August 17, 2026 ISSUED VIA PROVIDER HUB Dahaba Ibrahim, Authorized Agent HIGH FIVE LEARNING LLC 14409 Portland Avenue Burnsville, MN 55337 License Number: 2001689 (Rule 3) ORDER OF CONDITIONAL LICENSE Dear Dahaba Ibrahim: The Department of Children, Youth, and Families (DCYF) is placing your license to provide childcare services at HIGH FIVE LEARNING LLC, 1609 Southcross Drive West, Burnsville, MN 55306, on conditional status for two years, beginning August 28, 2026. This means you must meet certain conditions to maintain your license, detailed below. This order is based on your noncompliance with child care licensing requirements. Details of our findings are also provided below. Our next steps and your options are also detailed. REASON FOR THE CONDITIONAL LICENSE On July 20,2026, DCYF licensor conducted a re-inspection visit at your facility located at 1609 Southcross Dr W, Burnsville, MN 55306. As a result of this licensing visit, the DCYF licensor determined that your program failed to comply with the laws and rules that apply to licensed child care centers, citing sixteen violations. DCYF has considered the nature, chronicity, and severity of these violations, as well as the health, safety, and rights of children by the program. Nature and Severity: On July 20, 2026, the DCYF licensor determined that your program failed to comply with the laws and rules that apply to licensed child care centers, citing sixteen violations. Twelve of the sixteen violations are repeat violations for which you were previously cited. In your response to the Correction Order dated June 2, 2026, you stated that you corrected all the violations. However, it was determined that twelve of those citations were not corrected and were again determined to be out of compliance, suggesting an unwillingness and/or inability to comply with licensing rules and statutes. Numerous violations related to the health and safety of children were found, including failure to comply with: o staff distribution requirements o medication requirements o children’s file requirements o food allergy requirements o hazards requirements Chronicity: Your program received its license on May 3,2025. In that short time, your program demonstrated a history of noncompliance with licensing rules and statutes. The information below summarizes this history: o August 17, 2026Conditional License (this order): 16 violations (12 repeat) o June 2,2026, Correction Order: 26 violations (6 repeat) o February 23,2026, Correction Order: 7 violations (3 repeat) o November 7,2025, Correction Order : 10 violations Due to the serious and chronic nature of these violations, and the conditions in the program, which impact the health and safety of children in your care, your license to provide child care services is placed on a conditional status. Licensing Violations DCYF determined that your program failed to follow licensing rules and statutes, as described below. STAFF QUALIFICATIONS AND TRAINING 1. Violation: Staff distribution requirements were not maintained. There was no documentation to show that SP4 met the experience requirements to be considered teacher qualified, therefore, SP4 was deemed assistant teacher qualified. On the day of the visit, SP4 was supervising five children with another aide. A teacher qualified staff person was required. (Bright Beginnings: Preschool classroom) Citation: Minnesota Rules, part 9503.0040, subpart 2 2. Violation: The program did not have documentation on site to show that 1 of 1 (SP4) staff persons met the experience requirements of the teacher job classification for which the staff person was employed (SP4). Citation: Minnesota Rules, part 9503.0032, subpart 2; and part 9503.0120, item B Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to the Correction Order dated June 2, 2026, you stated, “Staff qualification documentation has been obtained and is maintained onsite. Staff files will be reviewed before assigning job classifications.” 3. Violation: Documentation was not available on site to verify that before starting assigned duties 1 of 1 (SP4) individuals (director, staff persons, substitutes, or unsupervised volunteers) received orientation training on the risk of abusive head trauma that was at least one half hour in length as required in Minnesota Statutes, section 142B.65, subdivision 7 (SP4). There was no documentation available to verify the duration of the training on the risk of abusive head trauma. (SP4) Citation: Minnesota Statutes, section 142B.65, subdivision 1; and section 142B.10, subdivision 21, paragraph (b), clause (1) INFANT AND TODDLER CARE 4. Violation: Toys and equipment that were mouthed by infants and toddlers were not cleaned and disinfected when mouthed or soiled and at least daily. There was no bin available for toys and equipment that were mouthed by toddlers. (Curious Cubs: Toddler classroom) Citation: Minnesota Rules, part 9503.0140, subpart 19 Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to Corrected Order dated June 2, 2026, you stated, “A designated mouthed-toy container has been placed in the toddler classroom. Staff have been reminded of cleaning and disinfecting procedures. Staff will set aside mouthed toys immediately and clean/ disinfect them as required.” 5. Violation: Each infant's bottle was not labeled with the child's first and last name. There were two infant bottles in the kitchen refrigerator that were not labeled with the infant's first and last name. (Tiny Treasures: Infant classroom) Citation: Minnesota Rules, part 9503.0145, subpart 7, item D Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to the Correction Order dated June 2, 2026, you stated, “Infant bottles are now labeled with each child’s first and last name. Bottle labeling will be checked daily.” PHYSICAL ENVIRONMENT 6. Violation: The program did not comply with cleanliness requirements; the indoor space was not clean. There was a toilet plunger accessible to children in the toddler bathroom. (Facility) As defined in Minnesota Rules, part 9503.0005, subpart 9, clean means 'free from dirt or other contaminants that can be detected by sight, smell, or touch.' Citation: Minnesota Rules, part 9503.0140, subpart 9 Repeat Licensing Violation: The license holder was cited for a similar violation in the following order(s): · A Correction Order dated June 2, 2026 · A Correction Order dated February 23, 2026 In your response to the Correction Order dated June 2, 2026, you stated, “The identified wall has been cleaned. Classroom cleanliness will be checked daily.” 