May 27, 2026 Angela Hansen, Authorized Agent Nuway House, Inc. 2217 Nicollet Ave Minneapolis, MN 55404 License Number: 801783 (2200 1st Ave S) License Number: 801784 (2518 1st Ave S) CORRECTION ORDER Dear Angela Hansen: On March 23, 24, 25, 26, and 27, 2026, Department of Human Services (DHS) licensors conducted a licensing review at your facilities located at the following: This review was conducted to determine compliance with state and federal laws and rules governing the provision of substance use disorder treatment statutes under Minnesota Statutes, chapter 245G. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS DHS determined that your program failed to follow licensing rules and statutes, as described below. Policies, Practices, and Procedures 1. Violation: The license holder did not meet requirements governing the description of treatment services (801783 and 801784). The treatment services description did not include the amounts and types of services provided. Statute Violated: Minnesota Statutes, section 245G.12, clause (10). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the treatment services description meets all applicable requirements. Within 30 days of receipt of this order, submit a treatment services description that meets all applicable requirements. 2. Violation: The license holder did not meet requirements governing co-occurring disorders (801783 and 801784). The co-occurring policies did not include flexibility for a client who may lapse in treatment or may have difficulty adhering to established treatment. Statute Violated: Minnesota Statutes, section 245G.20, clause (8). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the co-occurring policies meet all applicable requirements. Within 30 days of receipt of this order, submit a co-occurring policy that meets all applicable requirements. 3. Violation: The license holder did not meet requirements governing maltreatment of vulnerable adult internal reviews (801784). One of four internal reviews was not completed within 30 days when the facility had reason to know a report of alleged or suspected maltreatment was made on May 30, 2025. Statute Violated: Minnesota Statutes, section 245A.65, subdivision 1, paragraph (b), clause (1). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that vulnerable adult internal reviews meet all applicable requirements. Client Files Client files reviewed are identified in the following manner: 4. Violation: Two of six client files reviewed for requirements governing initial services plans (client files numbered 4 and 5) did not meet requirements. The initial services plan was not person-centered and client specific. Statute Violated: Minnesota Statutes, sections 245G.04, subdivision 1. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that initial services plans meet all applicable requirements. 5. Violation: Five of six client files reviewed for requirements governing individual abuse prevention plans did not meet requirements. The individual abuse prevention plan did not include the following: a. An individualized assessment of the person's susceptibility to abuse by other individuals (client files numbered 1 through 3, and 6); b. An individualized assessment of the person’s susceptibility to self-abuse (client file numbered 2); and c. An assessment of the person's risk of abusing other vulnerable adults (client files numbered 1 through 3, and 6). Statute Violated: Minnesota Statutes, sections 245A.65, subd. 2, paragraph (b), clause (1), 245G.04, subdivision 2, paragraph (b), and 245G.21, subdivision 5. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that individual abuse prevention plans meet all applicable requirements. Within 30 days of receipt of this order, submit one individual abuse prevention plans that meet all applicable requirements. 6. Violation: Five of six client files reviewed for requirements governing comprehensive assessments did not meet requirements. The comprehensive assessment did not include the following: a. The client's perceptions of the client's condition (client files numbered 2, 3, and 6); b. Substance use history, including types (client file numbered 6); c. The client's relationship with the client's family and other significant personal relationships, including the client's evaluation of the quality of each relationship (client file numbered 3); d. The client’s resources, including the extent of the client’s social networks (client file numbered 3); and e. Important developmental incidents in the client’s life (client files numbered 1, 3, 5, and 6). Statute Violated: Minnesota Statutes, section 245G.05, subdivision 3. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that comprehensive assessments meet all applicable requirements. 7. Violation: Six of six client files reviewed for requirements governing individual treatment plans (client files numbered 1 through 6) did not meet requirements. The individual treatment plan did not identify a treatment strategy. Statute Violated: Minnesota Statutes, section 245G.06, subdivision 1a, paragraph (a), clause (3). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that individual treatment plans meet all applicable requirements. Within 30 days of receipt of this order, submit one individual treatment plan that meets all applicable requirements. 