August 18, 2026 Duffy Craft Artesian Homes LLC 14091 Baxter Drive, Suite 116 Baxter, Minnesota, 55425 License Number: 1070910 (245D – Home and Community-Based Services) CORRECTION ORDER Dear Duffy Craft: On July 13 through 15, 2026, a licensing review of Artesian Homes LLC at 14091 Baxter Drive, Suite 116, Baxter, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245A.65, subdivision 2. Violation: For two of five persons whose records were reviewed (P4 and P5), the license holder did not develop an individual abuse prevention plan (IAPP) as required. a. The license holder did not develop an IAPP for P4 that included an individualized assessment of P4’s susceptibility to abuse. The license holder documented in P4’s IAPP that P4 was not susceptible to physical abuse. This assessment was not consistent with information found in P4’s record. The support plan addendum the license holder developed for P4 documented that P4 has a history of physical aggression towards others. b. The license holder did not develop an IAPP for P5 that included an individualized assessment of P5’s susceptibility to self abuse consistent with other information in P5’s record. P5’s support plan addendum contained information that showed a history of suicide attempts; however the license holder did not identify this in P5’s IAPP and did not document the statement of specific measures the license holder would take to minimize this risk to P5.
Corrective Action Ordered: Within 30 days of receiving this order, you must review and revise P4’s and P5’s IAPP with their interdisciplinary team and document this review in the person’s record. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.04, subdivision 3, paragraph (c). Violation: For one person whose record was reviewed (P3), the license holder did not ensure the exercise and protection of rights as required. The license holder did not ensure the exercise and protection of P3’s right to access their personal possessions. During a site visit to the community residential setting (CRS license number 1070912) where P3 resides, DHS licensors observed the license holder restricted P3’s access to their personal possessions by locking P3’s personal snacks. Corrective Action Ordered: Within 30 days of receiving this order, you must: · discuss with P3’s team whether a restriction of P3’s rights is necessary to ensure the health, safety, and well-being of the person; · immediately cease the restriction of P3’s rights if the rights restriction is not necessary to ensure the health, safety, and well-being of the person; · if it is determined a rights restriction is necessary for P3, you must document the following information in P3’s support plan addendum: o the justification for the restriction based on an assessment of P3’s vulnerability related to exercising the right without restriction; o the objective measures set as conditions for ending the restriction; o a schedule for reviewing the need for the restriction based on the conditions for ending the restriction to occur semiannually from the date of initial approval, at a minimum, or more frequently if requested by P3 and P3’s case manager; and o signed and dated approval for the restriction from P3. A restriction may be implemented only when the required approval has been obtained. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.05, subdivision 1. Violation: For three persons whose records were reviewed (P2 through P4), the license holder did not meet health service needs as required. a. The license holder was assigned the responsibility of meeting P2’s health needs. The license holder did not maintain documentation on how the person’s health needs would be met, including a description of the procedures the license holder would take to ensure P2’s health needs related to P2’s surgically implanted medical device. b. The license holder was assigned the responsibility of administering P’s and P4’s psychotropic as needed (PRN) medications. The license holder did not maintain documentation on how the person’s health needs would be met, including a description of the procedures the license holder would take in order to safely and correctly administer the psychotropic PRN medications. Corrective Action Ordered: Within 30 days of receiving this order, you must: · review and revise P2’s through P4’s support plan addendums to include documentation on how their health needs will be met as described above; · provide training to staff who provide direct support to P2 through P4 on their revised plans; and · maintain documentation of the training in each staff person’s personnel records. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. 4. Citation: Minnesota Statutes, section 245D.05, subdivision 2. Violation: For one persons whose records were reviewed (P3), the license holder did not implement medication administration procedures as required. The license holder was assigned the responsibility of providing medication administration and assistance with refilling medications for P3. The license did not implement medication administration procedures to ensure P3 took medications as prescribed. On multiple occasions between January and March 2026, the license holder documented that medications were not available or had not been delivered by the pharmacy. The license holder did not ensure P3’s medications were available on site to be administered. Corrective Action Required: Immediately upon receiving this order, you must ensure P3’s prescribed medications are available on site. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. 5. Citation: Minnesota Statutes, section 245D.051, subdivision 1, paragraph (b). Violation: For four persons whose record was reviewed (P1 through P4), the license holder did not develop, implement, and maintain documentation regarding psychotropic medications as required. "Target symptom" refers to any perceptible diagnostic criteria for a person's diagnosed mental disorder, as defined by the Diagnostic and Statistical Manual of Mental Disorders Fourth Edition Text Revision (DSM-IV-TR) or successive editions, that have been identified for alleviation. The license holder was responsible for administering P1’s through P4’s psychotropic medications. The license holder did not document a description of the target symptoms that each medication was to alleviate. Corrective Action Ordered: Within 30 days of receiving this order, you must document the target symptoms that each psychotropic medication is to alleviate for P1 through P4. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. 6. Citation: Minnesota Statutes, 245D.071, subdivision 3. Violation: For one person whose record was reviewed (P4), the license holder did not initiate an intensive service as required. The license holder did not discuss how technology might be used to meet P4’s desired outcomes at P4’s initial service planning meeting. Corrective Action Ordered: Within 30 days of receiving this order, you must: · meet with P4 and P4’s case manager to discuss how technology might be used to meet P4’s desired outcome; and · include a summary of that discussion in P4’s support plan addendum. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. 7. Citation: Minnesota Statutes, Minnesota Statutes, section 245A.65, subdivision 3. Violation: For one of ten staff persons whose records were reviewed (SP5), the license holder did not provide orientation to the license holders program abuse prevention plan as required. The license holder did not provide SP5 with orientation to the license holder’s program abuse prevention plan within 72 hours of SP5 first providing direct contact services. SP5 first provided direct contact services on April 11, 2024, and received this orientation on April 20, 2024. Corrective Action Ordered: On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. 8. Citation: Minnesota Statutes, section 245D.09, subdivision 4. Violation: For three staff persons whose records were reviewed (SP5, SP7 and SP8), the license holder did not provide orientation training as required. The license holder did not provide SP5, SP7 and SP8 with orientation to basic first aid within 60 calendar days of hire. SP5 was hired on April 1, 2024, and received this orientation on June 18, 2024. SP7 was hired on September 10, 2025, and provided the license holder with a valid CPR and First Aid certification which expired in April 2026. The license holder provided this training on May 26, 2026. SP8 was hired on March 18, 2026, and had not received this training at the time of the licensing review. Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP8 with the orientation to basic first aid. Additionally, you must maintain documentation in SP8’s record that includes the date the training was completed, the number of hours per subject area, and the name of the trainer or instructor. On an ongoing basis, you must maintain compliance throughout your program, as required in this subdivision. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
