Dear Rebecca Steffensen:
The Minnesota Department of Children, Youth, and Families (DCYF), Division of Licensing, received your request for reconsideration regarding Citation 5 in the Correction Order issued to you on January 28, 2026. You did not request review for Citations 1, 2, 3, and 4. Citations 1, 2, 3 and 4 are not under the scope of review.
Reconsideration Determination
Citation 5 Violation. The license holder did not provide a physical or electronic copy of the emergency plan to the child's parent upon enrollment. Based on a conversation with an administrative staff person, it was determined that families are not provided a copy of the program's emergency plan upon enrollment.
Applicable Law. The license holder must provide a physical or electronic copy of the emergency plan to the child's parent or legal guardian upon enrollment. Minnesota Statutes, section 142B.66, subdivision 3, paragraph (e).
Your Response. You stated that families may request the emergency plan per the parent handbook. You also stated that per the Child Information Sheet that is required upon enrollment, all families must sign that they have read the parent handbook before they have access to the emergency plan.
Reconsideration Determination. The Licensor noted that you did not provide a physical or electronic copy of the emergency plan to the child's parent upon enrollment. Based on a conversation with an administrative staff person. You must provide a physical or electronic copy of the emergency plan to the child's parent or legal guardian upon enrollment. You do not refute that you are noncompliant with the requirement to prove a physical or electronic copy of the emergency plan to the child's parent or legal guardian upon enrollment. Instead, you reference your Child Information Sheet and program policy to require that parents read the parent handbook before obtaining the emergency plan. Citation 5 is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 5 is affirmed. You did not request review for Citations 1, 2, 3, and 4. Citations 1, 2, 3 and 4 are not under the scope of review. This is a final agency decision.
Previously Ordered Corrective Action. In the original Correction Order issued, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 1, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations and respond in the Provider Hub immediately. The Commissioner appreciates your response and encourages you to continue to work cooperatively with your licensor to ensure the safety and well-being of the children you serve.
