Dear Elisheba Churchill:

On November 10, 2025, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citation 1 in the Correction Order issued to you on October 22, 2025. You did not request reconsideration of any other citations; therefore, they are not under review.

Reconsideration Determination

Citation 1:

A minimum temperature of 68 degrees Fahrenheit was not maintained in the program.

The temperature was 65 degrees Fahrenheit. (Facility: Facility)

Your Request for Reconsideration. You stated that you knew that you needed to replace your HVAC system in October of 2025. You stated that replacement was delayed until October 24, 2025, because of high costs of replacement.

You stated that in October 2025 you “turned the systems off overnight to help ensure the units were in working order until replacement of the unit could be installed… sure if there is documentation or if the Licensor checked the temperature prior to leaving. you do believe if they had done so, the temperature would have been up to 68 degrees at that time.”

Applicable Law. A minimum temperature of 68 degrees Fahrenheit must be maintained in indoor areas used by children. Minnesota Rules, part 9503.0155, subpart 13.

Reconsideration Determination. The Licensor noted that two thermometers in indoor areas used by children read 65 degrees Fahrenheit. First, the thermometer across from the Infant classroom read 65 degrees Fahrenheit. Second, the thermometer near the Preschool classroom read 65 degrees. A minimum temperature of 68 degrees Fahrenheit must be maintained in indoor areas used by children. You did not maintain an indoor room temperature of a minimum of 68 degrees Fahrenheit in areas used by children; therefore, Citation 1 is affirmed.

Disposition

The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 is affirmed. This is a final agency decision.

Previously Ordered Corrective Action. In the original Correction Order, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
