August 11, 2026 CERTIFIED MAIL Ernest Valenzuela 31283 210th Avenue Red Wing, MN 55066 License Number 1099512 FCC ORDER LIFTING IMMEDIATE SUSPENSION ORDER OF CONDITIONAL LICENSE ORDER TO PAY A FINE Dear Mr. Valenzuela: Based on the recommendation of Goodhue County Social Services (Goodhue County), the Department of Children, Youth, and Families (DCYF) is lifting the temporary immediate suspension and placing your license to provide family child care at family child care at 31283 210th Avenue, Red Wing, MN on conditional status for two years, beginning August 11, 2026. This means you must meet certain conditions to maintain your license, detailed below. This order is based on your level of noncompliance with family child care licensing requirements. Our next steps and your options are also provided below. In addition, DCYF is ordering you to pay a fine of $600. Details of our findings are provided below. REASON FOR THE CONDITIONAL LICENSE 1. Commissioner’s evaluation of program In determining whether a licensing action is warranted, DCYF evaluated the facts, conditions, and circumstances concerning your program’s operation. This includes consideration of the well-being of children served in your program, available evaluations from consumers of your program, and information about the qualifications of caregivers working in your program. Specifically, because you were providing care at a unlicensed location, because you failed to submit a background study for a caregiver prior to caring for children, because you failed to ensure a caregiver had the required training, because you failed to maintain your paperwork as required, because hazards and toxins were accessible, because you failed to complete required licensing paperwork, because you failed to ensure that toxins and hazards were inaccessible to children, and because you failed to follow various health and safety requirements. DCYF has determined that it is appropriate to place your license on conditional status based on the violations identified below and the program evaluation. Legal Authority: Minnesota Statutes, section 142B.10, subdivision 13. 2. Failure to comply with licensing laws and rules As a result of previous licensing visits, Goodhue County determined that your program failed to comply with the laws and rules for licensed family child care. DCYF has considered the nature, chronicity, and severity of these violations, which are provided below. Legal Authority: Minnesota Statutes, section 142B.16, subdivision 1. Nature, history and severity of violations New violations determined On December 24, 2025, you notified Goodhue County that you were moving to a new location. On January 5, 2026, you were informed by Goodhue County that prior to operating at the new location you needed to complete change of premise paperwork, have a licensing inspection, and have a fire marshal inspection. You requested that Goodhue County email you the change of premise paperwork which was done that day. You informed Goodhue County that you were working a construction job until you could operate at your new location. On January 29, 2026, Goodhue County sent you an email asking when you were going to submit your paperwork. You responded on January 30, 2026, that you would turn in your paperwork that week. On February 12, 2026, Goodhue County mailed the paperwork to your new address as you were not able to print out the emailed forms. On March 3, 2026, you sent an email to Goodhue County stating you had some questions on the paperwork. Goodhue County made several attempts to contact you, but was unable to reach you. Goodhue County did not receive your paperwork or hear from you. On May 7, 2026, Goodhue County made a visit to your new location. Upon arriving, you were not home and there was an individual providing care for six children, even though you had been notified by Goodhue County that you could not be providing care at this unlicensed location. You informed Goodhue County that you had been doing care at your new home since January 2026, even though it was unlicensed. Goodhue County made a follow up visit to your home and determined the following licensing violations; 1. You made changes that altered your license without notifying Goodhue County when you were operating your family child care program at an unlicensed location. Statute Violated: Minnesota Statute, section 142B.10 subdivision 15, paragraph a. 2. You failed to ensure an individual caring for children had a background study as required. Statute Violated: Minnesota Statute, section 245C.03, subdivision 1. 3. You failed to ensure that a caregiver had the required training on sudden unexpected infant death (SUID) prior to caring for children. Statute Violated: Minnesota Statute, section142B.70, subdivision 6. 