7. Violation: Electrical outlets were not tamper-proof or shielded. There was one unshielded electrical outlet on the back wall in two classrooms. (Tiny Treasures: Infant classroom and Curious Cubs: Toddler classroom) Citation: Minnesota Rules, part 9503.0155, subpart 11 Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to the Correction Order dated June 2, 22026, you stated, “The outlet issue was corrected during the licensing visit. Outlet covers and surge protectors will be included in routine safety checks.” 8. Violation: The posted procedures for emergencies and accidents were not posted in a visible place in two classrooms. (Tiny Treasures and Tiny Treasures Ext.). Citation: Minnesota Rules, part 9503.0140, subpart 21 Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to the Correction Order dated June 2, 2026, you stated, “Emergency and accident procedures have been posted in visible locations. Required postings will be checked monthly.” 9. Violation: The program did not provide children with access to interest areas on a daily basis. Children were not provided daily access to: · science interest area (Trailblazers); · music interest area (Trailblazers); · large muscle activities interest area (Trailblazers); and · sensory stimulation activities interest area (Trailblazers) Citation: Minnesota Rules, part 9503.0045, subpart 2 Repeat Licensing Violation: The license holder was cited for a similar violation in the following orders: · A Correction Order dated June 2, 2026 · A Correction Order dated February 23, 2026 In your response to the Correction Order dated June 2, 2026, you stated, “Required interest areas have been made available in the identified classrooms. Teachers will monitor daily access to required interest areas.” HAZARDS 10. Violation: The DCYF licensor observed that hazardous objects were accessible to children. · There was hand sanitizer on counter ledge by the entrance, accessible to children. (Facility) · There was a bulletin board on the classroom floor that had papers secured with thumb tacks, accessible to children. (Trailblazers: School Age classroom) Citation: Minnesota Statutes, section 142B.54, subdivision 2, paragraph (e) and Minnesota Rules, part 9503.0140, subpart 17 HEALTH AND SAFETY 11. Violation: Food allergy information was not readily available to staff where food is prepared. There was no food allergy information available for two children with known allergies where food is prepared. (Facility) Citation: Minnesota Statutes, section 142B.66, subdivision 1, paragraph (d) Repeat Licensing Violation: The license holder was cited for a similar violation in the following orders: · A Correction Order dated June 2, 2026 · A Correction Order dated February 23, 2026 · A Correction Order dated November 7, 2025 In your response to the Correction Order date June 2, 2026, you stated, “Food allergy information has been posted and made readily available where food is prepared and served. Allergy postings will be reviewed regularly and updated as needed.” 12. Violation: Medication was not kept in the original container. There was an EPI pen that was not in its original container. Citation: Minnesota Rules, part 9503.0140, subpart 7, item C Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to the Correction Order dated June 2, 2026, you stated, “Medication storage has been corrected so medication is kept in its original container. Medication containers will be checked when received and during routine reviews.” 13. Violation: The record of medication administration form did not include the: · name of the child; · name of the medication or prescription number; · date, time and dosage; and · name and signature of the person dispensing the medication. Through a conversation with an administrative staff person, it was determined that insulin was being administered to a child. The center used an app to record the administration of medication. The app did not include the name or signature of the person dispensing the medication. Citation: Minnesota Rules, part 9503.0140, subpart 7, item C 14. Violation: Products to control diaper rash were not labeled with the child's first and last name. There was one package of wipes that was not labeled with the child's first and last name. (Tiny Treasures Ext. : Infant classroom) Citation: Minnesota Rules, part 9503.0140, subpart 7, item D Repeat Licensing Violation: The license holder was cited for a similar violation in the following orders: · A Correction Order dated June 2, 2026 · A Correction Order dated February 23, 2026 · A Correction Order dated November 7, 2025 In your response to the Correction Order dated June 2, 2026, you stated, “Diaper products and wipes have been properly labeled. Staff will check labeling when items are brought into the classroom.” CHILDREN’S FILES 15. Violation: Each child's record did not contain all required information for children age six weeks to 33 months, 2 of 2 (C2 and C3) children's files reviewed did not contain a description of the child's eating, sleeping, toileting, communication habits, and effective methods for comforting the child. Citation: Minnesota Rules, part 9503.0125 Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to the Correction Order dated June 2, 2026, you stated, “The identified records have been corrected and maintained onsite. Child files will be reviewed at enrollment and through routine file audits.” 