You did not request review for Citations 1, 2, 3, 4, and 6. Citations 1, 2, 3, 4, and 6 are not under the scope of review. Reconsideration Determination Citation 5 Violation. A child was fed the wrong bottle. Through review of program documentation and interviews with staff persons it was determined that the licensor holder failed to follow written dietary instructions from an infant's parent and failed to ensure that appropriate procedures and practices were used to handle breast milk. On February 4, 2026, an infant was given breast milk from another child's bottle. (Infant: Infant classroom) Applicable Law. Infant diets. The diet of an infant must be determined by the infant's parent. The license holder must ensure that sanitary procedures and practices are used to prepare, handle, and store formula, milk, breast milk, solid foods, and supplements. Procedures must be reviewed and certified by a health consultant. A center serving infants must: A. obtain written dietary instructions from the parent of the child; B. have the infant's feeding schedule available in the food preparation area; C. offer the child formula or milk and nutritionally adequate solid foods in prescribed quantities at specified time intervals; and D. label each child's bottle. Minnesota Rules, part 9503.0145, subpart 7. Your Response. You stated that, “this incident was addressed immediately with both the child’s parents and the infant room staff involved…the center reviewed the circumstances surrounding the error and reinforced policy and procedures.” Reconsideration Determination. The Licensor discovered through review of program documentation and interviews with staff persons that on February 4, 2026, an infant was given breast milk from another child's bottle. The Licensor determined that a staff person (SP) failed to follow written dietary instructions from an infant's parent and failed to ensure that appropriate procedures and practices were used to handle breast milk. You admit that on February 4, 2026, an infant was given breast milk from another child's bottle when a SP failed to follow written dietary instructions from an infant's parent and failed to ensure that appropriate procedures and practices were used to handle breast milk. You did not provide any additional information to refute the violation. Citation 5 is affirmed. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 5 is affirmed. You did not request review for Citations 1, 2, 3, 4, and 6. Citations 1, 2, 3, 4, and 6 are not under the scope of review. This is a final agency decision. Previously Ordered Corrective Action. In the original Correction Order issued, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 1, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations and respond in the Provider Hub immediately.