4. You failed to ensure that a caregiver had the required training on abusive head trauma (AHT) prior to caring for children. Statute Violated: Minnesota Statute, section142B.70, subdivision 6. 5. You failed to ensure that a caregiver had the required cardiopulmonary recitation (CPR) and first aid prior to caring for children. Statute Violated: Minnesota Statute, section 142B.70 subdivision 4 and subdivision 5. 6. You failed to ensure that a substitute caregiver had the required Basics for Family Child Care training as required. Statute Violated: Minnesota Statute, section 142B.70, subdivision 10, paragraph (c ). 7. You failed to provide documentation that your fire extinguisher was serviced as required. The tag showed it was last serviced in December 2024. Statute Violated: Minnesota Statute, section 142B.72, subdivision 4. 8. You failed to obtain allergy information on two children prior to enrollment as required. Statute Violated: Minnesota Statute, section 142B.71, subdivision 1, paragraph (a). 9. You failed to ensure that your first aid kit had a thermometer. Rule Violated: Minnesota Rule, part 9502.0435, subpart 7. 10. You failed to provide documentation of a complete well water test as required. Your test results did not include Nitrogen Nitrates. Rule Violated: Minnesota Rule, part 9502.0445. subpart 1.A. 11. You failed to ensure that the basement used by children had at least two means of escape as required. Statute Violated: Minnesota Statute, section 142B.72, subdivision 1, paragraph 1. 12. You failed to provide required supervision when you left children with an individual who did not have a background study or training as required. Rule Violated: Minnesota Rule, part 9502. 0315, subpart 29a and Minnesota Rule, part 9502.0365, subpart 5. 13. You failed to provide procedures for reporting maltreatment to parents as required. Statute Violated: Minnesota Statute, section 142B.61, subdivision 1b. 14. You failed to maintain your refrigerator temperature at or below 40 degrees Fahrenheit when your refrigerator temperature was 41.4 degrees. Rule Violated: Minnesota Rule, part 9502.0445, subpart 4.B. 15. You failed to provide documentation of monthly crib safety inspections as required. Statute Violated: Minnesota Statute, section 142B.45, subdivision 4 (a). 16. You failed to provide current admission, and arrangement forms for two children in care as required. Rule Violated: Minnesota Rule, part 9502.0405, subpart 4. 17. You failed to provide a portable radio or TV in the event of an emergency. Rule Violated: Minnesota Rule, part 9502.0435, subpart 8.E. 18. You failed to ensure that the furnace was inaccessible to children in care as required. Rule Violated: Minnesota Rule, part 9502.0425, subpart 7 E. 19. You failed to ensure that toxic substances were inaccessible to children in care when children had access to over the counter medication and vitamins in a hall closet with no door on it. Rule Violated: Minnesota Rule, part 9502.0435, subpart 4. 20. You failed to obtain the required fire marshal inspection which was required because you were using the basement for child care. Rule Violated: Minnesota Rule, part 9502.0335, subpart 2.A. 21. You failed to provide documentation on permission to administer medication for two children in care as required. Rule Violated: Minnesota Rule, part 9502.0435, subpart 16. 22. You failed to ensure that hazards were inaccessible to children in care when your tv was not secured to prevent it from falling. Also accessible were cigarettes, lighters, scissors, push pins, tools, a pizza cutter, can opener, vegetable peeler, plastic wrap, and plastic bags. Rule Violated: Minnesota Rule, part 9502.0435, subpart 6. 23. You failed to document the use of a substitute caregiver as required. Statute Violated: Minnesota Statute, section 142B.74, subdivision 1. 24. You failed to ensure that the wall between the garage and residence met requirements when there was a section of wall that extended through the rafters that was not covered with gypsum board or an equivalent. Rule Violated: Minnesota Rule, part 9502.0425, subpart 5. 25. You failed to provide documentation of parental permission to transport children as required. Rule Violated: Minnesota Rule, part 9502.0405, subpart 4. E. 26. You failed to ensure that your water temperature was at or below 120 degrees Fahrenheit when your water temperature was at 129.6 degrees Fahrenheit. Rule Violated: Minnesota Rule, part 9502.0435, subpart 15. A. 27. You failed to provide disposable gloves and eye protection in the event of an emergency. Statute Violated: Minnesota Statute, section 142B.71, subdivision 2, (4). 