CORRECTION ORDER

Dear Ubah Ali:

On April 8, 2026, a licensing review and investigation of Unity Home Care Inc located at 2738 Winnetka Avenue North Suite 150B, New Hope, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review and investigation a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review and investigation. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes section 245A.65, subdivision 2, paragraph (b).

Violation: For one of five persons whose record was reviewed (P4), the license holder did not develop and review an individual abuse prevention plan (IAPP) as required.

a. The license holder initiated individualized home supports with training services for P4 on May 4, 2024. The license holder did not develop an IAPP for P4 as part of the initial individual service plan. The license holder developed an IAPP for P4 on July 11, 2024. Additionally, the license holder did not review P4’s IAPP with the interdisciplinary at least annually in 2025. The license holder reviewed P4’s IAPP on December 23, 2025.

b. The license holder initiated night supervision services for P4 in August 2024. The license holder did not develop an IAPP for P4 that contained an individualized assessment of P4’s susceptibility to abuse, including self-abuse, and did not include statements of specific measures to be taken to minimize the risk of abuse to P4. During the licensing review, the license holder verbally explained why P4 needed night supervision and identified areas of risk to P4. The license holder did not identify these risks in P4’s most recent IAPP dated December 23, 2025.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· review and revise P4’s IAPP to include in individualized assessment of P4’s susceptibility to abuse and include statements of the specific measures your program will take to minimize the identified risks to P4;

· provide P4’s support team an opportunity to review the IAPP for P4;

· provide all staff persons providing services to P4 with training on P4’s revised IAPP; and

· maintain documentation of this training in the staff person’s personnel records as required in Minnesota Statutes, section 245D.095, subdivision 5.

Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

2. Citation: Minnesota Statutes, section 245D.04, subdivision 1.

Violation: For one person whose record was reviewed (P4), the license holder did not provide the service recipient rights as required.

Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.

The license holder did not provide P4 with a written notice that identified the service recipient rights and an explanation of those rights annually in 2025. The license holder provided this notice to P4 in July 2024 and December 2025.

Corrective Action Ordered: Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

3. Citation: Minnesota Statutes, section 245D.05, subdivision 1.

Violation: For two persons whose records were reviewed (P4 and P5), the license holder did not document health needs as required.

a. P4’s support plan addendum developed by the license holder documented that P4 self-managed their medications. During the licensing review, the license holder called P4 to clarify what supports P4 needed during night supervision services. P4 reported needing support with medications. The license holder did not maintain documentation on how P4’s health needs would be met that included a description of the procedures the license holder would follow in order to provide medication setup, assistance, or administration.

b. Regarding report number 202602120, the license holder maintained log notes in P5’s record that documented multiple occurrences of SP3 assisting P5 with health needs that included the use of medical equipment, devices, or adaptive aids or technology. The license holder did not maintain documentation on how P5’s health needs would be met that included a description of the procedures the license holder would follow in order to use medical equipment, devices, or adaptive aids or technology safely and correctly according to written instructions from a license health professional.

The license holder no longer provided services to P5 at the time of the licensing review.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· maintain documentation on how P4’s health needs will be met that includes a description of the procedures you will follow in order to provide medication setup, assistance, or administration;

· provide all staff persons providing services to P4 with training on P4’s health needs; and

· maintain documentation of this training in the staff person’s personnel records as required in Minnesota Statutes, section 245D.095, subdivision 5.

Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.   

4. Citation: Minnesota Statutes, section 245D.06, subdivision 1, and section 245D.11, subdivision 2, clause (7).

Violation: For one person whose record was reviewed (P3), the license holder did not maintain information about and report incidents as required.

Regarding an incident involving P3 on September 18, 2025, the license holder did not:

· report this incident to P3’s case manager within 24 hours. The license holder reported this incident to P3’s case manager on September 24, 2025;

· maintain an incident report that included:

o the name of the staff person who responded to the incident; and

o whether P3’s support plan addendum or program policies and procedures were implemented as applicable.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· complete a review of the incident identified above for P3; and

· maintain documentation of this review in P3’s record.

Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

5. Citation: Minnesota Statutes, section 245D.07, subdivision 1.

Violation: For three persons whose records were reviewed (P1, P3, and P4), the license holder did not provide services as assigned in the support plan and in compliance with the requirements of this chapter and the federal waiver plan.

a. The license holder provided integrated community supports (ICS) to P1. The license holder did not provide services according to the federal waiver plan and did not provide services as assigned in the support plan in the following ways:

· the license holder maintained log notes that documented staff and P1 ran errands for P1’s family member on January 15, 2026;

· the license holder maintained log notes that documented staff provided transportation for P1 to P1’s family member’s house with no other supports or training being offered to P1 at this time; and

· the license holder did not provide P1 with staffing for the daily average number of direct contact hours and remote hours authorized in P1’s support plan on multiple dates from February 20, 2026, to April 5, 2026. The license holder maintained information in P1’s record that showed the license holder provided P1 with ICS in-person and remotely on the same dates at overlapping times.

b. The license holder provided integrated community supports (ICS) to P3. The license holder did not provide services according to the federal waiver plan and did not provide services as assigned in the support plan in the following ways:

· the license holder documented that SP4 provided remote support to P3 from 7 a.m. to 10 a.m. on April 8, 2026, which was the date of this licensing review. DHS licensors arrived at the program around 9 a.m. and met with SP4. SP4 was not observed to be engaged with P3 using live, two-way communication from 9 a.m. to 10 a.m.;

· the license holder completed household management for P3 without cueing, supervision, training, or instructional support on multiple occasions when the license holder completed errands for P3 in the absence of P3 from January 2026 through March 2026; and

· the license holder did not provide P3 with staffing for the daily average number of direct contact hours and remote hours authorized in P3’s support plan on average from May 2025 to July 2025. P3’s support plan authorized an average of 6 in-person hours and 4 remote hours of ICS services daily. The license holder did not provide P3 in-person support through the delivery of ICS during this timeframe.

c. The license holder provided night supervision services to P4. The license holder did not provide services according to the federal waiver plan when the license holder maintained documentation that indicated night supervision was being provided to P4 during awake hours. Timecards and log notes showed that night supervision was being provided to P4 from as early as 3:30 p.m. to midnight. P4’s support plan stated P4 “generally goes to bed about midnight and wakes up about 11 a.m.” Additionally, the log notes indicated that while providing P4 with night supervision services during daytime hours, the staff person was completing tasks such as making dinner, doing laundry, and running errands.

Corrective Action Ordered: Immediately, you must begin providing services as assigned in the support plan and according to the requirements of the federal waiver plan. Concerns regarding services not delivered as assigned in the support plan and in compliance with the federal waiver plan were referred to the Department of Human Services, Office of Inspector General, Program Integrity and Oversight Division. Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

6. Citation: Minnesota Statutes, section 245D.07, subdivision 1a.

Violation: For one person whose record was reviewed (P4), the license holder did not provide person-centered planning and service delivery as required.

The license holder did not provide services in response to P4’s needs, as assigned in the support plan and support plan addendum. The license holder developed an IAPP as part of P4’s support plan addendum on July 11, 2024. When assessing P4’s susceptibility to abuse, the license holder documented that P4 had a history of physical abuse and stated that the license holder will develop a safety plan for P4, assisting P4 with identifying red flags, healthy relationships, and outlining steps to take when P4 feels unsafe including identifying safe places to go and safe people P4 could reach. The license holder did not develop this safety plan for P4.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· develop the safety plan referenced in P1’s IAPP and ensure this plan is consistent with P4’s identified needs;

· provide all staff persons providing services to P4 with training on P4’s safety plan; and

· maintain documentation of this training in the staff person’s personnel record as required in Minnesota Statutes, section 245D.095, subdivision 5.

Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

7. Citation: Minnesota Statutes, section 245D.07, subdivision 2, paragraphs (b) and (c).

Violation: For one person whose record was reviewed (P4), the license holder did not complete initial service planning for a basic service as required.

The license holder initiated individualized home supports with training services for P4 on May 4, 2024, and initiated night supervision services for P4 in August 2024. The license holder did not complete a preliminary support plan addendum based on the support plan within 15 calendar days of service initiation and did not, within 60 calendar days of service initiation, document the services that would be provided including how, when, and by whom the services will be provided and the person responsible for overseeing the delivery and coordination of services.

Corrective Action Ordered: Within 30 days of receiving this order, you must document the information required above in P4’s support plan addendum for each service you are providing P4 that requires basic service planning. Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

8. Citation: Minnesota Statutes, section 245D.071, subdivision 4.

Violation: For one person whose record was reviewed (P1), the license holder did not implement the supports and methods related to accomplishing outcomes as required.

