ORDER OF CONDITIONAL LICENSE
Dear Chelsea Lapham: The Department of Children, Youth, and Families (DCYF) is placing your license to provide childcare services at O2B Kids Sartell, 2451 Leander Ave., Sartell, MN 56377, on conditional status for two years, beginning June 11, 2026. This means you must meet certain conditions to maintain your license, detailed below. This order is based on your noncompliance with child care licensing requirements. Details of our findings are also provided below. Our next steps and your options are also detailed. REASON FOR THE CONDITIONAL LICENSE
On March 19, 2026, DCYF licensors conducted a licensing review and complaint investigation at your facility located at 2451 Leander Ave., Sartell, MN 56377. As a result of this licensing visit, the DCYF licensors determined that your program failed to comply with the laws and rules that apply to licensed child care centers, citing 31 violations. DCYF has considered the nature, chronicity, and severity of these violations, as well as the health, safety, and rights of children served by the program. · Nature and Severity: On March 19, 2026, the DCYF licensors determined that your program failed to comply with the laws and rules that apply to licensed child care centers, citing 31 violations. Thirteen of the thirty-three violations are repeat violations for which you were previously cited. Numerous violations related to the health and safety of children were found, including failure to:
o comply with background study requirements (addressed in a separate Order to Pay a Fine on April 1, 2026)
o comply with staff-to-child ratios
o comply with staff distribution requirements
o adequately supervise children
o comply with staff distribution requirements
o comply with cleanliness requirements
o comply with equipment requirements
o comply with mitigating hazards
o comply with staff training requirements, including orientation, CRP, first aid, child development and learning.
· Chronicity: Your program received its license on January 31. 2025. Since that time, your program has demonstrated a history of noncompliance with licensing rules and statutes. During the short period of licensure, eight licensing investigations have also been determined. This number is significant and was also considered in the decision to issue a conditional license. The information below summarizes this history:
o June 11, 2026, Conditional License (this order): 31 violations (13 repeat)

Due to the serious and chronic nature of these violations, and the conditions in the program, which impact the health and safety of children in your care, your license to provide child care services is placed on a conditional status. Licensing Violations
DCYF determined that your program failed to follow licensing rules and statutes, as described below. PROGRAM PRACTICES
1. Violation: The required staff-to-child ratios were not maintained. It was determined through interviews and/or conversations with staff persons that:
· On most mornings, one staff person worked alone with up to 10 infants from approximately 7:15 a.m., to 8:00 a.m. Two additional staff persons were required to maintain staff-to-child ratio requirements. (Infant B: Infant classroom)
· On March 17, 2026, for approximately 30 minutes, one staff person was working alone with eight toddlers. A second staff person was required to meet staff-to-child ratio requirements. (Freshman B: Toddler classroom)
· On at least one occasion between February 23, 2026, and March 19, 2026, two staff persons were working with 23 preschool age children. A third staff person was required to maintain staff-to-child ratio requirements. (Junior A: Preschool classroom)
• On at least one day in March of 2026, one staff person was providing care for ten infants in the Infant B classroom. (Infant B: Infant classroom)

Repeat Licensing Violation: The license holder was cited for a similar violation in the following orders:

2. Violation: Staff did not supervise the children at all times (Junior A).
· It was determined through interviews with staff persons and review of facility documentation that on February 25, 2026, five preschool age children ran from staff persons during a transition from the large motor room to the classroom and were without supervision. Four of the five children were brought to the classroom less than 1 minute later by a substitute staff person working at the facility that day.
· The fifth preschool age child that ran from facility staff persons during the transition on February 25, 2026, was unsupervised for approximately 25-40 minutes. The child was found in a hallway near strollers by another staff person. Staff persons from the child’s classroom were not aware that the fifth child was still missing. (Junior A: Preschool classroom)
Supervision occurs when a program staff person is accountable for the child's care and is within sight and hearing of a child at all times, so that the program staff person can intervene to protect the health and safety of the child.

3. Violation: Staff distribution requirements were not maintained.
There was an assistant teacher and one aide working alone with ten preschool age children. A staff person, meeting the requirements of a teacher, was required to maintain staff distribution requirements. (Seniors: Preschool classroom)

4. Violation: Staff distribution requirements were not maintained. A teacher or assistant teacher did not directly
supervise an aide. The DCYF licensors observed the following during their onsite visit:
• There were two aide qualified staff persons working alone with seven infants. A staff person with the minimum qualifications of a teacher was required. (Infant B: Infant classroom)
· From approximately 8:20 a.m.to 9:20 a.m., there were two aide qualified staff persons supervising 12 preschoolers. A staff person with the minimum qualifications of a teacher was required. (Junior A: Preschool classroom)
· At approximately 9:50 a.m., there was an aide qualified staff person supervising 8 preschoolers. A staff person with the minimum qualifications of a teacher was required. (Junior A: Preschool classroom)
· There were two aide qualified staff persons supervising 7 infants. A staff person with the minimum qualifications of a teacher was required.(Infant C: Infant classroom)
· There were two aide qualified staff persons working alone with 12 toddlers. A staff person with the minimum qualifications of an assistant teacher was required. (Sophomore A: Toddler classroom)