28. You failed to have children wash their hands prior to them eating a snack as required. Rule Violated: Minnesota Rule, part 9502.0435, subpart 15. 29. You failed to provide parents of four children in care that you do not carry liability insurance as required. Statute Violated: Minnesota Statute, section 142B.62( c). 30. You failed to submit an application to Goodhue County to license your new location as required. Rule Violated: Minnesota Rule, part 9502.0335, subpart 1. 31. You failed to train a caregiver on your emergency preparedness plan prior to caring for children as required. Statute Violated: Minnesota Statute, section 142B.71, subdivision 3 (b). 32. You failed to ensure that stairways met requirements when the back of the stair risers were not enclosed, stairways were not well lit, and the area between the handrail and stair threads were not enclosed as required. Rule Violated: Minnesota Rule, part 9502.0425, subpart 10. 33. You failed to provide documentation of current immunization records for two children in care as required. Rule Violated: Minnesota Rule, part 9502.0405, subpart 4. C. 34. You failed to provide documentation of an updated emergency plan for your new location as required. Statute Violated: Minnesota Statute, section 142B.71, subdivision 3, (a). 35. You failed to provide documentation of emergency drills since September 15, 2025. Statute Violated: Minnesota Statute, section 142B.71, subdivision 3 (c ). 36. You failed to provide documentation of a written fire escape plan as required. Rule Violated: Minnesota Rule, part 9502.0435, subpart 8.F. 37. You failed to ensure that your outdoor play space was free of hazards when children had access to boards with screws and pieces of metal that were partially burned. Ashes were also accessible to children as well as horses that were nearby with an electric fence. Rule Violated: Minnesota Rule, part 9502.0425, subpart 2. 38. You failed to ensure that combustibles were not in close proximity to your furnace when a plastic play yard gate and paint can were by the furnace. Statute Violated: Minnesota Statute, section 142B.72, subdivision 3. 39. You failed to follow guidelines for electrical wiring when you were using two extension cords. Rule Violated: Minnesota Rule, part 9502.0425, subpart 18, C. 40. You failed to follow your smoking policy that said there was no smoking in your program when smoking had occurred in the attached garage. You also did not have a sign posted stating smoking was allowed in your dwelling. Rule Violated: Minnesota Rule, part 9502.0425, subpart 19. 41. You failed to provide documentation of written consent from parents for emergency medical treatment for two children in care. Rule Violated: Minnesota Rule, part 9502.0405, subpart 4.D. 42. You failed to obtain a fire marshal inspection prior to caring for children in the basement. Rule Violated: Minnesota Rule, part 9502.0425, subpart 1 B. 43. You failed to provide documentation of pet vaccinations for a cat as required. Rule Violated: Minnesota Rule, part 9502.0435. subpart 12 C. 44. You failed to follow diapering procedures when you did not have a lined garbage container in the diapering area and children had access to diapers. Rule Violated: Minnesota Rule, part 9502.0435, subpart 13 A and 13 C. 45. You failed to provide documentation of current first aid training as required. Statute Violated: Minnesota Statute, section 142B.70, section 4 a. 46. You failed to ensure that your furnace and water heater were inaccessible to children in care as required. Rule Violated: Minnesota Rule, part 9502.0425, subpart 7 E. Subsequently, on May 13, 2026, DCYF placed your family child care license on a Temporary Immediate Suspension. You did not appeal the Temporary Immediate Suspension. The Temporary Immediate Suspension remains in effect. Between May 14, 2026, and July 27, 2026, Goodhue County continued to work with you to bring your program into compliance. On July 28, 2026, Goodhue County made an announced visit to your new location. As a result of the visit, the following licensing violations were determined. The following are new violations that have not been the subject of a previous correction order. If you appeal this order, the following violations will be reviewed as a part of the appeal. DCYF considered these violations as a factor when it determined that a Conditional License is appropriate. 1. You failed to ensure that the separation requirement between the attached garage and the house was completed as required. Rule Violated: Minnesota Rule, part 9502.0335, subpart 2 B. 2. You failed to include in your provider policy that smoking is allowed after hours in the garage or attached garage as well as posting this information in the home for parents to view. Rule Violated: Minnesota Rule, part 9502.0405, subpart 3, item P. 3. You failed to have an adequate quantity of toys and equipment available for children as required. Rule Violated: Minnesota Rule, part 9502.0415, subpart 3. 