Dear Angela Williams:
On March 23, 2026, the Minnesota Department of Children, Youth, and Families (DCYF), Division of Licensing, received your request for reconsideration regarding Citation 2 in the Correction Order issued to you on March 19, 2026. You did not request review for Citation 1. Citations 1 is not under the scope of review.
Reconsideration Determination
Citation 2 The program did not have documentation on site to show that 1 of 1 (SP5) staff persons met the education requirements of the director job classification for which the staff person was employed (SP5).
Applicable Law. DIRECTORS. Subpart 1. General requirements for a director. A director must:
A. be at least 18 years old;
B. be a graduate of a high school or hold an equivalent diploma attained through successful completion of the commissioner of education-selected high school equivalency test;
C. have at least 1,040 hours of paid or unpaid staff supervision experience; and
D. have at least nine quarter credits or 90 hours earned in any combination of accredited courses in staff supervision, human relations, and child development. Minnesota Rules, part 9503.0031, subpart 1.
The license holder must ensure that a personnel record for each staff person is maintained at the center. The personnel record for each staff person must contain: the staff person's documentation indicating that the staff person meets the requirements of the staff person's job position and the education and experience requirements specified in
parts 9503.0031 to 9503.0034;Minnesota Rules, part 9503.0120, item B.
Your Response. You stated that SP5 is in the process of obtaining official credentials from Bolivia. “The process in Bolivia requires documents to be requested in person, processed through multiple institutions, and sent internationally in sealed and certified envelopes. These steps can take several weeks or longer.”
You stated that there is another individual who is listed as the designated director in the Summary of Personnel Form. You also stated that SP5’s role has been updated from “director” to “manager” on the Summary Personnel Form to address the lack of documentation in SP5’s personnel file that SP5 meets the education requirements of SP5’s director job classification role.
Reconsideration Determination. The Licensor noted that you lacked the documentation on site to show that SP5 met the education requirements of the director job classification for which SP5 was employed. SP5 was listed as the “director” on the Summary of Personnel Form, but you did not have the documentation on site to show that SP5 met the education requirements of the director job classification for which SP5 was employed. You do not dispute your lack of SP5’s education documentation. Instead, you provided an explanation as to why the documents have been delayed and missing. Citation 2 is affirmed.
You revised the Summary of Personnel Form after the licensing site visit to classify SP5 as a “manager” rather than a “director,” but on the day of the site visit, SP5 was listed as the “director”, and you did not have documentation to show that SP5 met the education requirements of a director. Citation 2 is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 2 is affirmed. You did not request review for Citation 1. Citation 1 is not under the scope of review. This is a final agency decision.
Previously Ordered Corrective Action. In the original Correction Order issued, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 1, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations and respond in the Provider Hub immediately. The Commissioner appreciates your response and encourages you to continue to work cooperatively with your licensor to ensure the safety and well-being of the children you serve.