FOOD AND WATER
5. Violation: The program did not comply with refrigeration requirements the refrigerator was not maintaining a temperature of 40 degrees Fahrenheit or less. The classroom refrigerator, used for storing milk, was 46 degrees Fahrenheit. (Infant C: Infant classroom)

6. Violation: Staff did not wash tables used for meals with soap and water as required. It was determined through conversations with a staff person that:
· highchair trays were not washed before meals and snacks were served. (Infant B: Infant classroom)
· tables were not washed before meals and snacks were served. (Infant C: Infant classroom)

7. Violation: Water bottles and reusable cups were used to provide drinking water to children, and the program did not follow the policy for labeling the child's first and last name.
There were two reusable water bottles which did not have a child’s first and last name on them. (Sophomore A: Toddler classroom)

MEDICATION/FIRST AID
8. Violation: Products to control diaper rash were not labeled with the child's first and last name.
· There were three packages of diaper wipes labeled with only the first name of a child and/or unlabeled. (Freshman B: Toddler classroom)
· There was one container of Aquaphor and one container of Desitin labeled only with a child's first name and last initial. (Infant C: Infant classroom)

9. Violation: The program did not comply with medication storage requirements. A medicine, insect repellent, sunscreen, or diaper rash product was accessible to children. There were several containers of diaper wipes stored in two mobile storage racks near the handwashing sink that were accessible to children. (Freshman B: Toddler classroom)

FACILITY
10. Violation: The program did not comply with cleanliness requirements; the indoor space was not clean (Seniors and Freshman B).
· A plunger was stored, accessible to children, in each of the two classroom bathrooms. This is not a clean and sanitary method to store a plunger. (Seniors: Preschool classroom)
· The licensor observed a staff person preparing children's art projects on the changing table. This is not a sanitary method for art project preparation. (Freshman B: Toddler classroom)
As defined in Minnesota Rules, part 9503.0005, subpart 9, clean means 'free from dirt or other contaminants that can be detected by sight, smell, or touch.'

11. Violation: A minimum of 35 square feet of indoor space was not available for each child in attendance.
· It was determined through interviews with staff persons that on at least one day in March of 2026, there were ten infants in the Infant B classroom. The Infant B classroom is licensed for eight infants. (Infant B: Infant classroom)
· It was determined that on at least one occasion between February 23, 2026, and March 19, 2026, there were 23 preschool age children in the Junior A classroom. The Junior A classroom is licensed for 20 children. (Junior A: Preschool classroom)

12. Violation: Equipment and furniture were not in good repair.
There were multiple children's books torn and in disrepair. (Freshman B: Toddler classroom)

13. Violation: The DCYF licensor observed that the following hazardous objects were accessible to children:
· The cord to the sound machine was draped above a crib. (Infant B: Infant classroom and Infant A: Infant classroom)
· A spray bottle containing a cleaning solution was hanging on a changing table in a bathroom.
· There were multiple children climbing on chairs that were stacked three high, posing a hazard. (Junior A: Preschool classroom)

14. Violation: Children's hand sinks were used for custodial work and/or food preparation.
At approximately 8:40 a.m., the DCYF licensor observed a child taking a single serve drinking cup and filling it with water from a designated handwashing sink. Handwashing sinks cannot be used for drinking water.

15. Violation: Hot or hazardous surfaces were not shielded or insulated.
There was one, unsecured bottle warmer. Bottle warmers/crock pots present a risk of children being burned by hot water spilling onto children or of children coming into contact with the hot surface of the bottle warmer/crock pot if not firmly secured/shielded. (Infant B: Infant classroom)

INFANT AND TODDLER CARE
16. Violation: Daily written reports were not provided to parents.
It was determined through conversations with staff persons and a review of daily reports that the infant daily reports did not include the child’s food intake. The infant daily reports showed the amount of formula/breast milk prepared and served to the child but did not contain how much of the prepared formula/breast milk was consumed by each infant during a feeding.(Infant A: Infant classroom, Infant B: Infant classroom and Infant C: Infant classroom)

17. Violation: Each infant's bottle was not labeled with the child's first and last name.
There were two unlabeled infant pacifiers. Each child’s pacifier must be labeled with the child’s complete first and last name and/or marked in a manner that it is clearly identified to whom the pacifier belongs (Infant B: Infant classroom)