4. You failed to ensure that your outdoor play space was free of rubbish, animal waste, and hazards when children had access to horse waste, horses, a water heater, tarps and hazards under the tarps, ashes, wiring, fire extinguisher, washer fluid, and fishing poles with hooks. Rule Violated: Minnesota Rule, part 9502.0425, subpart 2. 5. You failed to ensure that toxic substances were inaccessible when children had access to deodorant, mouth wash, shaving gel, hair products, and medication. Rule Violated: Minnesota Rule, part 9502.0435, subpart 4. 6. You failed to ensure that ammunition was stored in a locked area as required. Rule Violated: Minnesota Rule, part 9502.0435, subpart 5. 7. You failed to ensure that hazards were inaccessible when children had access to knives, plastic, an unsecured television, archery bows and arrows. Rule Violated: Minnesota Rule, part 9502.0435, subpart 6. 8. You failed to ensure you had a complete first aid kit when you were missing a thermometer as required. Rule Violated: Minnesota Rule, part 9502.0435, subpart 7. 9. You failed to provide a smooth nonabsorbent surface for diaper changes as required. Rule Violated: Minnesota Rule, part 9502.0435, Subpart 13, item D. 10. You failed to ensure that your water temperature was at or below 120 degrees Fahrenheit when your water temperature was 129.4 degrees Fahrenheit. Rule Violated: Minnesota Rule, part 9502.0435, subpart 15.A. 11. You provided care in an unlicensed location. Statute Violated: Minnesota Statues, section 142B.10, subdivision 15, (a). 12. You failed to provide documentation of completed monthly storm drills logs after September 15, 2025. Statute Violated: Minnesota Statues, section 142B.71, subdivision 3, (c). 13. You failed to provide documentation of monthly crib safety inspections after November 1, 2025. Statute Violated: Minnesota Statues, section 142B.45, subdivision 4 (a). On August 3, 2026, and August 4, 2026, Goodhue County verified that you had corrected the above licensing violations to complete the change of premise and resume providing family child care at your new location. Previous licensing actions The following violations summarize the nature of your previous licensing violations. Because these violations are now conclusive, the individual violations are not within the scope of your appeal rights. Please refer to the previously issued correction orders for further details on these violations. If you do not have copies of these orders, contact your Goodhue County licensor for assistance. DCYF also considered this history as a factor when it determined that a Conditional License is appropriate. · May 13, 2026, Temporary Immediate Suspension, which determined children were at an imminent risk of harm. · July 22, 2025, Correction Order, which cited you for failure to ensure that hazards were inaccessible to children in care when children had access to garbage bags. · January 31, 2023, Correction Order, which cited you for the following licensing violations: o You failed to provide a portable radio or TV for emergencies as required. o You had two birds in your program for four to five months prior to having them tested for chlamydia-psittaci. o You failed to have bodily fluid disposable supplies including eye protection. o You failed to provide documentation of two hours of annual training as required. Severity of violations Due to the serious and chronic nature of these violations, and the conditions in the program, which impact the health and safety of children served in your care, your license to provide family child care is placed on a conditional status. Conditional License Terms In addition to the licensing rules and statutes for family child care, you are required to comply with the following terms: 1. You must follow and comply with all applicable Minnesota Rules and Laws. 2. No variances to age distribution or capacity will be granted during the conditional period. 3. Prior to using a substitute or another caregiver, you must have approval from Goodhue County to ensure that the individual has the required background study and training.
