Dear Michelle O’Toole:
On August 12 – 14, 2026, a licensing review of Diversified Lifestyles, located at 1111 6th Street Southeast, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.
A. Reason for Correction Order
Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.
The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.
1. Citation: Minnesota Statutes, section 245A.65, subdivision 2, paragraph (a).
Violation: For one of ten persons whose record was reviewed (P10), the license holder did not provide an orientation to the program abuse prevention plan (PAPP) as required.
The license holder did not provide P10 with an orientation to the PAPP within 24 hours of admission when P10 moved into a community residential setting (CRS) on January 23, 2026.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide P10 with an orientation to the PAPP for their licensed residential setting and maintain documentation of this orientation in their service recipient record. Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Statutes, section 245A.65, subdivision 2, paragraph (b).
Violation: For two persons whose records were reviewed (P3 and P10), the license holder did not develop and review the individual abuse prevention plan (IAPP) as required.
a. The license holder did not review P3’s IAPP with P3’s interdisciplinary team in 2025.
b. The license holder did not develop an IAPP for P10 as part of the initial individual program plan or service plan prior to or upon service initiation on January 23, 2026.
Repeat Violation: In an Order for Conditional License that DHS issued on April 24, 2026, the license holder was ordered to review P3’s IAPP with P3’s interdisciplinary team. The license holder did not comply with the corrective action ordered by DHS.
Corrective Action Ordered: Within 30 days of receipt of this order, you must:
· review P3’s IAPP with P3’s interdisciplinary team;
· develop an IAPP for P10 and review with P10 interdisciplinary team; and
· train all staff working with P10 on P10’s IAPP and document this training according to the requirements in Minnesota Statutes, section 245D.095, subdivision 5.
Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.04, subdivision 3.
Violation: For one person whose record was reviewed (P2), the license holder did not ensure the exercise and protection of the person’s rights as required.
The license holder provided services to P2 in a community residential setting (1069587_CRS). The license holder did not ensure the exercise and protection of P2’s right to have privacy in P2’s bedroom for visits with P2’s significant other. The license holder maintained documentation in P2’s record that indicated P2 was not allowed to close their bedroom door when P2’s significant other visited. Additionally, the license holder documented that P2 was not allowed to sit on P2’s bed with P2’s significant other.
Corrective Action Ordered: Immediately upon receiving this order, you must ensure the exercise and protection of P2’s right to have privacy in P2’s bedroom. Within 30 days of receiving this order, you must:
· discuss with P2’s support team whether a rights restriction is necessary to ensure P2’s health, safety and well-being;
· if it is determined that a rights restriction is necessary to ensure P2’s health, safety, and well-being, you must implement and document the restriction in the person’s support plan addendum according to the requirements in section 245D.04, subdivision 3, paragraph (c).
Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
4. Citation: Minnesota Statutes, section 245D.05, subdivision 2, paragraph (c), clause (5).
Violation: For two persons whose records were reviewed (P2 and P9), the license holder did not implement medication administration procedures as required.
a. The license holder was assigned the responsibility of medication administration for P9. The license holder did not document a notation of when a treatment was administered or a notation of a treatment not being administered, whether by error by the staff or the person, or by refusal by the person on June 19, 2026.
b. The license holder was assigned the responsibility of medication administration for P2. The license holder did not document in P2’s medication administration record (MAR) a notation of when a medication was administered on the following dates:
· August 5, 2026;
· August 7, 2026; and
· August 10, 2026.
Repeat Violation: In an Order of Conditional license dated April 26, 2026, you were previously found in violation of the same statute.
Corrective Action Ordered: Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
5. Citation: Minnesota Statutes, section 245D.05, subdivision 4.
Violation: For two persons whose records were reviewed (P9 and P10), the license holder did not review and report medication and treatment issues as required.
a. The license holder did not report P9’s treatment refusal or P9’s failure to take a treatment as prescribed to P9’s case manager and P9’s legal representative as it occurred. The license holder did not notify P9’s case manager and P9’s legal representative on June 19, 2026, of the occurrence of P9 not taking their treatment as prescribed.
b. The license holder did not report P10’s medication refusal on April 7, 2026, to P10’s legal representative and P10’s case manager when the license holder administered P10’s medication and the medication was discovered in the toilet the same day. Additionally, the license holder reviewed P10’s April 2026 medication administration record and did not accurately identify the above medication refusal error.
Repeat Violation: In an Order of Conditional license dated April 26, 2026, you were previously found in violation of the same statute.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· report any medication or treatment errors, including refusals or missed doses, found in P9’s and P10’s medication administration record (MAR) to P9’s legal representative, P10’s legal representative, P9’s case manager, and P10’s case manager; and · maintain documentation of the notifications regarding the medication errors in P9’s and P10’s service recipient record. Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
6. Citation: Minnesota Statutes, section 245D.051, subdivision 1, paragraph (a) and (b).
Violation: For four persons whose records were reviewed (P2, P3, P6, and P10), the license holder did not maintain documentation for psychotropic medications as required.
“Target symptom" refers to any perceptible diagnostic criteria for a person's diagnosed mental disorder, as defined by the Diagnostic and Statistical Manual of Mental Disorders Fourth Edition Text Revision (DSM-IV-TR) or successive editions, that has been identified for alleviation. a. The license holder was responsible for administering P2’s medications. The license holder assigned themselves responsibility to collect monitoring data for P2’s target symptoms and share the data with P2’s expanded support team every six months. The license holder did not collect data for P2’s target symptoms.
b. The license holder was responsible for administering P3’s medications. The license holder did not document the description of the target symptoms that each of P3’s psychotropic medications were prescribed to alleviate. In addition, the license holder assigned themselves responsibility to collect monitoring data for the target symptoms and share the data with P3’s expanded support team every six months. The license holder did not collect data for P3’s target symptoms.
c. The license holder was responsible for administering P6’s medications. The license holder did not maintain documentation that included a description of the target symptoms that each psychotropic medication was to alleviate .
d. The license holder was responsible for administering P10’s medications. The license holder did not maintain documentation that included a description of the target symptoms that each psychotropic medication was to alleviate. In addition, the license holder assigned themselves responsibility to collect monitoring data for the target symptoms and share the data with P10’s expanded support team every six months. The license holder did not collect data for P10’s target symptoms.
Repeat Violation: In an Order of Conditional License dated April 24, 2026, that DHS issued, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receipt of this order, you must maintain target symptoms for each psychotropic medication prescribed to P2, P3, P6, and P10. You must begin collecting the data for P2’s, P3’s, and P10’s target symptoms. Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision. 7. Citation: Minnesota Statutes, section 245D.071, subdivision 3.
Violation: For one person whose record was reviewed (P10), the license holder did not complete assessments for intensive services as required.
The license holder did not hold an initial planning meeting with P10, P10’s legal representative, and P10’s case manager within 45 days of initiating an intensive service to determine a discussion of how technology might be used to meet P10's desired outcomes in this meeting.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· meet with P10, P10’s legal representative, P10’s case manager, other members of P10’s support team or expanded support team, and other people as identified by P10 or P10’s legal representative to determine how technology might be used to meet P10's desired outcomes in this meeting;
· maintain a summary of the discussion regarding the use of technology that includes a statement regarding any decision that is made regarding the use of technology and a description of any further research that needs to be completed before a decision regarding the use of technology can be made in P10’s support plan addendum; and
· maintain documentation of the meeting and the determinations made at this meeting in P10’s support plan addendum.
Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision. 8. Citation: Minnesota Statutes, section 245D.071, subdivision 4.
Violation: For two persons whose records were reviewed (P6 and P10) the license holder did not document the supports and outcomes as required.
a. The license holder did not document the following supports and methods to be implemented to support P6 and accomplish outcomes:
· any changes or modifications to the physical and social environments necessary when the services supports were provided;
· any equipment or materials provided;
· the projected starting date for implementing the supports and methods;
· the date by which progress towards accomplishing the outcome would be reviewed and evaluated;
· the names of the staff person or position responsible for implementing the supports and methods.
b. The license holder did not document the following supports and methods to be implemented to support P10 and accomplish outcomes:
· any changes or modifications to the physical and social environments necessary when the service support was provided;
· any equipment or materials required;
· techniques that were consistent whit the person’s communication mode and learning style;
· the measurable and observable criteria for identifying when the desired outcome had been achieved and how data would be collected;
· the projected starting date for implementing the supports and methods and the date by which progress towards accomplishing the outcome would be reviewed and evaluated; and
· the names of the staff person or position responsible for implementing the supports and methods.
Repeat Violation: In an Order of Conditional License dated April 24, 2026, that DHS issued, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receipt of this order, you must:
· develop a service plan for P6 that documents the information detailed above;
· develop a service plan for P10 that documents the information detailed above;
· submit to P6’s and P10’s support teams for approval, and maintain documentation this information was submitted to their respective support teams;
· train P6’s and P10’s respective staff on the supports and methods for P6’s and P10’s outcomes and document this training according to the requirement in Minnesota Statutes, section 245D.095, subdivision 5; and
· implement the supports and methods for P10’s desired outcomes and begin collecting data related to their outcome.
Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
9. Citation: Minnesota Statutes, section 245D.071, subdivision 5, paragraph (b).
Violation: For three persons whose records were reviewed (P1, P2, and P8), the license holder did not review and evaluate the service plan as required.
a. The license holder did not have a discussion about how technology might be used to meet P1’s desired outcomes with P1’s support team. The license holder held a progress review meeting on June 4, 2026. The license holder did not have this discussion at the meeting.
b. The license holder held a progress review meeting with P8, P8’s case manager, and P8’s legal representative on April 10, 2026. At the time of this meeting, the license holder held a discussion on technology. The discussion summary stated P8 uses their TV and remote to watch the shows they are interested in, especially their stories. The license holder did not discuss with P8 and members of P8’s support team about how technology might be used to meet P8’s desired outcomes.
c. The license holder did not discuss with P2 and their expanded support team how technology might be used to meet P2’s desired outcomes at least once per year.
Repeat Violation: In an Order for Conditional License that DHS issued on April 24, 2026, the license holder was ordered to have a discussion about how technology would be used to meet P1’s desired outcomes with P1’s support team and maintain a summary of that discussion in P1’s support plan addendum. The license holder did not comply with the corrective action ordered by DHS.
Corrective Action Ordered: Within 30 days of receiving this order, you must discuss with P1, P2, and P8 and their respective expanded support teams about how technology might be used to meet their desired outcomes. You must maintain a summary of this discussion in P1’s, P2’s, and P8’s support plan addendum, including a statement in the summary regarding any decision made related to the use of technology including a description of any further research that must be completed before a decision can be made. Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision. 10. Citation: Minnesota Rules 9544.0100, subpart 1.
Violation: For two persons whose records were reviewed (P5 and P6), the license holder did not document outcomes as required.
The license holder did not document P5’s and P6’s progress or lack of progress towards each outcome or goal for P5 and P6.
Repeat Violation: In an Order for Conditional License that DHS issued on April 24, 2026, the license holder was ordered to begin documenting P5’s and P6’s progress towards achieving their respective outcomes. The license holder did not comply with the corrective action ordered.
Corrective Action Ordered: Within 30 days of receipt of this order, you must begin documenting P5’s and P6’s progress or lack of progress towards their respective outcomes. Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
11. Citation: Minnesota Statutes, section 245D.09, subdivision 4.
Violation: For one of six staff person whose record was reviewed (SP2), the license holder did not provide and ensure completion of orientation training as required.
The license holder did not ensure SP2 received orientation training on staff responsibilities related to prohibited procedures within 60 calendar days of hire. The license holder’s training on prohibited procedure did not include why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· ensure SP2 has been orientated and trained on the above-mentioned topics, and annually thereafter; and
· maintain documentation in SP2’s personnel record of the above-mentioned training according to the requirements in Minnesota Statutes, section 245D.095, subdivision 5.
Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
12. Citation: Minnesota Statutes, section 245D.09, subdivision 4a.
Violation: For two staff persons whose records were reviewed (SP4 and SP5), the license holder did not provide training to individual needs as required.
a. SP4 provided direct care to P1. The license holder did not provide training to SP4 on P1’s health needs.
b. SP5 provided direct care to P3. The license holder did not provide SP5 with training on P3’s IAPP.
Repeat Violation: In an Order for Conditional License that DHS issued on April 24, 2026, the license holder was ordered to train all staff working with P1 to be trained on P1’s health needs, and the license holder ordered to train all staff working P3 on P3’s IAPP. The license holder did not comply with the corrective action ordered by DHS. Corrective Action Ordered: Within 30 days of receipt of this order, you must provide SP4 and SP5 with the trainings listed in (a) and (b). Compliance with this order will be reviewed onsite. On an ongoing basis, you must maintain compliance as required in this subdivision. 13. Citation: Minnesota Statutes, section 245D.09, subdivision 5.
Violation: For two staff persons whose records were reviewed (SP1 and SP3), the license holder did not provide and ensure completion of annual training as required.
Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.
The license holder did not provide annual training to SP1 and SP3 in 2026 on staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5. The license holder’s training on prohibited procedure did not include why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· ensure SP1 and SP3 have been trained on the above-mentioned topics; and
· maintain documentation in SP1’s and SP3’s personnel records of the above-mentioned training according to the requirements in Minnesota Statutes, section 245D.095, subdivision 5.
Compliance with this order will be monitored onsite at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.
If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
B. Right to Request Reconsideration
If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
