CORRECTION ORDER
Dear Gina Marie Stokke:
On June 22, 2026, a licensing review of Stokke Family Care at 5664 Saint Louis Road, Duluth, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.
A. Reason for Correction Order
Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.
The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.
1. Citation: Minnesota Statutes, section 245D.05, subdivision 1, paragraph (b).
Violation: For one of one person whose record was reviewed (P1), the license holder did not document health needs as required.
The license holder was assigned the responsibility of assisting P1 with their medical appointments. The license holder did not document a description of the procedures that would be followed in order to assist with or coordinate P1’s health service appointments.
Corrective Action Ordered: Within 30 days of receiving this order, you must document the information detailed above in P1’s service support plan addendum. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored onsite. 2. Citation: Minnesota Statutes, section 245D.071, subdivision 3, paragraph (b).
Violation: For one person whose record was reviewed (P1), the license holder did not complete assessments as required.
The license holder did not ensure that the assessments completed for P1 were based on the person’s status within the last 12 months at the time of service initiation. The license holder documented in P1’s assessments that license holder provides medication administration for P1; however in a conversation at the time of the review, the license holder stated that P1 does not take any medications. The license holder stated that this information was likely from P1’s prior placement at this program.
Corrective Action Ordered: Within 30 days of receiving this order, you must complete assessments for P1 to include accurate information regarding P1’s support needs. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored onsite.
3. Citation: Minnesota Statutes, section 245D.071, subdivision 3, paragraphs (c) and (d).
Violation: For one person whose record was reviewed (P1), the license holder did not complete initial service planning for an intensive service as required.
a. The license holder initiated services to P1 on August 6, 2024. The license holder held an initial planning meeting with P1 and P1’s support team within 45 days of providing service; however the license holder did not determine the following:
· the scope of the services to be provided to support the person's daily needs and activities;
· the person's desired outcomes and the supports necessary to accomplish the person's desired outcomes;
· the person's preferences for how services and supports are provided, including how the provider will support the person to have control of the person's schedule;
· whether the current service setting is the most integrated setting available and appropriate for the person;
· opportunities to develop and maintain essential and life-enriching skills, abilities, strengths, interests, and preferences;
· opportunities for community access, participation, and inclusion in preferred community activities;
· opportunities to develop and strengthen personal relationships with other persons of the person's choice in the community;
· opportunities to seek competitive employment and work at competitively paying jobs in the community; and
· how services must be coordinated across other providers licensed under this chapter serving the person and members of the support team or expanded support team to ensure continuity of care and coordination of services for the person.
b. The license holder did not include a discussion with P1’s support team on how technology might be used to meet the person’s desired outcomes.
Corrective Action Ordered: Within 30 days of receiving this order, you must: · meet with P1’s support team to determine the above information; and
· document a summary of the discussion related to technology that includes a statement regarding any decision made regarding the use of technology and a description of any further research that needs to be completed before a decision regarding the use of technology cand be made.
On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored onsite.
4. Citation: Minnesota Statutes, section 245D.071, subdivision 4, paragraphs (a) and (b).
Violation: For one person whose record was reviewed (P1), the license holder did not develop a service plan that documented the service outcomes and supports as required.
The license holder developed a service plan that identified P1’s desired outcome; however the license holder did not include the following supports and methods to be implemented to support the person to accomplish the outcome:
· any equipment and materials required; and
· the measurable and observable criteria for identifying when the desired outcome has been achieved.
Corrective Action Ordered: Within 30 days of receiving this order, you must document the above supports and methods to be implemented for P1 in P1’s support plan addendum. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored onsite.
5. Citation: Minnesota Statutes, section 245D.071, subdivision 5, paragraphs (b), (c), and (d).
Violation: For one person whose record was reviewed (P1), the license holder did complete ongoing service planning and delivery for an intensive service as required.
The license holder did not, at least one time per year, participate in a progress review meeting with P1 and P1’s support team to discuss the following: · how technology might be used to meet the person’s desired outcome; and
· options for transitioning out of a community setting controlled by a provider and into a setting not controlled by a provider.
Corrective Action Ordered: Within 30 days of receiving this order, you must meet with P1’s support team to discuss the above topics. You must document a summary of the discussions that includes a statement regarding any decisions made and a description of any further research that needs to be completed before a decision can be made. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored onsite. 6. Citation: Minnesota Statutes, section 245D.071, subdivision 5, paragraph (g).
Violation: For one person whose record was reviewed (P1), the license holder did not complete progress review reports as required.
The license holder did not summarize P1’s status and progress towards achieving the identified outcomes, make recommendations, and identify the rationale for changing, continuing, or discontinuing implementation of supports and methods in a report at the time of the progress review meeting in 2025.
Corrective Action Ordered: Immediately you must begin collecting appropriate data on P1’s as detailed in citation 7. Within 90 days of receiving this order, you must provide P1’s support team with a progress review report that includes the above mentioned information. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored onsite. 7. Citation: Minnesota Statutes, section 245D.095, subdivision 3, paragraph (b), clause (11) and Minnesota Rule 9644.0100, subpart 1.
Violation: For one person whose record was reviewed (P1), the license holder did not maintain a service recipient record and did not maintain appropriate data as required.
a. The license holder did not maintain progress or daily log notes recorded by the program in P1’s service recipient record.
b. The license holder did not maintain appropriate data that:
· revealed the progress or lack of progress towards each outcome or goal for each person;
· ensure that staff are accountable for the services provided to the person; and
· ensure that services could be evaluated and monitored by the license holder and the commissioner.
Corrective Action Ordered: Immediately upon receiving this order, you must begin maintaining progress or daily log notes and the data detailed above in P1’s service recipient record. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored on site. 8. Citation: Minnesota Statutes, section 245D.09, subdivision 5.
Violation: For two of two staff persons whose records were reviewed (SP1 and SP2), the license holder did not provide annual training as required.
a. The license holder did not provide SP1 with annual training on the following required topic areas in 2023, 2024 and 2025:
· data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices;
· the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04;
· sections 245A.65, 245A.66, and 626.557 and chapter 260E governing maltreatment reporting and service planning for children and vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment;
· the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person;
· the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint;
· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe;
· basic first aid; and
· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.
b. The license holder did not provide the annual training on the following required topic areas in 2024 and 2025:
· data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices; this training was provided to SP2 on June 10, 2025 but was not provided in 2024;
· the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04;
· sections 245A.65, 245A.66, and 626.557 and chapter 260E governing maltreatment reporting and service planning for children and vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment;
· the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person;

Corrective Action Ordered: Within 30 days of receiving this order, you must ensure SP1 and SP2 receives training on the required topic areas detailed above. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. Compliance with this order will be monitored onsite. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
B. Right to Request Reconsideration
If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
