August 20, 2026 Angela Carlson, Authorized Agent New Creations Child Care & Learning Center at Prior Lake 11806 Aberdeen St NE Ste 210 Blaine, MN 55449 License Number: 1103753 (Child Care Ctr) Program Location: 16757 Five Hawks Ave SE, Prior Lake, MN 55372 Dear Angela Carlson: On March 9, 2026, the Minnesota Department of Children, Youth, and Families (DCYF), Division of Licensing, received your request for reconsideration regarding Citation 1 in the Correction Order issued to you on March 3, 2026. Reconsideration Determination Citation 1 Violation. The DCYF licensor observed that hazardous objects were accessible to children. Applicable Law. The License Holder must develop a risk reduction plan that prohibits the accessibility of hazardous items to children. Minnesota Statutes, section 142B.54, subdivision 2, paragraph (e). Hazardous objects including but not limited to sharp objects, medicines, plastic bags and poisonous plants, chemicals, including household supplies, must be stored out of reach of children. Minnesota Rules, part 9503.0140, subpart 17. Your Response. You stated that “the toilet bolt is a structural component of the facility rather than a hazardous object such as medicine, chemicals, or sharp tools left accessible by staff.” You also stated, “ Should an uncovered toilet bolt remain a violation, we request that the citation be reclassified under Minnesota Rules, part 9503.0140, subpart 19 (Condition of Equipment and Furniture). This subpart addresses structural stability and protrusions, which more accurately describes a toilet bolt that may become exposed during routine maintenance or cleaning.” Reconsideration Determination. The DCYF licensor observed that hazardous objects were accessible to children, specifically, there was a toilet bolt protruding out of the base of the toilet. Hazardous objects including but not limited to sharp objects, medicines, plastic bags and poisonous plants, chemicals, including household supplies, must be stored out of reach of children. The protruding, exposed bolt at the toilet base is a hazard. Citation 1 is affirmed. This violation was not classified under Minnesota Rules, part 9503.0140, subpart 19, but if the Licensor had classified the protruding toilet bolt as non-compliance of condition of equipment and furniture, then the Commissioner would have affirmed under that rule, too. Regardless, the protruding toilet bolt is a hazard; therefore, citation 1 is affirmed. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 is affirmed. This is a final agency decision.