The license holder developed supports and methods to be implemented to support P1 in accomplishing outcomes that stated staff will collect data on P1’s outcome that included the date, location, type of activity, and P1’s level of participation. The license holder did not implement the supports and methods related to data collection as the license holder did not maintain documentation on P1’s outcome that included the location and type of activity.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide staff persons providing services to P1 with training on the implementation of P1’s supports and methods. Additionally, you must verify and maintain evidence of staff competency as required in Minnesota Statutes, section 245D.09, subdivision 3, paragraph (a). Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

9. Citation: Minnesota Statutes, section 245D.095, subdivision 3.

Violation: For one person whose record was reviewed (P4), the license holder did not maintain service recipient records as required.

Timecards maintained by the license holder showed that multiple services were provided to P4 on multiple dates between February 5, 2026, and April 6, 2026. The license holder did not maintain progress or daily log notes that were recorded by the program in P4’s service recipient record for services provided during this timeframe.

Corrective Action Ordered: Within 30 days of receiving this order, you must maintain the information required above in P4’s service recipient record. Concerns regarding the provider’s progress or daily log notes and billing for home and community-based services were referred to the Department of Human Services, Office of Inspector General, Program Integrity and Oversight Division. Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

10. Citation: Minnesota Statutes, section 245D.095, subdivision 4.

Violation: For two persons whose records were reviewed (P1 and P3), the license holder did not ensure access to service recipient records as required.

The license holder did not ensure that staff persons providing services to P1 and P3 had access to P1’s and P3’s service information, including access to P1’s and P3’s supports and methods for implementing P1’s and P3’s identified outcomes.

Corrective Action Ordered: Within 30 days of receiving this order, you must ensure that all direct support staff providing services licensed under this chapter have access to the information relevant to carrying out the person’s support plan or support plan addendum. Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

11. Citation: Minnesota Statutes, section 245D.10, subdivision 4, paragraph (b).

Violation: For one person whose record was reviewed (P4), the license holder did not provide policies and procedures as required.

The license holder did not inform and provide P4’s case manager with copies of the policies and procedures affecting a person’s rights within five working days of service initiation. P4’s services were initiated on May 4, 2024. The license holder provided these policies to P4’s case manager on July 11, 2024.

Corrective Action Ordered: Compliance with this order will be monitored onsite. On an ongoing basis you must maintain compliance as required in this subdivision.

12. Citation: Minnesota Rules, part 9544.0110.

Violation: For one person whose record was reviewed (P3), the license holder did not use the behavior intervention reporting form (BIRF) to report incidents as required by the commissioner.

The license holder did not use the BIRF to report a behavioral incident involving P3, resulting in the program calling 911 on September 18, 2025.

  Corrective Action Ordered: Within 30 days of receiving this order, you must:

· utilize the BIRF to report the above mentioned incident involving P3 to the commissioner; and

· maintain documentation of this report in P3’s record.

Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

13. Citation: Minnesota Statutes, section 245D.09, subdivision 5.

Violation: For two of four staff persons whose records were reviewed (SP1 and SP2), the license holder did not provide annual training as required.

Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.

a. The license holder did not provide SP1 and SP2 with training on the principles of person-centered service planning and delivery as identified in Minnesota Statutes, section 245D.07, subdivision 1a, and how they applied to direct support service provided by the staff person in 2025.

b. The license holder did not provide SP2 with training on the required topics annually in 2026. The license holder provided SP2 with training on the required topics, with the exception of the principles of person centered planning, in January 2025 and February 2026.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1 and SP2 with training on the principles of person-centered service planning and delivery as identified in Minnesota Statutes, section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person. Additionally, you must maintain documentation of this training in SP1’s and SP2’s personnel records as required in Minnesota Statutes, section 245D.095, subdivision 5. Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

14. Citation: Minnesota Statutes, section 245A.65, subdivision 2, paragraph (a).

Violation: The license holder did not establish a written program abuse prevention plan (PAPP) as required.

The license holder provided services licensed under this chapter at a location that was within the control of the license holder. The license holder did not establish a written PAPP that assessed the population, the physical plant, and the environment within the control of the license holder and the location where licensed services were provided.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· establish a written PAPP for any location where you provide services licensed under this chapter and are within your control;

· post the PAPP in a prominent location in the program;

· provide any person receiving services at these locations with an orientation to the PAPP;

· maintain documentation of this orientation in each person’s record;

· provide any staff persons providing services at these locations with an orientation to the PAPP; and

· maintain documentation of this orientation in each staff person’s personnel record as required in Minnesota Statutes, section 245D.095, subdivision 5.

Compliance with this order will be monitored onsite. On an ongoing basis, you must maintain compliance as required in this subdivision.

If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:
