CORRECTION ORDER

Dear Oladipo Cornelius Ajayi:

On May 20, 2026, a licensing review of Dominion Cares, located at 555 3rd Avenue Northwest, Suite B, Hutchinson, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes, section 245A.65, subdivision 2.

Violation: For one of four persons whose record was reviewed (P3), the license holder did not develop and review the individual abuse prevention plan (IAPP) as required.

245A.02, subdivision 2b defines annual or annually as prior to or within the same month of the subsequent calendar year.

The license holder did not review P3’s IAPP annually in January 2026. This was completed in February 2026.

Repeat Violation: In a Correction Order that DHS issued on January 28, 2026, you were previously found in violation of this same statute.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required.

2. Citation: Minnesota Statutes, section 245D.04, subdivision 1.

Violation: For one person whose record was reviewed (P3), the license holder did not provide the service recipient rights as required.

The license holder did not provide P3 with a written notice that identified the service recipient rights in subdivisions 2 and 3, and an explanation of those rights annually in January 2026. This was provided in February 2026.

Repeat Violation: In a Correction Order that DHS issued on January 28, 2026, you were previously found in violation of this same statute.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required.

3. Citation: Minnesota Statutes, section 245D.07, subdivision 2.

Violation: For four persons whose records were reviewed (P1-P4), the license holder did not complete responsibilities related to service planning for basic support services as required.

The license holder did not ensure that P1-P4’s support plan addendum identified how services were to be provided for each service, including how, when and by whom.

Corrective Action Ordered: Within 30 days of receiving this order, you must review and update P1-P4’s support plan addendum to include how each of P1-P4’s services will be provided, including how, when and by whom. On an ongoing basis, you must maintain compliance as required in this subdivision.

4. Citation: Minnesota Statutes, section 245D.095, subdivision 3.

Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not maintain service recipient records as required.

The license holder did not provide annual written reports to P1 and P2, P1’s legal guardian, and P1 and P2’s case manager regarding P1 and P2’s progress or status that was assigned in P1 and P2’s support plan addendum.

Repeat Violation: In a Correction Order that DHS issued on January 28, 2026, you were previously found in violation of this same statute.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide P1 and P2, and their support team, a written report regarding the person’s progress or status. On an ongoing basis, you must maintain compliance as required in this subdivision.

5. Citation: Minnesota Statutes, section 245D.10, subdivision 4.

Violation: For one person whose record was reviewed (P4) the license holder did not inform and provide policies and procedures to the case manager as required.

The license holder did not inform and provide copies of the following policies and procedures affecting a person’s rights under section 245D.04 to P4’s case manager within five working days of service initiation January 30, 2026:

· grievance policy and procedure;

· service suspension policy and procedure;

· service termination policy and procedure; and

· emergency use of manual restraints policy and procedure.

The license holder provided the above-mentioned policies to P4’s case manager on March 4, 2026.

Repeat Violation: In a Correction Order that DHS issued on January 28, 2026, you were previously found in violation of this same statute.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required.

6. Citation: Minnesota Statutes, section 245D.081, subdivision 3.

Violation: The license holder did not ensure the designated managers provided program management and oversight as required.

The license holder did not ensure that the individual designated to provide program management and oversight completed corrective action ordered by the commissioner in a timely manner. In a correction order dated January 28, 2026, the license holder was ordered to make corrections within 30 days of receiving the order and maintain compliance as required. The license holder did not ensure the following corrective action was taken within 30 days of receiving the order as well as maintain compliance as required:

· provide SP2 and SP4 with training on required annual training topics. The license holder provided the training to SP2 on May 14, 2026 and to SP4 on May 15, 2026;

· provide annual written reports to P1 and P2, P1’s legal guardian, and P1 and P2’s case manager regarding P1 and P2’s progress or status;

· review P3’s IAPP on an annual basis;

· provide P3 the service recipient rights on an annual basis; and

· provide P4’s case manager with the required policies and procedures within five working days of service initiation.

  

Corrective Action Ordered: Within 30 days of receiving this order, the individual identified as the designated manager for your program must review the duties associated with this role, as specified in 245D.081, subdivision 3. You must maintain a signed acknowledgment of these duties in their personnel record. On an ongoing basis, you must ensure that corrective action ordered by the commissioner is completed as ordered, including within the specified timelines, as required in this subdivision.

7. Citation: Minnesota Statutes, section 245D.09, subdivision 5.

Violation: For four of four staff persons whose records were reviewed (SP1-SP4), the license holder did not provide annual training as required.

a. The license holder did not provide SP1-SP4 with annual training on the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04 in 2026.

b. The license holder did not provide SP4 with annual training on basic first aid in December 2025. The license holder provided first aid training to SP4 in March 2026.

Repeat Violation: In a Correction Order that DHS issued on January 28, 2026, you were previously found in violation of this same statute.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1-SP4 with training on the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights. You must also audit all personnel files in your program to ensure that all staff persons receive this training. On an ongoing basis, you must maintain compliance as required in this subdivision.

If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
