August 20, 2026 Rebecca LaBeau, Authorized Agent Cornerstone Preschool and Childcare 20731 Dyers Pass Farmington, MN 55024 License Number: 1094332 (Child Care Ctr) Program Location: 305 Elm St, Farmington, MN 55024-1028 Dear Rebecca LaBeau: The Minnesota Department of Children, Youth, and Families (DCYF), Division of Licensing, received your request for reconsideration regarding Citation 2 in the Correction Order issued to you on February 24, 2026. You did not request review for Citations 1, 3, 4, and 5. Citations 1, 3, 4, and 5 are not under the scope of review. Reconsideration Determination Citation 2 Violation. Documentation was not available on site to verify that before starting assigned duties 1 of 4 (SP3) individuals (director, staff persons, substitutes, or unsupervised volunteers) received orientation training on: · the risk of abusive head trauma that was at least one half hour in length as required in Minnesota Statutes, section 142B.65, subdivision 7 (SP3); · allergy prevention and response as required by Minnesota Statutes, 142B.66, subdivision 1 (SP3); · ·emergency preparedness as required by Minnesota Statutes, 142B.66, subdivision 3. (SP3); · handling and disposal of bodily fluids as required by Minnesota Statutes, 142B.66, subdivision 2 (SP3); · handling emergencies and accidents according to Minnesota rules, part 9503.0110 (SP3); · procedures for maintaining health and safety according to Minnesota Rules, part 9503.0140 (SP3); · a child's individual child care program plan as required under Minnesota Rules, part 9503.0065, subpart 3 (SP3); · program's risk reduction plan as required under section 142B.54, subdivision 2 (SP3); and sudden unexpected infant death that was at least one half hour in length as required in Minnesota Statutes, section 142B.65, subdivision 6 (SP3). Applicable Law. The license holder shall provide training to program staff related to their duties in implementing the program's policies and procedures necessary to maintain compliance with licensing requirements under Minnesota Statutes and Minnesota Rules. Minnesota Statutes, section 142B.10, subdivision 21, paragraph (b), clause (1). The child care center license holder must ensure that the director, staff persons, substitutes, and unsupervised volunteers are given orientation training and successfully complete the training before starting assigned duties. Minnesota Statutes, section 142B.65, subdivision 1. “Direct contact" means providing face-to-face care, training, supervision, counseling, consultation, or medication assistance to persons served by the program. Minnesota Statutes, section 245C.02, subdivision 11. Your Response. You stated, “the rule states that orientation must be successfully completed before a staff person begins “assigned duties.” It does not say before the staff person has “direct contact” with the children…I understood this to mean that orientation must be complete before a staff member independently performs job responsibilities or is assigned duties within the classroom.” You also stated that “the circumstances stem from a good-faith interpretation of the rule rather than not to follow it.” Reconsideration Determination. You acknowledged that you misunderstood the training and direct contact statutory requirements. You acknowledged that you lacked documentation on site to show that SP3 had completed the required orientation training before starting his/her assigned duties. Direct contact includes training of staff regarding their assigned duties. You must provide all required orientation training and ensure that all program staff complete the required orientation training before (emphasis added) starting training regarding assigned duties. You did not provide any additional information to refute that you did not have SP3’s documentation of completed required orientation trainings before the date of first direct contact of the training and class room observation. Citation 2 is affirmed. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 2 is affirmed. You did not request review for Citations 1, 3, 4, and 5. Citations 1, 3, 4, and 5 are not under the scope of review. This is a final agency decision. Previously Ordered Corrective Action. In the original Correction Order issued, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 1, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations and respond in the Provider Hub immediately.