8. Violation: Six of six client files reviewed for requirements governing documentation of treatment services did not meet requirements. The entries in the client’s record did not document the following: a. The type of treatment service provided for: i. December 1, 2, 3, 4, 5, 15, 16, 17, 18, 19, 2025, and January 2, 2026 (client file numbered 1); ii. January 21, 22, 27, 29, February 17, 18, 19, and 20, 2026 (client file numbered 2); iii. February 24, 25, 26, March 11, 12, and 13, 2026 (client file numbered 3); iv. December 16, 17, 2025, January 5, 6, 7, and 9, 2026 (client file numbered 4); and v. January 14 and February 11, 2026 (client file numbered 5); b. The amount of treatment service provided for: i. January 9, 2026 (client file numbered 4); ii. February 9, 2026 (client file numbered 5); and iii. March 20, 2026 (client file numbered 6); c. The client’s response to the treatment service for: i. January 22, 2026 (client file numbered 2); ii. December 17, 2025 (client file numbered 4); and iii. January 12 and February 11, 2026 (client file numbered 5); and d. The treatment service within seven days of providing the treatment service for: i. January 21, 2026 (client file numbered 2); and ii. February 25, 2026 (client file numbered 3). Statute Violated: Minnesota Statutes, section 245G.06, subdivision 2a. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the documentation of treatment services meet all applicable requirements. 9. Violation: Six of six client files reviewed for requirements governing client record documentation did not meet requirements in the following ways: a. The license holder did not document concerns related to attendance for treatment services, including the reason for any client absence from a treatment service for: i. January 2, 2026 (client file numbered 1); ii. January 28, 29, and February 17, 2026 (client file numbered 2); iii. February 25, 2026 (client file numbered 3); iv. January 5, 2026 (client file numbered 4); v. February 12, 2026 (client file numbered 5); and vi. March 10, 2026 (client file numbered 6); and b. The entry in the client’s record was not signed for January 12 and February 18, 2026 (client file numbered 5). Statute Violated: Minnesota Statutes, section 245G.06, subdivision 2b, paragraph (b), clause (3) and paragraph (c). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that client record documentation meets all applicable requirements. 10. Violation: Three of six client files reviewed for requirements governing administration of medication did not meet requirements. The client’s use of medication was not recorded, including staff signatures with date and time on the following dates: a. February 20, 22, 25, 27, March 6, 15, 17, 20, and 21, 2026 (client file numbered 3); b. February 9 and March 13, 2026 (client file numbered 5); and c. March 4, 5, 7, 10, 11, 12, 13, 14, 15, 16, and 17, 2026 (client file numbered 6). Statute Violated: Minnesota Statutes, section 245G.08, subdivision 5, paragraph (c), clause (7) and 245G.21, subdivision 8. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that administration of medication meets all applicable requirements. Personnel Files Personnel files reviewed are identified in the following manner: 11. Violation: One personnel file reviewed for requirements governing individuals with a temporary permit (personnel file numbered 3) did not meet requirements in the following ways: a. The amount of supervision was not documented for September 16, 25, October 4, 13, 31, November 9, 18, 27, December 6, 15, 26, 2024, January 2, 11, 20, 29, February 7, 16, 25, March 6, 15, 24, April 2, 11, 20, 29, May 8, 15, 26, June 4, 13, 24, July 1, 10, 16, 28, August 6, 15, 26, September 2, 11, 20, 29, October 8, 17, 26, November 4, 13, 22, December 1, 10, 19, 28, 2025, January 6, 15, 22, 29, February 4, 10, 19, 26, March 2, 13, and 19, 2026; and b. Supervision was not provided at least on a weekly basis during the weeks of September 8, November 10, 2024, March 16, May 18, June 15, July 20, August 17, September 21, November 23, 2025, and February 8, 2026. Statute Violated: Minnesota Statutes, section 245G.11, subdivision 11, paragraph (a). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that individuals with a temporary permit meet all applicable requirements. 12. Violation: Three of six personnel files reviewed for requirements governing staff orientation did not meet requirements. There was no documentation of orientation as follows: a. Program abuse prevention plan within 72 hours of first providing direct contact services (personnel file numbered 4); and b. HIV minimum standards within 72 hours of employment (personnel files numbered 3 and 7). Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b) and 245A.65, subdivision 3. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that staff orientation meets all applicable requirements. 13. Violation: One of seven personnel files reviewed for requirements governing personnel file contents (personnel file numbered 7) did not meet requirements. The personnel file did not contain a completed application for employment signed by the staff member. Statute Violated: Minnesota Statutes, section 245G.13, subdivision 3, clause (1). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that personnel file contents meet all applicable requirements. Written Response Required If you fail to correct the violation(s) specified in the Correction Order within the prescribed timelines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
