AMENDED ORDER OF LICENSE DENIAL
Dear Salman Ahmed Elmi: NOTICE: This Amended Order of License Denial superseded an Order of License Denial dated March 12, 2026, which must be destroyed. The Department of Human Services, Division of Licensing (“DHS”) received additional information related to the disqualification of a controlling individual. The Department of Human Services (DHS) is denying your application for a Substance Use Disorder Treatment license at 701 Decatur Ave N Suite 206, Golden Valley, Minnesota 55427. This denial is based on a controlling individual being the subject of pending administrative and criminal investigations and the disqualification of a controlling individual. Details of our findings are provided below. Our next steps and your options are also detailed. REASON FOR LICENSE DENIAL
1. Subject of a pending criminal investigation
CI1 and CI2 were identified as controlling individuals on your license application. On February 24, 2026, a search warrant was issued by the Fourth Judicial District of the State of Minnesota after the District Court Judge found probable cause existed for the search warrant, which related to a current investigation into a commercial sex trafficking organization. The application for the search warrant alleges that CI2 is operating a sex trafficking organization and CI1 is a known associate. Legal Authority: Minnesota Statutes, section 245A.05, subdivision (a)(11). 2. Disqualification of a controlling individual
· On March 9, 2026, DHS notified you that CI2 had a disqualification. On the same date, DHS notified CI2 of the disqualification and the right to request reconsideration.
On April 06, 2026, CI2 requested reconsideration of the disqualification. On April 17, 2026, DHS notified CI1 that the disqualification was affirmed and that the Commissioner may not grant a variance for the disqualification. · On April 8, 2026, DHS notified you that CI1 had a disqualification. On the same date, DHS notified CI1 of the disqualification and the right to request reconsideration.
If CI1 does not submit a timely request for reconsideration, CI1’s disqualification will become final. If CI1 timely requests reconsideration, DHS will issue a decision on the disqualification. If the disqualification is upheld, the disqualification will be reviewed as part of the contested case hearing. Legal Authority: Minnesota Statutes, section 245A.05, subdivision (a)(4). 3. Commissioner’s evaluation of program
In determining whether a licensing action is warranted, DHS evaluated the facts, conditions, and circumstances concerning your program’s operation. This includes consideration of the program’s operation and the well-being of persons served by your program. Based on the pending criminal investigation and the disqualifications of CI1 and CI2, DHS does not have faith that you are able to operate a license that would comply with applicable statutes and rules. In addition, the search warrant application alleges that CI2’s sex trafficking organization targets vulnerable females with mental health concerns and substance abuse to recruit into the organization. The application is to provide substance use treatment, which would include the targeted vulnerable population. DHS cannot ensure that the health and safety of persons served by the program would be maintained and that persons served would receive the care to which they are entitled. DHS has determined that the denial of your license is appropriate based on the violation identified above. Legal Authority: Minnesota Statutes, section 245A.04, subdivision 6. Due to the serious and chronic nature of these violations, which impact the health and safety of persons served in your care, your license to provide substance use disorder treatment is denied. On April 02, 2026, DHS received your timely request for a contested case hearing, and the case has been scheduled for a hearing in front of an Administrative Law Judge at the Court of Administrative Hearings. · This action is taken under Minnesota Statutes, section 245A.05, subdivision (a), which describes under which conditions DHS may deny a license.
· “Controlling individual” is defined under Minnesota Statutes, section 245A.02, subdivision 5a.
· License holders have a right to appeal licensing actions and request a contested case hearing, under Minnesota Statutes, chapter 14 and Minnesota Rules, parts 1400.8505 to 1400.8612.
· Under Minnesota Statutes, section 245A.04, subdivision 7, paragraph (d), clause (2), the commissioner shall not issue or reissue a license if the applicant, license holder, or controlling individual has been denied a license under this chapter within the past two years.