4. You must work with Goodhue County to obtain a mentor to work on ensuring you are following all family child care rules and laws in particular pertaining to keeping your family child care program clean, organized, and free of health and safety issues. The mentor must be obtained within 30 days of receiving this order. You must also sign a release of information for Goodhue County to communicate with the mentor to follow up on your progress. The release must be signed within 5 days of obtaining a mentor. 5. You must review Minnesota Rules 9502 and Minnesota Statute 142B and 245C and complete a worksheet created by Goodhue County. The worksheet must be completed within 30 days of this order. 6. You must obtain a minimum of six hours of additional training within 60 days of this order. The training is in addition to the annual training requirements as listed in Minnesota Statutes, section 142B.70. The training must be in the area of health and safety. You must obtain prior approval from Goodhue County to ensure that the training is appropriate, and you must submit documentation of your attendance to Goodhue County. 7. You must either provide a copy of the Order of Conditional License to parents of children in care or document that all parents have been given an opportunity to review the Order. You must obtain parent signatures of each currently enrolled child, indicating they have either received a copy of the Order or had an opportunity to review the Order. You must provide this documentation to Goodhue County within 30 days of this order. For new families, you must submit documentation of compliance with this term to Goodhue County within 5 days of any child’s admission to your child care program. If you close or temporarily stop services at license no. 1099512 during the conditional license period, you must complete any remaining duration and/or terms of this conditional license in the event you apply for and are approved for a new family child care license or resume services at license no. 1099512. Ongoing Monitoring Your Goodhue County licensor will monitor your compliance with these terms and with all of the family child care rules and laws. This will include unannounced visits. If you fail to demonstrate substantial compliance with family child care requirements or with the terms of your conditional license that are provided above, DCYF may take an additional licensing sanction, including a revocation of your license. REASON FOR FINE 1. Background Study Violation On May 7, 2026, Goodhue County made a visit to your new location as they had not heard from you since March 2026. Upon arrival, Goodhue County observed an individual caring for children who did not have a background study as required. Statute Violated: Minnesota Statutes, section 245C.04, subdivision 1, paragraph (g). Fine: $200 2. Failure to Complete Training On May 7, 2026, Goodhue County made a visit to your new location. Upon arrival, Goodhue County observed an individual caring for children who did not have CPR and first aid training prior to caring for children. Statute Violated: Minnesota Statutes, section 142B.70, subdivision 4 and subdivision 5. Fine: $200 On May 7, 2026, Goodhue County made a visit to your new location. Upon arrival, Goodhue County observed an individual caring for children who did not have SUID and AHT training prior to caring for children. Statute Violated: Minnesota Statutes, section 142B.70, subdivision 6. Fine: $200 Total Fine Amount $600 Legal Authority: Minnesota Statutes, section 142B.18, subdivision 4, paragraph (c), subparagraph (4)(ii). YOUR APPEAL/RECONSIDERATION RIGHTS If You Wish to Appeal the Fine and the Conditional License, or Just the Fine You have the right to appeal both the fine and the conditional license, or only the fine. Your request must be in writing and clearly state that you are requesting a contested case hearing for this matter. Your request must be made before the deadlines provided below. If you do not meet this deadline, you lose your right to an administrative appeal. The timeline to appeal began when you received this order. If you are mailing your request, it must be sent by certified mail and postmarked within 10 calendar days from when you receive this order. Following this hearing, the Commissioner of DCYF will issue a final order. If You Wish to Only Appeal the Conditional License If you are not appealing the fine, you do not have a right to a contested case hearing. However, you have the right to request reconsideration of the conditional license and the cited violations. Your request must: · Be in writing · Clearly state that you are requesting reconsideration of the conditional license · List each citation you are challenging and identify what is inaccurate or incomplete about the information in the order · Supply information that is accurate or more complete · State why you believe your license should not be on a conditional status · Be made before the deadlines provided below If you are mailing your request, it must be sent by certified mail and postmarked within 10 calendar days from when you received this order. If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order. Payment must be made as directed