Dear Victor Makori:
On June 29, 2026, a licensing review of Loving Caring Home Care LLC, located at 17017 Georgetown Way, Rosemount, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.
A. Reason for Correction Order
Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.
The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.
1. Citation: Minnesota Statutes, 245D.071, subdivision 3, paragraphs (d).
Violation: For one of two persons whose record was reviewed (P1), the license holder did not complete initial service planning as required.
The license holder met with P1 and P1’s case manager within 30 days of receipt of the notice of noncompliance with terms of conditional license and correction order DHS issued on March 10, 2026 to determine the information in Minnesota Statutes, section 245D.071, subdivision 3, paragraph (c). The license holder did not discuss how technology might be used to meet P1’s desired outcomes.
Repeat Violation: In a notice of noncompliance with terms of conditional license and correction order DHS issued March 10, 2026, you were previously found in violation of this same statute.
Corrective Action Required: Within 30 days of receiving this order, you must meet with P1 and P1’s case manager to discuss how technology might be used to meet P1’s desired outcomes. The support plan addendum must include a summary of this discussion, including a statement regarding any decision that is made regarding the use of technology and a description of any further research that needs to be completed before a decision regarding the use of technology can be made. Compliance with this order will be reviewed at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Statutes, section 245D.071, subdivision 4.
Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not complete service outcomes and supports as required.
a. The license holder did not document the following supports and methods for P1 to be implemented to support and accomplish outcomes related to acquiring, retaining, or improving skills and physical, mental and emotional health and well-being, including:
· the methods or actions that will be used to support P1 and to accomplish the service outcomes, including information about techniques that are consistent with the P1’s communication mode and learning style; and
· the measurable and observable criteria for identifying when the desired outcome has been achieved and how data will be collected.
b. The license holder did not document the techniques that were consistent with P2’s communication mode used to support P2 and to accomplish the service outcomes.
Repeat Violation: In a notice of noncompliance with terms of conditional license and correction order DHS issued March 10, 2026, you were previously found in violation of this same statute.
Corrective Action Required: Within 30 days of receiving this order, you must review and revise P1’s and P2’s outcomes to document all supports and methods required in this subdivision. Compliance with this order will be reviewed at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
3. Citation: Minnesota Statutes, section 245D.071, subdivision 5.
Violation: For one person whose record was reviewed (P2), the license holder did not meet requirements for service plan review and evaluation.
The license holder did not meet with P2, P2’s case manager, and other people as identified by P2 to participate in service plan review meetings at least once per year in 2025 to: · discuss how technology might be used to meet P2’s desired outcomes and include a summary of this discussion that includes a statement regarding any decision made related to the use of technology and a description of any further research that must be completed before a decision regarding the use of technology can be made in P2’s support plan addendum; and
· summarize P2’s status and progress toward achieving the identified outcomes and make recommendations and identify the rationale for changing, continuing, or discontinuing implementation of supports and methods identified in subdivision 4 in a report available at the time of the progress review meeting.
Repeat Violation: In a notice of noncompliance with terms of conditional license and correction order DHS issued March 10, 2026, you were previously found in violation of this same statute.
Corrective Action Ordered: Within 30 days of receiving this order, you must meet with P2, P2’s case manager, and other people identified by P2 for a service plan review meeting to determine, discuss and summarize the requirements identified above. Compliance with this order will be reviewed at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
4. Citation: Minnesota Statutes, section 245D.095, subdivision 3, paragraph (b), clause (11).
Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not maintain a service recipient record as required.
The license holder did not maintain progress or daily log notes that were recorded by the program for P1 and P2.
Corrective Action Ordered: Immediately and ongoing, you must maintain compliance as required in this subdivision.
5. Citation: Minnesota Statutes, section 245D.09, subdivision 5.
Violation: For one of two staff persons whose record was reviewed (SP1), the license holder did not provide annual training as required.
Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.
The license holder did not provide SP1 the following required training annually: · data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices; · sections 245A.65, 245A.66, 626.556, and 626.557, governing maltreatment reporting and service planning for children and vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment; and · strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.
Repeat Violation: In a notice of noncompliance with terms of conditional license and correction order DHS issued March 10, 2026, you were previously found in violation of this same statute.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1 with the above-mentioned training. Compliance with this order will be reviewed at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
6. Statutes Violated: Minnesota Statutes, section 245D.081, subdivisions 2 and 3.
Violation: The license holder did not ensure program coordination, evaluation and oversight as required.
The license holder did not ensure the designated manager took corrective action when ordered by the commissioner. The commissioner issued a notice of noncompliance with terms of conditional license and correction order to the license holder on March 10, 2026, and was ordered to take corrective action for 4 citations. The license holder did not complete all of the corrective action ordered for citation numbers 1, 2, 3 and 5.
Repeat Violation: In a notice of noncompliance with terms of conditional license and correction order DHS issued March 10, 2026, you were previously found in violation of this same statute.
Corrective Action Ordered: Compliance with this order will be reviewed at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
B. Right to Request Reconsideration
If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
