September 11, 2026 Arnold Kubei, Authorized Agent Home Sweet Home Minnesota 2056 Woodlane Drive License Number: 1112301 (245D - HCBS) CORRECTION ORDER RECONSIDERATION DECISION Dear Arnold Kubei: The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citation 3 in the Correction Order issued to Home Sweet Home Minnesota on March 17, 2026. After an independent review of the record, the Commissioner has affirmed citation 3. Reconsideration Determination Citation 3 For three persons whose records were reviewed (P1-P3), the license holder did not comply with the provision of service required. The license holder was assigned the responsibility to provide Integrated Community Support (“ICS”) services to P1, P2, and P3. · The license holder maintained information in P1's record that indicated P1 would receive 5.5 hours of in person support daily and 1.5 hours of remote support daily. P1's daily log notes indicated that the license holder did not provide the hours of support that P1 required between March 2025 and November 2025. · The license holder maintained information in P2's record that indicated P2 would receive 2.5 hours of in person support daily and at .5 hours of remote support daily. P2's daily log notes indicated that the license holder did not provide the hours of support that P2 required between April 2025 and November 2025. · The license holder maintained information in P3's record that P3 would receive 5.5 hours of in person support daily and 1.5 hours of remote support daily. The license holder did not provide the hours of support that P3 required between October 2025 and November 2025. Applicable Law The license holder must provide services as assigned in the support plan. The provision of services must comply with the requirements of this chapter and the federal waiver plans. Minnesota Statutes, section 245D.07, subdivision 1. Your Response In your reconsideration request you do not state you provided the hours assigned in their plans. You state the law, CSBM, and DHS published guidance does not require you to provide a daily minimum of in-person care. You argue DHS policy requires a measurement of average hours over a consecutive period of up to 52 weeks. Reconsideration Determination You did not provide the services assigned in the persons support plan as required by Minnesota Statutes, section 245D.07, subdivision 1. Your Daily Progress Notes for P1, P2, and P3 do not show you provided the services assigned in their support plans. The progress notes show that on most days you provided check-ins by text message or phone, and on a small percentage of the days, there were in-person conversations in the staff office. For example, P1’s plan required an average of 5.5 hours of in-person support a day, and from April 2025 to December 2026, there were only 29 instances of in-person support, which appear to be a brief conversation in the staff office. The in-person support was not anywhere near the average of 5.5 hours, required by P1’s plan. The guidance you provided in your reconsideration request instructs lead agencies and providers on how to calculate the average number of hours needed per day to establish the support plan. The guidance did not instruct providers on how to deliver the hours assigned in the support plan. Once the hours are in the support plan, Minnesota Statutes, section 245D.07, subdivision 1, requires license holders to provide the “assigned services”. The assigned services in-person hours in P1’s plan were 5.5 hours, P2’s was 2.5 hours, and P3’s was 5.5 hours of individual “staff hours per day”. The plan states, average “per day,” meaning you should provide those hours for the approximate duration in the plan each day. You provided very little in-person support for each person and when you did, it was nowhere near the number of hours assigned in the plan. Disposition The Commissioner has reviewed the relevant laws and all of the information you submitted in response to the Correction Order. Citation 3 is affirmed. This is a final agency decision.
