numbered 1 through 4);

b. The ITP was not updated based on new information gathered about the client’s condition (client file numbered 2); and

c. The ITP did not document the following (client files numbered 1 and 2):

i. A treatment strategy; and

ii. The ASAM level of care.

Statute Violated: Minnesota Statutes, section 245G.06, subdivisions 1 and 1a, paragraph (a), clauses (3) and (4).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure individual treatment plans meet all applicable requirements. Within 30 days of receipt of this order, submit two individual treatment plans that meet all applicable requirements.

20. Violation: Four of four client files reviewed for requirements governing documentation of treatment services did not meet requirements. There was no documentation of the following:

a. Type of treatment service provided on the following dates:

i. January 12 through 15, February 18, and March 9 through 12, 2026 (client file numbered 1);

ii. January 26 through 29, February 16, 17, March 9, 11, and 12, 2026 (client file numbered 2); and

iii. July 22 through 24, 28, August 8, and October 29, 2025 (client file numbered 4);

b. Amount of treatment service provided on the following dates:

i. January 12 through 15, February 18, and March 9 through 12, 2026 (client file numbered 1);

ii. January 26 through 29, February 16, 17, and March 9 through 12, 2026 (client file numbered 2);

iii. February 5, 9, 11, 12, 16 through 19, and 24, 2026 (client file numbered 3); and

iv. July 22 through 24, 28, August 8, and October 29, 2025 (client file numbered 4); and

c. Documentation was not completed within seven days of providing the treatment service on March 09, 2026 (client file numbered 1).

Statute Violated: Minnesota Statutes, section 245G.06, subdivision 2a.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure documentation of treatment services meet all applicable requirements. Within 30 days of receipt of this order, submit two treatment services documentation notes that meet all applicable requirements.

21. Violation: Two of two files reviewed for requirements governing services provided via telehealth did not meet requirements. There was no documentation of the license holder’s basis for determining that telehealth is an appropriate and effective means for delivering the treatment service, the mode of transmission used to deliver the service, and the location of the originating site and the distance site on:

a. February 15, 21, and March 14, 2026 (client file numbered 1); and

b. February 13 and March 5, 202 (client file numbered 2).

Staute Violated: Minnesota Statues, section 245G.07, subdivision 4, paragraph (c), clause (2).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that services provided by telehealth meet all applicable requirements. Within 30 days, submit one documentation of telehealth services note that meets all applicable requirements.

22. Violation: One of three client files reviewed for requirements governing client records (client file numbered 1) did not meet requirements. A note dated March 2, 2026 inaccurately identified the service as being completed in person; however, staff interviews confirmed it was completed via telehealth.

Statute Violated: Minnesota Statutes, section 245G.06, subdivision 2b, paragraph (c).

23. Violation: Two of two client files reviewed for requirements governing treatment plan reviews did not meet requirements. There was no documentation of the following:

a. Whether the identified methods continued to be effective (client file numbered 1);

b. Monitoring of mental health problems (client file numbered 1); and

c. The participation of others involved in the individual’s treatment planning (client files numbered 1 and 2).

Statute Violated: Minnesota Statutes, section 245G.06, subdivision 3, clauses (1) through (3).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that treatment plan reviews meet all applicable requirements.