on the invoice. If you request a contested case hearing, as described above, do not pay the fine at this time. Following the contested case hearing, the Commissioner of DCYF will issue a final order on this matter. Please note, you may not avoid payment of this fine by closing, selling, or otherwise transferring the license to a third party. If this occurs, you are personally responsible for payment. If you do not pay the fine on or before the date specified on the invoice and you did not request a contested case hearing, as described above, the Commissioner may issue a second fine, may not issue or reissue a license, or may suspend the license until the license holder pays the fine. Conditional license stayed pending reconsideration If you request reconsideration within the timeframes described above, the terms of the conditional license will not take effect until a decision is issued by DCYF. If the conditional license is affirmed on reconsideration, the terms would take effect on the date of the reconsideration decision, and run for two years from that date. You continue to be required to comply with all family child care laws and rules. Legal representation at the contested case hearing You do not need a lawyer to appeal. However, a lawyer can help you with your appeal. The state or county will not get you a lawyer and will not pay for a lawyer. Posting of this licensing action You are required to place this Order Lifting Immediate Suspension, Order of Conditional License and Order to Pay a Fine in a place that is clearly noticeable to the people receiving services and all visitors to the facility for two years, even if you appeal. Prohibition against providing legally unlicensed child care On May 13, 2026. DCYF issued an Order of Temporary Immediate Suspension to your family child care program, which disqualified you from providing legally unlicensed child care. You remain prohibited from providing legally unlicensed child care even if you appeal this order. Legal authority for this licensing action · This action is taken under Minnesota Statutes, section 142B.18, subdivision 1, paragraph (a), which describes under which conditions DCYF may impose a fine against a license. · DCYF may impose a $200 fine for each health, safety, or supervision licensing violation under Minnesota Statutes, section 142B.18, subdivision 4, paragraph (c), subparagraph (4)(iv). · Minnesota Statutes, section 142B.18, subdivision 4, paragraph (c), subparagraph (5), states that license holders may not avoid payment of a fine by closing, selling, or transferring a license. · Minnesota Statutes, section 142B.12, subdivisions 5 and 8, state that DCYF shall not issue or reissue a license if the applicant, license holder, or controlling individual has an outstanding debt related to a license fee, licensing fine, or settlement agreement for which payment is delinquent. · Minnesota Statutes, section 142B.18, subdivision 4, paragraph (c), subparagraph (c), states that that the license holder shall pay the fine assessed on or before the payment date specified, and if the license holder does not do so the commissioner may issue a second fine or suspend the license until the license holder complies. · The timeline to request reconsideration of the order of conditional license is provided in Minnesota Statutes, section 142B.16, subdivision 4. · License holders have a right to appeal licensing actions and request a contested case hearing, under Minnesota Statutes, chapter 14 and Minnesota Rules, parts 1400.8505 to 1400.8612. · If a license holder files a timely reconsideration request, the terms of the conditional license are stayed pending a decision by DCYF under Minnesota Statutes, section 142B.16, subdivision 4. · Under Minnesota Statutes, section 142B.16, subdivision 4, if DCYF issues a dual order to pay a fine and a conditional license and the license holder appeals both the fine and the conditional license, DCYF will not do a separate reconsideration of the conditional license. If the license holder does not appeal the fine but requests reconsideration of the conditional license, then the license holder does not have a right to a hearing and DCYF will conduct a reconsideration of the conditional license. · The requirement to post this order in a clearly visible location is required under Minnesota Statutes, section 142B.18, subdivision 6. · Minnesota Statutes, section 142B.05, subdivision 4, provides that a child care provider who has received a Fine or Conditional Order that has not been reversed on appeal may not operate as a legally unlicensed child care provider to non-relatives. Operating a prohibited unlicensed family child care is a misdemeanor under Minnesota Statutes, section 142B.05, subdivision 5.
