CORRECTION ORDER
An investigation of Brown County Evaluation Center, Inc. - detox division was completed regarding report number 202602418 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Rule 32. This maltreatment allegation concerned possible neglect. The disposition of the investigation report is substantiated. Three violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes, section 245A.65, subdivision 3.
Violation: For two staff persons whose record was reviewed (P7 and P8), the license holder did not provide annual training as required.
The license holder did not provide vulnerable adult mandated reporter training to P7 and P8 annually. This training was provided to P7 on May 1, 2020, and P8 on September 10, 2023, and was not completed after. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program. 2. Citation: Minnesota Rules, chapter 9530.6550, item A.
Violation: The license holder failed to follow their own procedures for monitoring client health and providing observation. On multiple occasions on February 21, 2026, staff persons failed to supervise a client, including hourly checks. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program. 3. Citation: Minnesota Statutes, section 245A.04, subdivision 14, paragraph (b).
Violation: The license holder failed to monitor implementation of the Facility Abuse Prevention Plan by program staff. On February 21, 2026, multiple staff persons failed to supervise a client as indicated by the Facility Abuse Prevention Plan but documented that the hourly checks were completed when they were not. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program. If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