18. Violation: The program did not have documentation of brand names and model numbers for every crib that is used by or accessible to any child in care.
Citation: Minnesota Statutes, section 142B.45, subdivision 2, paragraph (a)
19. Violation: All crib brand names and model numbers were not checked annually against the U.S. Consumer Product Safety Commission website listing of unsafe cribs.
It was determined through a conversation with an administrative staff person that all 2025 crib documentation had been destroyed. Therefore, the DCYF licensors were unable to verify that crib brand names and model numbers were checked in 2025. (Infant B: Infant classroom, Infant A: Infant classroom and Infant C: Infant classroom) “Annual" or “annually” means prior to or within the same month of the subsequent calendar year. Citation: Minnesota Statutes, section 142B.45, subdivision 3 20. Violation: The required crib safety inspections were not completed on a monthly basis.
It was determined through a conversation with an administrative staff person that all 2025 crib documentation had been destroyed. Therefore, the DCYF licensors were unable to verify that crib safety inspections were completed monthly in 2025. (Infant B: Infant classroom, Infant A: Infant classroom and Infant C: Infant classroom)

21. Violation: When the program placed an infant under one year of age down to sleep, the infant's clothing or sleepwear must not have weighted materials, a hood, or a bib.
At approximately 9:05 a.m., a child was placed in a crib for nap, while wearing a hooded garment. (Infant B: Infant classroom)

22. Violation: The center lacked the following furnishings, equipment, materials, or supplies:

REPORTING REQUIREMENTS
23. Violation: The program did not comply with the reporting requirements for abuse and neglect. It was determined through conversations with staff persons, they would report suspected maltreatment to program administration.

24. Violation: The program did not identify the primary and secondary person or position who will ensure that internal reviews are completed.
The DCYF licensors determined, that the maltreatment of minors policy, stored within the policies and procedures binder and used to train staff persons, was incomplete. The policy did not contain the name(s) and/or position(s) for the primary and secondary person responsible for an internal review.

STAFF QUALIFICAITONS
25. Violation: The program did not have documentation on site to show that 3 of 4 (SP2, SP4 and SP10) staff persons met the:
· education requirements of the teacher job classification for which the staff person was employed (SP2 and SP10); and
· experience requirements of the teacher job classification for which the staff person was employed (SP2, SP4 and SP10).

STAFF TRAINING
26. Violation: Documentation was not available on site to verify that before starting assigned duties 4 of 4 (SP1, SP5, SP9 and SP10) individuals (director, staff persons, substitutes, or unsupervised volunteers) received orientation training on:
· the child care program plan and center's philosophy (SP1, SP5, SP9 and SP10);
· emergency preparedness as required by Minnesota Statutes, 142B.66, subdivision 3. (SP1, SP5, SP9 and SP10); and
· program's risk reduction plan as required under section 142B.54, subdivision 2 (SP1, SP5, SP9 and SP10).
Although the documentation showed a training date, it was determined through interviews with staff persons and an administrative staff person that training on site specific program policies was not completed during the initial orientation training for these staff persons.

27. Violation: The required in-service training had not been completed for 3 of 3 (SP3, SP6 and SP7) individuals (director, staff persons, substitutes, or unsupervised volunteers) for the previous concluded calendar year. In-service training did not include the required number of in-service training hours for the previous concluded calendar year (SP3, SP6 and SP7).

28. Violation: The program did not comply with cardiopulmonary resuscitation (CPR) training requirements. Documentation was not available on site to show that 4 of 6 (SP2, SP4, SP8 and SP9) individuals (director, staff persons, substitutes, or unsupervised volunteers) had satisfactorily completed the required pediatric CPR training including the treatment of obstructed airways and a hands-on skill assessment before unsupervised contact with a child (SP2, SP4, SP8 and SP9).

29. Violation: The program did not comply with first aid training requirements. Documentation was not available on site to show that 4 of 6 (SP2, SP4, SP8 and SP9) individuals (director, staff persons, substitutes, or unsupervised volunteers) completed pediatric first aid training before unsupervised direct contact with a child (SP2, SP4, SP8 and SP9).

Children’s Records
30. Violation: Each child’s record did not contain all required information:
· 2 of 5 (C3 and C5) children’s files reviewed did not contain written authorization for the center to act in an emergency or when the parent cannot be reached or is delayed; and
· 1 of 3 (C1) children’s files reviewed did not contain the dates of parent conferences and a summary of conference information.

31. Violation: The individual child care program plan (ICCPP) for 2 of 2 (C1 and C3) children with a known allergy did not contain:
· Avoidance techniques (C3); and
· Procedures for responding to an allergic reaction, including medication, dosage, and doctor contact information (C1).

