July 24, 2026 Stella Nyakundi, Authorized Agent Holistic Nursing Corp 6501 91st Trail North Brooklyn Park, Minnesota 55445 License Number: 1109156(245D – HCBS) CORRECTION ORDER Dear Stella Nyakundi: On July 6, 2026, a licensing review of Holistic Nursing Corp, located at 1821 University Avenue West, Saint Paul, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245A.65, subdivision 2, paragraph (b). Violation: For one of two persons whose records were reviewed (P1), the license holder did not meet requirements for an individual abuse prevention plan (IAPP) as required. The license holder assessed P1 to be susceptible to physical abuse. The license holder did not include a statement of the specific measures or actions that would be taken to minimize this risk of abuse to P1. Repeat Violation: In a Correction Order DHS issued March 5, 2026, the license holder was ordered to review and update P1’s IAPP, provide training on P1’s IAPP to all staff persons working with P1, and maintain documentation of this training. The license holder did not comply with the corrective action issued by DHS. Corrective Action Ordered: Within 30 days of receiving this order, you must update P1’s IAPP to include the information detailed above. Once P1’s IAPP has been updated, you must review the IAPP with P1 and P1’s case manager. You must provide training on P1’s IAPP to all staff persons working with P1 and maintain documentation of this training for each staff person. On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.05, subdivision 1. Violation: For one person whose record was reviewed (P1), the license holder did not meet health service needs as required. The license holder was assigned responsibility for administering P1’s medications. The license holder did not maintain documentation of how P1’s health needs would be met, including a description of the procedures the license holder would follow to: · provide medication setup, assistance, or administration; · monitor health conditions according to written instructions from a licensed health professional; · assist with or coordinate medical, dental, and other health service appointments; and · use medical equipment, devices, or adaptive aides or technology safely and correctly according to written instructions from the provider. Repeat Violation: In a Correction Order DHS issued March 5, 2026, the license holder was ordered to update P1’s support plan addendum to include the health service needs documentation and information listed in this citation. The license holder did not comply with the corrective action issued by DHS. Corrective Action Ordered: Within 30 days of this order, you must update P1’s support plan addendum to document how P1’s needs will be met, including a description of the procedures the license holder will follow to provide the health service needs detailed above in this citation. On an ongoing basis, you must maintain compliance as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.071, subdivision 3. Violation: For one person whose record was reviewed (P2), the license holder did not complete assessments as required. The license holder did not produce information that described P2’s overall strengths, functional skills and abilities when completing P2’s assessments. Corrective Action Ordered: Within 30 days of receiving this order, you must update P2’s assessments to include P2’s overall strengths, functional skills and abilities. On an ongoing basis, you must maintain compliance as required in this subdivision. 4. Citation: Minnesota Statutes, section 245D.071, subdivision 4. Violation: For one person whose record was reviewed (P2), the license holder did not develop service outcomes and supports as required. The license holder did not document the measurable and observable criteria for identifying when P2’s community engagement outcome would be achieved. The license holder maintained varying criteria for achievement in P2’s support plan addendum. Additionally, the license holder did not develop and document the following supports and methods to be implemented to support P2 and accomplish P2’s apartment organization outcome: · the methods or actions that would be used to support P2 and to accomplish service outcomes, including information about: o any changes or modifications to the physical and social environments necessary when the service supports were provided; o any equipment and materials required; and o techniques that were consistent with P2’s communication mode and learning style; · the measurable and observable criteria for identifying when the desired outcome has been achieved and how data would be collected; · the projected starting date for implementing the supports and methods and the date by which progress towards accomplishing the outcomes would be reviewed and evaluated; and · the names of the staff or position responsible for implementing the supports and methods. Corrective Action Ordered: Within 30 days of receiving this order, you must: · update P2’s community engagement outcome to clarify the criteria for achievement; · update P2’s apartment organization outcome to include all supports and methods as identified above; · review P2’s outcomes with P2 and P2’s case manager and maintain documentation of this review in P2’s service recipient record; and · provide training to all staff who work with P2 on the updated outcomes and maintain documentation of this training according to Minnesota Statutes, section 245D.095. On an ongoing basis, you must maintain compliance as required in this subdivision. 5. Citation: Minnesota Statutes, section 245D.095, subdivision 3, paragraph (b) and Minnesota Rules, part 9544.0100, subpart 1. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not document the use of positive support strategies as required. a. The license holder did not maintain appropriate data for P1 that: · ensured that staff are accountable for the services provided to P1; and · ensured that services could be evaluated and monitored by the license holder and the commissioner. b. The license holder did not maintain appropriate data for P2 that: · revealed the progress or lack of progress towards each outcome; · ensured that staff are accountable for the services provided to P2; and · ensured that services could be evaluated and monitored by the license holder and the commissioner. Corrective Action Ordered: Immediately, you must ensure that progress or daily log notes, including outcome data if applicable, are documented each shift worked with all persons served by your program. Concerns regarding the provider’s progress or daily log notes and billing for home and community-based services were referred to the Department of Human Services, Office of Inspector General, Program Integrity and Oversight Division. On an ongoing basis, you must maintain compliance as required in this subdivision. 6. Citation: Minnesota Statutes, section 245D.09, subdivision 4. Violation: For three of three staff persons whose records were reviewed (SP1 – SP3), the license holder did not provide and ensure orientation to the program as required. a. The license holder did not provide SP1 with instruction in strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities within 60 days of hire. b. The license holder did not provide SP2 and SP3 with the following training within 60 days of hire: · strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities; and · basic first aid. Repeat Violation: In a Correction Order DHS issued March 5, 2026, the license holder was ordered to provide SP1-SP3 with orientation to the topics identified above. The license holder did not comply with the corrective action issued by DHS. Corrective Action Ordered: Within 60 days of receiving this order you must provide SP1-SP3 with the trainings identified above and annually thereafter and maintain documentation in accordance with Minnesota Statutes 245D.095. On an ongoing basis, you must maintain compliance as required in this subdivision. 7. Citation: Minnesota Statutes, section 245D.09, subdivision 4a. Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide orientation to individual service recipient needs as required. The license holder did not provide SP2 with review and instruction on the person's support plan or support plan addendum as it relates to the responsibilities assigned to the license holder and the person's individual abuse prevention plan, to achieve and demonstrate an understanding of the person as a unique individual, and how to implement those plans before SP2 had unsupervised direct contact with a person served by the program. Repeat Violation: In a Correction Order DHS issued March 5, 2026, the license holder was ordered to provide SP2 with review and instruction on the persons support plan or support plan addendum. The license holder did not comply with the corrective action issued by DHS. Corrective Action Ordered: Within 60 days of receiving this order you must provide SP2 with orientation to individual services recipient needs as outlined above and maintain documentation according to Minnesota Statutes 245D.095. On an ongoing basis, you must maintain compliance as required in this subdivision. 8. Citation: Minnesota Statutes, section 245D.095, subdivision 5, paragraph (b). Violation: For two staff persons whose records were reviewed (SP2 and SP3), the license holder did not maintain a personnel record as required. The license holder did not maintain the number of training hours per subject area in SP2’s and SP3’s personnel file. Repeat Violation: In a Correction Order DHS issued March 5, 2026, you were previously found in violation of this same statute. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
