Terms of Settlement Agreement:
1. Upon final execution of the Settlement Agreement, License Holder agrees that her appeal of the Order of Temporary Immediate Suspension is withdrawn.
2. Upon final execution of the Agreement, DCYF agrees not to impose the Order of License Revocation against Appellant’s family child care license, subject to the paragraphs below.
3. After Dakota County reviews and confirms that the condition of License Holder’s family child care program satisfies applicable licensing laws and rules, License Holder’s license, No. 1098460, will be placed on conditional status for a period of two (2) years from the effective date of the Agreement. While under the conditional license, License Holder will comply with the following terms:
a. License Holder will follow and comply with all applicable Minnesota Statutes and Rules, including Minnesota Rules, parts 9502.0300 through 9502.0445, and background study requirements under Minnesota Statutes, chapter 245C.
b. License Holder’s family child care license will be limited to a maximum capacity of 12 children (class C2 license), and no variance to age distribution of capacity will be granted during the conditional period.
c. License Holder must submit all outstanding licensing documents to Dakota County required under the previous Order of License Revocation within 14 calendar days of the effective date of this Agreement.
d. License Holder must submit daily attendance records to Dakota County on a monthly basis. The records must show the name and the birth date of each child, and the dates and hours when they were under License Holder’s care. The previous month’s attendance must be submitted to Dakota County by the 5th of each month.
e. License Holder must notify Dakota County of any new children enrolling in her program within 5 calendar days of their first attendance, including drop-in children.
f. License Holder must complete additional training in the area of safe sleep. License Holder must first obtain approval from Dakota County that the training is appropriate. Within 14 calendar days of obtaining training approval from the County, License Holder must submit documentation of her completion of training, and a written plan on how she will implement safe sleep practices in her program. Dakota County may direct License Holder to view additional videos of its choosing on the topic of safe sleep.
g. License Holder must re-take FCCL child care orientation and complete the orientation study guide within 14 calendar days of the effective date of this Agreement, or by another agreed-upon date.
h. License Holder must work with Dakota County to obtain a mentor to work on ensuring that she is following all family child care rules and laws. The mentor must be obtained within 45 calendar days of the effective date of the Agreement, and must be approved by Dakota County. Upon completion of working with the mentor, License Holder must submit a summary to Dakota County of what she learned and changes she will implement into her program to support required compliance with licensing regulations including record keeping and paperwork.
i. License Holder must post this Agreement in her family child care program in a conspicuous place and provide a copy of this Agreement to parents or guardians of all children in care under License No. 1098460. She must obtain signatures from parents or guardians of each child attending her family child care programs indicating they have received a copy of the Agreement. Documentation that the parents received a copy of this Agreement must be provided to Dakota County within 30 calendar days of the effective date of the Agreement. For new families enrolling a child in the family child care program, License Holder must submit documentation signed by the parent or guardian to Dakota County within five (5) calendar days of the child beginning to receive family child care services from her family child care program that verifies that the parent received a copy of the Agreement.
