CORRECTION ORDER

An investigation of Habilitative Services, Inc. was completed regarding report number 202602486, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is substantiated. Two violations were noted.

VIOLATIONS AND CORRECTION ORDERS

The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

1.  Citation: Minnesota Statutes section 245D.05, subdivision 1, paragraph (a)

Violation: For a client, whose record was reviewed (C1), the license holder did not meet the person’s health service needs assigned in the support plan or the support plan addendum, consistent with the person's health needs.

Staff were to watch C1 for signs and symptoms of discomfort and/or illness and treat accordingly.

On February 3, 2026, C1 became unresponsive or unconscious and staff did not provide medical treatment or seek medical attention for over ten hours.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required with this subdivision.

2.  Citation: Minnesota Statutes section 245D.10, subdivision 1

Violation: For an incident on February 3, 2026, the license holder did not enforce policies and procedures as required in this chapter, chapter 245A, and other applicable state and federal laws and regulations governing the provision of home and community-based services licensed according to this chapter.

If a client was unconscious, staff were to first call 9-1-1 “immediately,” and then contact a supervisor, who designated a staff person to contact the person’s guardian or emergency contact.

On February 3, 2026, when C1 became unresponsive or unconscious, staff first called C1’s guardian and did not call a supervisor and/or 9-1-1 for over ten hours.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
