June 18, 2026 Mark Pellegrino, Authorized Agent Newport Academy 3990 Hillsboro Pike, Suite 330 Nashville, TN 37215 RE: Report No. 202603926 Newport Academy License No. 1108472 Dear Mark Pellegrino: CORRECTION ORDER An investigation of Newport Academy was completed regarding report number 202603926, which alleged violation of Minnesota Statutes, section 260E, and Minnesota Rules, part 2960. This maltreatment allegation concerned neglect. The disposition of the investigation report is maltreatment not determined. Three violations were noted. VIOLATIONS AND CORRECTION ORDERS The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07. 1. Citation: Minnesota Statutes, section 245A.04, subdivision 14 and Minnesota Rules, part 2960.0710. Violation: The license holder did not monitor the development and implementation of their restrictive procedures plan to ensure the use of physical holding was used only as permitted in a resident’s treatment plan. The license holder’s Behavior Management and Emergency Safety Intervention Policy stated that the need for manual restraints is determined in advance on an individual basis by the client’s treatment team and documented in the client’s treatment plan as an intervention to prevent immediate or imminent injury to the client or to others and the use of holds will only be used as permitted in the resident’s treatment plan. Client files reviewed (C1 and C3) included treatment plans that stated, “this facility does not utilize physical restrictive procedures to protect the resident from imminent danger to self or others….” However, the licensed facility is certified to utilize restrictive procedures and was found to have utilized a physical hold with clients C1 and C3 on March 28, 2026, according to client file documentation. Corrective Action Ordered: Within 30 days of receipt of this order, you must submit a revised restrictive procedures plan that meets all requirements. On an ongoing basis, you must maintain compliance as required. 2. Citation: Minnesota Rules part 2960.0080, subpart 17 Violation: One of two critical incidents reviewed was not submitted to the Department within ten days of the occurrence. On March 24, 2026, three clients (C1-C3) ran away from the facility, climbed into dumpsters, and ingested unknown items. Staff called 9-1-1 and took C1 to an emergency room after s/he repeatedly vomited. On April 4, 2026, eleven days later, the license holder submitted a DHS Critical Incident Report to the Department for this occurrence. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required. 3. Citation: Minnesota Statutes section 245A.66, subdivision 4. Violation: One of ten staff (S1) records reviewed did not meet annual training requirements. The license holder did not ensure the maltreatment of minors reporting requirements and definitions in chapter 260E to each mandatory reporter, as described in section 260E.06, subdivision 1 was completed annually. The license holder provided documentation that in 2024, S1 received training on the maltreatment of minors reporting requirements but S1 did not receive this same training annually thereafter. Corrective Action Ordered: Within 30 days of receipt of this order, you must provide S1 with training on the maltreatment of minors reporting requirements and definitions in chapter 260E to each mandatory reporter, as described in section 260E.06, subdivision 1. On an ongoing basis you must maintain compliance as required. If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
