You did not request review for Citations 2, 3, and 4. Citations 2, 3 and 4 are not under the scope of review. Reconsideration Determination Citation 1 Violation. Staff did not supervise the children at all times (Preschoolers). A child left the classroom into the hall to the bathroom. The staff person in the classroom and the staff person in the bathroom did not always have the child within sight while the child walked to the bathroom down the hall. (Preschoolers: Preschool classroom) Supervision occurs when a program staff person is accountable for the child's care and is within sight and hearing of a child at all times, so that the program staff person can intervene to protect the health and safety of the child. Applicable Law. For purposes of licensed child care centers, "supervision" means when a program staff person: (1) is accountable for the child's care; (2) can intervene to protect the health and safety of the child; and (3) is within sight and hearing of the child at all times except as described in paragraphs (b) to (e). Minnesota Statutes, section 142B.01, subdivision 27. The license holder have and implement the child care program plan, which must mandate that children have supervision at all times. Minnesota Rules, part 9503.0045, subpart 1, item A. Your Response. You stated: The program maintains supervision of children at all times within sight and hearing. During the on-site visit, the licensor was standing at the open pre-school classroom doorway and was asking questions and communicating with the staff member assigned to this classroom. Previously one of the staff members went with a child to bathroom. While the staff member was coming back with the child from the bathroom to the pre-school classroom, another child used the opportunity of opened preschool door and went to the hallway. The staff that was coming back from the bathroom with the other child took the child that left the classroom and brought both of them back to the pre-school classroom. The licensor was standing inside the pre-school classroom, near the doorway the whole time. There was a staff member in the same classroom supervising children, and also there was another staff in the hallway supervising children within sight and hearing. At no time were children left unsupervised nor outside of sight and hearing. Reconsideration Determination. On the day of the site visit, the Licensor observed a child exiting the preschool class room, enter the hallway and walk down to the bathroom. SP1 opened the door for the child but did not watch the child walk down the hallway. At the same time, SP2 was in the bathroom with another child. However, SP1 did not alert SP2 that the child was in the hallway on his/her way to the bathroom. The Licensor observed that the child was not within sight and sound of SP1 and SP2. Adequate supervision occurs when program staff is accountable for the child's care, can intervene to protect the health and safety of the child, and is within sight and hearing of the child at all times. The child walking to the bathroom was not within sight and sound of SP1 and SP2. Citation 1 is affirmed. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 is affirmed. You did not request review for Citations 2, 3 and 4. Citations 2, 3, and 4 are not under the scope of review. This is a final agency decision. Previously Ordered Corrective Action. In the original Correction Order issued, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 1, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations and respond in the Provider Hub immediately.
