Dear Mandra Schroeder:

On May 8, 2026, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citations 2 and 4 in the Correction Order issued to you on April 21, 2026. You did not request reconsideration of any other citations; therefore, they are not under review.

Reconsideration Determination

Citation 2:

A personnel record was not maintained at the program for each staff person (SP1, SP2, SP3 and SP4).

Your Request for Reconsideration. You stated that all staff have files on site. The training binder was off-site at the time of the Licensor’s site visit. However, original copies were in each employee's personnel file.

You also stated, “Hard copies of all staff Inservice documents are in their personnel file stored on site in the file cabinet. The copies are also located in the ‘staff in-service’ binder that was originally off site when licensing showed up.”

Applicable Law. The license holder must maintain personnel records at the center, and the records must be available for inspection at the request of the commissioner. Minnesota Rules, part 9503.0115, item B.

The license holder must ensure that a personnel record for each staff person is maintained at the center. The personnel record for each staff person must contain:

A. the staff person's name, home address, home telephone number, and date of birth;

B. the staff person's documentation indicating that the staff person meets the requirements of the staff person's job position and the education and experience requirements specified in parts 9503.0031 to 9503.0034;

C. documentation that the staff person has completed the orientation to the center required in part 9503.0035, subpart 1;

D. documentation, when applicable, that the staff person has completed the first aid and CPR training required in part 9503.0035, subparts 2 and 3; and

E.  documentation of completion of the in-service training required by part 9503.0035, subpart 4, showing the training topic, source of training, number of hours completed, and method used to document mastery of the subject. Minnesota Rules, part 9503.0120.

Reconsideration Determination. On the day of the site visit, the Licensor noted that personnel staff files were not available on-site for review. The license holder must maintain personnel records at the center, and the records must be available for inspection at the request of the commissioner Later, an administrative staff person transported staff files to the site visit towards the end of the licensing inspection.

You admit that the training binder with staff personnel files was off-site at the time of the Licensor’s site visit. Citation 2 is affirmed because you did not maintain personnel records at the center, and the records were not immediately available for inspection at the request of the commissioner.

Citation 4:

The license holder did not provide a physical or electronic copy of the emergency plan to the child's parent upon enrollment.

Your Request for Reconsideration. You stated that the emergency plan is located in the parent handbook.

You also stated, “Physical copies of Apple Academy’s emergency plan is located in the parent handbook under “Information for parents” letter I paragraph 2. This is given to the parents upon enrollment as well if/when any changes have been made.”

Applicable Law. The license holder must provide a physical or electronic copy of the emergency plan to the child's parent or legal guardian upon enrollment. Minnesota Statutes, section 142B.66, subdivision 3, paragraph (e).

Reconsideration Determination. The Licensor noted that you did not provide a physical or electronic copy of the emergency plan to the child's parent upon enrollment. Based on a conversations with a staff persons and an administrative staff person. You must provide a physical or electronic copy of the emergency plan to the child's parent or legal guardian upon enrollment. You do not refute that you are noncompliant with the requirement to prove a physical or electronic copy of the emergency plan to the child's parent or legal guardian upon enrollment. Instead, you stated that the emergency plan is in your parent handbook. Citation 4 is affirmed.

Disposition

The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citations 2 and 4 are affirmed. This is a final agency decision.

Previously Ordered Corrective Action. In the original Correction Order, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
