August 21, 2026 Samantha Sorensen, Authorized Agent Fairview Health Services 2450 Riverside Ave Minneapolis, MN 55454-1450 License Number: 803978 (245G) CORRECTION ORDER Dear Samantha: On May 5 through 8, 2026 a Department of Human Services (DHS) licensor conducted a licensing review at your facility, Fairview Recovery Services Minneapolis, located at 2450 Riverside Ave Minneapolis, MN 55454. This review was conducted to determine compliance with state and federal laws and rules governing the provision of substance use disorder treatment under Minnesota Statutes, chapter 245G. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS DHS determined that your program did not follow licensing rules and statutes, as described below. Postings, Policies, Procedures 1. Violation: The license holder did not meet requirements governing program abuse prevention plan (PAPP). There were two conflicting versions of the PAPP. The PAPP that was posted was not the same as the PAPP in the policy manual; and neither met statute requirements. Statute Violated: Minnesota Statute, sections 245A.04, subdivision 14, paragraph (b) and 245A.65, subdivision 2, paragraph (a). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the program abuse prevention plan meets all applicable requirements. Within 45 days of receipt of this order, submit a program abuse prevention plan that meets all applicable requirements. 2. Violation: The license holder did not meet requirements governing the treatment services description. The treatment services description did not include: a. Amount and type of treatment services provided; and b. Identify which services meet the definition of group counseling under Minnesota Statutes, section 245G.01, subdivision 13a. Statute Violated: Minnesota Statute, section and 245G.12, clause (10). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the treatment services description meets all applicable requirements. Within 45 days of receipt of this order, submit a treatment service description that meets all applicable requirements. 3. Violation: The license holder did not meet requirements governing client property management. The license holder’s client funds and property policy did not include that the license holder must return to the person upon the person’s request, the funds and property in the license holders possession, as soon as possible, but no later than three working days after the date of request. Statute Violated: Minnesota Statute, section 245A.04, subdivision 13, paragraph (c), and 245G.21, subdivision 3, clause (4). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the client funds and property policy meets all applicable requirements. Within 45 days of receipt of this order, submit a client funds and property policy that meets all applicable requirements. Personnel Files 4. Violation: Six of ten personnel files reviewed for requirements governing annual training did not meet requirements. There was no documentation of the following annual trainings: a. Mandatory reporting as specified in Minnesota Statutes, sections 245A.65, 626.557, and 626.5572, and chapter 260E for the year 2025 (personnel files numbered 8 and 9); and b. Program Abuse Prevention Plan for the following years: i. 2025 (personnel files numbered 8 and 9); and ii. 2026 (personnel files numbered 8 and 10); c. All internal policies and procedures related to the prevention and reporting of maltreatment of individuals receiving services for the years: i. 2025 (personnel files numbered 3, 8 and 9); and ii. 2026 (personnel files numbered 8 and 10); d. Reporting of Maltreatment of Minors for the calendar years: i. 2025 (personnel file numbered 3); e. HIV minimum standards for the following years: i. 2025 (personnel files numbered 3, 8, and 9); and ii. 2026 (personnel files numbered 8 and 10). Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b), 245A.65, subdivision 3, and 245G.13, subdivision 2, paragraphs (c) and (d). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that annual trainings meet all applicable requirements. 5. Violation: Seven of ten personnel files reviewed for requirements governing personnel file content did not meet requirements. There was no documentation of the following: a. A completed application for employment signed by the staff member (personnel files numbered 7, 9 and 10); and b. A written annual review of the staff members’ job performance for years: i. 2025 (personnel files numbered 1 through 3); and ii. 2026 (personnel files numbered 6 and 8). Statute Violated: Minnesota Statutes, section 245G.13, subdivision 1, clause (3) and subdivision 3, clause (1). Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that personnel file contents meet all applicable requirements. Client Files 6. Violation: Two of three client files reviewed for requirements governing initial services plan did not meet requirements. The initial services plan was not person-centered and client specific (client files numbered 1 and 2). Statute Violated: Minnesota Statutes, section 245G.04, subdivision 1. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that initial services plans meet all applicable requirements. Within 45 days of receipt of this order the license holder will submit two initial services plans from clients participating in the American Society of Addiction Medicine (ASAM) 3.5 or 3.1 level of care that meet all applicable requirements. 7. Violation: Three of three client files reviewed for requirements governing comprehensive assessment did not meet requirements. The comprehensive assessment did not contain the following: a. Diagnosis of a substance use disorder (client file numbered 3); b. Risk rating summary to support the risk rating (client file numbered 3); and c. Recommendation for the ASAM level of care identified in Minnesota Statutes, section 254B.19, subdivision 1 (client files numbered 1 and 2). Statute Violated: Minnesota Statute, section 245G.05, subdivision 3. Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that comprehensive assessments meet all applicable requirements. Within 45 days of receipt of this order the license holder will submit two comprehensive assessments that meet all applicable requirements. 8. Violation: One of three client files reviewed for requirements governing individual treatment plans (ITP) (client file numbered 1) did not meet requirements in the following ways: a. The ITP was not: i. Signed by the client; and ii. Based on the client’s comprehensive assessment; and b. The ITP did not document a treatment strategy. Statute Violated: Minnesota statutes, section 245G.06, subdivisions 1 and subdivision 1a, paragraph (a). Corrective Action Required: Immediately and on an ongoing basis the license holder must ensure that individual treatment plans meet all applicable requirements. 9. Violation: Two of three client files reviewed for client record documentation did not meet requirements. The license holder did not ensure that staff members who provided a treatment service accurately documented the amount and the client's response to each treatment service. Documentation of treatment services was completed and signed by the staff person providing the treatment service; however, the amount of service was unable to be determined as the documentation was signed prior to the end of the session on the following dates: a. January 15, 17, 29, 30, and 31, 2026; (client file numbered 1); and b. April 14 through 17, 26 through 30, and May 1, 2026 (client file numbered 2). Statute Violated: Minnesota statutes, section 245G.06, subdivisions 2a and 2b, paragraph (c). Corrective Action Required: Immediately and on an ongoing basis the license holder must ensure that client record documentation meets all applicable requirements. Within 45 days of receipt of this order, the license holder will submit two progress notes, from clients participating in the ASAM 3.5 or 3.1 level of care, that meet all applicable requirements. Written Response Required If you fail to correct the violation(s) specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