16. Violation: 1 of 1 (C2) children's files reviewed did not contain a current immunization record, a signed notarized statement of parental objection to the immunization, or a medical exemption. Citation: Minnesota Rules, part 9503.0125, item G; and part 9503.0140, subpart 5 Repeat Licensing Violation: The license holder was cited for a similar violation in a Correction Order dated June 2, 2026. In your response to the Correction Order dated June 2, 2026, you stated, “The required immunization documentation has been obtained and is maintained onsite. Immunization records will be checked at enrollment and during file reviews.” Immediate corrective action required You must immediately correct the violations cited above. Submit documentation to your licensor within 30 days from when you received this order explaining how you have corrected the violations. If you fail to demonstrate substantial compliance with child care center requirements or with the terms of your conditional license that are provided below, DCYF may take an additional licensing action, including revocation, against your license. Additionally, DCYF will not approve a request to increase services from the date of this order until the time your conditional license expires. CONDITIONAL LICENSE TERMS In addition to the child care licensing rules and statutes, you are required to comply with the following terms: 1. Within 15 days from receipt of this order, you must provide written notification of the conditional status of your license to all parents/legal guardians. Prior to providing the written notification to all parents/legal guardians, you must submit the written notice to your DCYF licensor for approval. The notification must specify the length of time of the conditional status of your license, the reasons your license was made conditional, and must include either a copy of the Order of Conditional License or an offer to provide a copy of the order upon request. 2. On a monthly basis while your license is on conditional status, you must complete staffing patterns that identify every staff person and his/her job title included in the staff-to-child ratio for each classroom and maintain all completed staffing patterns onsite. The staffing information must be documented on the attached form titled “Staffing Patterns,” must be completed separately for each classroom, and must include the total number of children in attendance each hour for each classroom. The documentation must include the time each person takes their break, if applicable, and identify the name of the person who replaces them. Staffing patterns must be completed at the beginning of each month, maintained on site, and made immediately available to the Commissioner upon request. Within 30 days from the receipt of this order, you must develop a plan to ensure staff-to-child ratios are maintained at all times and submit the plan to your licensor for approval. 3. On a daily basis while your license is on a conditional status, you must complete daily maintenance, cleanliness, and hazard checks of the facility, equipment, and outdoor play areas, and maintain documentation onsite to show that the checks have been completed. This documentation must be made immediately available to the Commissioner during onsite inspection and otherwise requested. YOUR RIGHT TO REQUEST RECONSIDERATION You have the right to request reconsideration of this order and the cited violations. Your request must: · Be in writing · Clearly state that you are requesting reconsideration of the conditional license · List each citation you are challenging and identify what is inaccurate or incomplete about the information in the order · Supply information that is accurate or more complete · State why you believe your license should not be on a conditional status · Be made before the deadlines provided below If you choose to request reconsideration of this order, you must use the Provider Hub (https://providerhub.DCYF.mn.gov/) to submit your request. The timeline to request reconsideration began when this order was issued in the Provider Hub. Your request for reconsideration must be submitted in the Provider Hub within 10 calendar days from the date of issue. If you do not meet this deadline, you lose your right to request reconsideration. Conditional license stayed pending reconsideration If you request reconsideration within the timeframes described above, the terms of the conditional license will not take effect until a decision is issued by DCYF. If the conditional license is affirmed on reconsideration, the terms would take effect on the date of the reconsideration decision, and run for two years from that date. You continue to be required to comply with all child care center laws and rules. Posting of this licensing action You are required to place this Order of Conditional License in a place that is clearly noticeable to the people receiving services and all visitors to the facility for two years, even if you appeal. Legal authority for this licensing action · This action is taken under Minnesota Statutes, 142B.16, subdivision 1. · Child Care Centers are required to follow Minnesota Rules 9503.0005 to 9503.0170; and Minnesota Statutes, Chapters 142B, 245C, and 260E · The timeline to request reconsideration of the order is provided in Minnesota Statutes, section 142B.16, subdivision 4. · The requirement to post this order in a clearly visible location is required under Minnesota Statutes, section 142B.16, subdivision 5. · If a license holder files a timely reconsideration request, the terms of the conditional license are stayed pending a decision by DCYF under Minnesota Statutes, section 142B.16, subdivision 4. · Minnesota Statutes, section 142B.16, subdivision 3 states that DCYF may impose additional licensing actions against a license holder that does not correct the violations cited in a conditional license order.