Immediate corrective action required
You must immediately correct the violations cited above. Submit documentation to your licensor within 30 days from when you received this order explaining how you have corrected the violations. If you fail to demonstrate substantial compliance with child care center requirements or with the terms of your conditional license that are provided below, DCYF may take an additional licensing action, including revocation, against your license. Additionally, DCYF will not approve a request to increase services from the date of this order until the time your conditional license expires. CONDITIONAL LICENSE TERMS
In addition to the child care licensing rules and statutes, you are required to comply with the following terms: 1. Within 15 days from receipt of this order, you must provide written notification of the conditional status of your license to all parents/legal guardians. Prior to providing the written notification to all parents/legal guardians, you must submit the written notice to your DCYF licensor for approval. The notification must specify the length of time of the conditional status of your license, the reasons your license was made conditional, and must include either a copy of the Order of Conditional License or an offer to provide a copy of the order upon request.
2. On a monthly basis while your license is on conditional status, you must complete staffing patterns that identify every staff person and his/her job title included in the staff-to-child ratio for each classroom and maintain all completed staffing patterns onsite. The staffing information must be documented on the enclosed form titled “Staffing Patterns,” must be completed separately for each classroom, and must include the total number of children in attendance each hour for each classroom. The documentation must include the time each person takes their break, if applicable, and identify the name of the person who replaces them. Staffing patterns must be completed at the beginning of each month, maintained on site, and made immediately available to the Commissioner upon request. Within 30 days from the receipt of this order, you must develop a plan to ensure staff-to-child ratios are maintained at all times and submit the plan to your licensor for approval.
3. On a daily basis while your license is on a conditional status, you must complete daily maintenance, cleanliness, and hazard checks of the facility, equipment, and outdoor play areas, and maintain documentation onsite to show that the checks have been completed. This documentation must be made immediately available to the Commissioner during onsite inspection and otherwise requested.
4. Within 45 days from the receipt of this order, you must develop a system to ensure that monthly crib inspections are completed, document all cribs brand name and model number, and ensure all crib brand names and model numbers are checked annually against the U.S. Consumer Product Safety Commission website listing of unsafe cribs as required under Minnesota Statues, section 142B, subdivisions 2, 3, and 4.
5. Within 45 days from receipt of this order, you must ensure that all staff persons have successfully completed training as required under Minnesota Statutes, section 142B.66, subdivision 1 paragraphs A and C, and infant safe sleep requirements as required under Minnesota Statutes, section 142B. 46. You also must ensure that new hires successfully complete all applicable training. You must maintain documentation of the completed training in each staff person’s personnel record. YOUR RIGHT TO REQUEST RECONSIDERATION
You have the right to request reconsideration of this order and the cited violations. Your request must: · Be in writing
· Clearly state that you are requesting reconsideration of the conditional license
· List each citation you are challenging and identify what is inaccurate or incomplete about the information in the order
· Supply information that is accurate or more complete
· State why you believe your license should not be on a conditional status
· Be made before the deadlines provided below
If you choose to request reconsideration of this order, you must use the Provider Hub (https://providerhub.dhs.mn.gov/) to submit your request. The timeline to request reconsideration began when this order was issued in the Provider Hub. Your request for reconsideration must be submitted in the Provider Hub within 10 calendar days from the date of issue. If you do not meet this deadline, you lose your right to request reconsideration. Conditional license stayed pending reconsideration
If you request reconsideration within the timeframes described above, the terms of the conditional license will not take effect until a decision is issued by DHS. If the conditional license is affirmed on reconsideration, the terms would take effect on the date of the reconsideration decision, and run for two years from that date. You continue to be required to comply with all child care center laws and rules. Posting of this licensing action
You are required to place this Order of Conditional License in a place that is clearly noticeable to the people receiving services and all visitors to the facility for two years, even if you appeal. Legal authority for this licensing action
· This action is taken under Minnesota Statutes, 142B.16, subdivision 1.
· Child Care Centers are required to follow Minnesota Rules 9503.0005 to 9503.0170; and Minnesota Statutes, Chapters 142B, 245C, and 260E
· The timeline to request reconsideration of the order is provided in Minnesota Statutes, section 142B.16, subdivision 4.
· The requirement to post this order in a clearly visible location is required under Minnesota Statutes, section 142B.16, subdivision 5.
· If a license holder files a timely reconsideration request, the terms of the conditional license are stayed pending a decision by DCYF under Minnesota Statutes, section 142B.16, subdivision 4.
· Minnesota Statutes, section 142B.16, subdivision 3 states that DCYF may impose additional licensing actions against a license holder that does not correct the violations cited in a conditional license order.
