You did not request review for Citations 2, 3, and 4. Citations 2, 3, and 4 are not under the scope of review. Reconsideration Determination Citation 1. Food allergy information was not readily available to staff where food is served. Applicable Law. Before admitting a child for care, the license holder must obtain documentation of any known allergy from the child's parent or legal guardian or the child's source of medical care. If a child has a known allergy, the license holder must maintain current information about the allergy in the child's record and develop an individual child care program plan as specified in Minnesota Rules, part 9503.0065, subpart 3. The individual child care program plan must include but not be limited to a description of the allergy, specific triggers, avoidance techniques, symptoms of an allergic reaction, and procedures for responding to an allergic reaction, including medication, dosages, and a doctor's contact information. Minnesota Statutes, section 142B.66, subdivision 1, paragraph (d). A child's allergy information must be available at all times including on site, when on field trips, or during transportation. A child's food allergy information must be readily available to a staff person in the area where food is prepared and served to the child. Minnesota Statutes, section 142B.66, subdivision 1, paragraph (d). Your Response. You stated, “Allergy information was posted onsite in cafeteria, kitchen and classroom. We were given this citation because the ICCPP documents were in children’s files, folders in both kitchen and classrooms instead of cafeteria. I do not agree with this citation because allergy information is readily available at all times.” Reconsideration Determination. The Licensor noted that food allergy information was not readily available to staff where food is served. The Licensor noted that there was a printed chart in the cafeteria where the food is served, titled “Food Allergy-Diet Restrictions-Diet Modification.” The chart included some food allergy information. However, the chart did not include all the required information in each child’s individual child care program plan (ICCPP). The printed chart was missing specific triggers, avoidance techniques, symptoms of an allergic reaction and procedures for responding to an allergic reaction, including medication, dosages, and a doctor's contact information. The children’s allergy food information must contain allergy, specific triggers, avoidance techniques, symptoms of an allergic reaction, and procedures for responding to an allergic reaction, including medication, dosages, and a doctor's contact information and must be readily available to a staff person in the area where food is prepared and served to the child. You acknowledge that the children’s ICCPP was not readily available where the food is served in the cafeteria. Citation 1 is affirmed. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 is affirmed. You did not request review for Citations 2, 3, and 4. Citations 2, 3, and 4 are not under the scope of review. This is a final agency decision. Previously Ordered Corrective Action. In the original Correction Order issued, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 1, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations and respond in the Provider Hub immediately.
