Reconsideration Determination Citation 1 Violation. A minimum temperature of 68 degrees Fahrenheit was not maintained in the program. Applicable Law. A minimum temperature of 68 degrees Fahrenheit must be maintained in indoor areas used by children. Minnesota Rules, part 9503.0155, subpart 13. Your Response. You stated that the temperature drops within two degrees of the required temperature of 68 degrees for less than one hour. You also stated that you identified and implemented a backup heat source. Reconsideration Determination. The Licensor noted that you maintained documentation that the program did not maintain a minimum indoor room temperature of 68 degrees Fahrenheit. Staff persons and the Director confirmed to the Licensor that were issues with maintaining the minimum 68 degrees Fahrenheit temperature. A minimum temperature of 68 degrees Fahrenheit must be maintained in indoor areas used by children. You did not maintain an indoor room temperature of a minimum of 68 degrees Fahrenheit in areas used by children; therefore, Citation 1 is affirmed. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citations 1 is affirmed.
