Dear Julie Oachs:
On September 26, 2025, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citation 5 in the Correction Order issued to you on September 25, 2025. You did not request reconsideration of any other citations; therefore, they are not under review.
Reconsideration Determination
Citation 4: The program did not have documentation on site to show that 2 of 5 (SP5 and SP14) staff persons met the: · education requirements of the teacher job classification for which the staff person was employed (SP14); and
· experience requirements of the teacher job classification for which the staff person was employed (SP5 and SP14).
Your Request for Reconsideration. In your violation correction response that you submitted, you stated that you sent an appeal for Citation 4. However, you did not submit any information, defenses or documentation for reconsideration on the Hub for Citation 4.
Applicable Law. A teacher must meet the education and experience requirements. Minnesota Rules, part 9503.0032, subpart 2.
The license holder must ensure that a personnel record for each staff person is maintained at the center contains the staff person's documentation indicating that the staff person meets the requirements of the staff person's job position and the education and experience requirements. Minnesota Rules, part 9503.0120, item B.
The commissioner must be given access without prior notice and as often as the commissioner considers necessary if the commissioner is investigating alleged maltreatment, conducting a licensing inspection, or investigating an alleged violation of applicable laws or rules. (emphasis added). Minnesota Statutes, section 245A.04, subdivision 5(a).
Reconsideration Determination. On the day of the site visit, the Licensor noted that that 2 of 5 (SP5 and SP14) staff persons did not meet the: education requirements and, or experience requirements of the teacher job classification for which the staff person was employed (SP14); and experience requirements of the teacher job classification for which the staff person was employed (SP5 and SP14). You did not submit any additional information, defenses, or documentation to support your request for reconsideration. Citation 4 is affirmed.
Citation 5: The program did not have documentation on site to show that 6 of 9 (SP1, SP4, SP8, SP9, SP10 and SP19) staff persons met the: · education requirements of the assistant teacher job classification for which the staff person was employed
(SP1, SP8 and SP9); and
· experience requirements of the assistant teacher job classification for which the staff person was employed (SP4, SP8, SP9, SP10 and SP19).
Your Request for Reconsideration. You acknowledged that it was a mistake to list SP1 and SP8 as an assistant teacher, because both had started the Track 2 process but decided to stop. You stated that SP9 has both education and experience requirements. You also stated that SP4, SP10 and SP9 have the experience from past and current hours at your program.
You also included SP4, SP9 and SP10’s personnel information forms (PIFs) and transcripts.
Applicable Law. An assistant teacher must meet the education and experience requirements. Minnesota Rules, part 9503.0033, subpart 2.

Reconsideration Determination. Citation 5 is affirmed regarding SP1 and SP8, because you acknowledged that they did not meet the education and experience requirements of an assistant teacher, and a Track 2 variance exception was not applicable for either SP1 or SP8.
On the day of the site visit, the Licensor noted that you did not have documentation that SP4, SP9, and SP10 had the required experience for their respective listed positions. On reconsideration, you included SP4, SP9 and SP10’s personnel information forms (PIFs), but this documentation was not made accessible to the Licensor during the site visit. The commissioner must be given access to documents and records, including records maintained in electronic format without prior notice and as often as the commissioner considers necessary if the commissioner is conducting a licensing inspection, or investigating an alleged violation of applicable laws or rules (emphasis added). Citation 5 is affirmed because you did not have documentation to show that SP4, SP9 and SP10 met the required experience for their positions.
Disposition
The Commissioner has reviewed the relevant laws and all of the information you submitted in response to the Correction Order. Citations 4 and 5 are affirmed. This is a final agency decision.
Previously Ordered Corrective Action. In the original Correction Order, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
