August 24, 2026 Shamso Abdi, Authorized Agent Empire Resources LLC 1821 University Avenue West Suite 374 Saint Paul, Minnesota 55104 License Number: 1111950 (245D – HCBS) CORRECTION ORDER Dear Shamso Abdi: On August 19, 2026, a licensing review of Empire Resources LLC, located at 1821 University Avenue West, Saint Paul, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245D.05, subdivision 1. Violation: For one of three persons whose record was reviewed (P1), the license holder did not document health service needs as required. The license holder assumed the responsibility of meeting P1’s health needs. The license holder did not maintain documentation on how P1’s health needs would be met including a description of the procedures the license holder would follow in order to provide medication assistance and assist with or coordinate medical, dental, and other health service appointments for P1.
Repeat Violation: In a Correction Order that DHS issued on August 12, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must: · revise P1’s support plan addendum to include a description of the procedures you will follow in order to meet their health needs detailed above; · review the newly revised support plan addendum with P1’s expanded support team and document this review in their support plan addendum; · provide training to all staff who provide direct support to P1 on their revised support plan addendum; and · maintain documentation of this training in each staff person’s personnel record according to Minnesota Statutes, section 245D.095, subdivision 5. On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.06, subdivision 1 and section 245D.11 subdivision 2. Violation: For one person whose record was reviewed (P3), the license holder did not meet the protection standards of incident response and reporting as required. The license holder maintained a policy titled, “Policy and Procedure on Reviewing Incidents and Emergencies.” The license holder did not enforce this policy when they did not document the following information in an incident report involving P3 on November 5, 2025: · whether a person’s support plan addendum or program policies and procedures were implemented as applicable; and · the name of the staff person or persons who responded to the incident. Corrective Action Ordered: Within 30 days of receiving this order, you must review and revise P3’s incident report to include the information detailed above. On an ongoing basis, you must maintain compliance as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.07, subdivision 2. Violation: For one person whose record was reviewed (P1), the license holder did not complete service planning for basic support services as required. The license holder provided multiple services to P1. The license holder did not review and revise P1’s support plan addendum to document P1’s 24-hour emergency assistance service that would be provided including how, when, and by whom services would be provided. Repeat Violation: In a Correction Order that DHS issued on August 12, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must review and revise P1’s support plan addendum to include the information detailed above for P1’s 24-hour emergency assistance service and maintain documentation of the review and revision in P1’s service recipient record. On an ongoing basis, you must maintain compliance as required in this subdivision. 4. Citation: Minnesota Rules, part 9544.0030, subpart 1. Violation: For one person whose record was reviewed (P1), the license holder did not evaluate positive support strategies as required. The license holder did not evaluate the identified positive support strategies with P1 at least every six months. The license holder completed this evaluation in June 2025 and June 2026. Repeat Violation: In a Correction Order that DHS issued on August 12, 2025, you were previously found in violation of this same rule. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subpart. 5. Citation: Minnesota Statutes, section 245D.10, subdivision 2. Violation: The license holder did not establish policies and procedures related to grievances as required. The license holder did not establish a policy and procedure that provided a simple complaint process for persons served by the program and their authorized representatives to bring a grievance that allowed the person to bring the complaint to the highest level of authority in the program if the grievance cannot be resolved by other staff members, and that provided the correct name, address, and telephone number of that person. Corrective Action Ordered: Within 30 days of receiving this order, you must: · revise your program’s grievance policy and procedure to include the program’s accurate highest level of authority including the information detailed above; · provide written notice to all persons or their legal representatives and case managers to explain that a revision was made and include a copy of the revised policy and procedure; and · inform all employees of the revisions and provide training on implementation of the revised grievance policy and procedure. On an ongoing basis, you must maintain compliance as required in this subdivision. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
