CORRECTION ORDER

Dear Arnold Kubei:

On July 1, 2026, a licensing investigation of Metro Care Human Services, located at 2056 Woodlane Drive, Suite 2B, Woodbury, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes, section 245D.05, subdivision 2.

Violation: For one of four persons whose records were reviewed (P1), the license holder did not complete medication administration as required.

The license holder was assigned responsibility for P1’s medication administration in P1’s support plan addendum. The license holder maintained log notes for P1 that indicated that staff would provide P1 with their medication for P1 to consume at a later time, not in the presence of staff which resulted in staff not knowing whether P1 consumed his medications. Additionally, the license holder documented that P1 declined a medication for consistently from August 2025 through November 2025. The license holder did not ensure that P1 took medications and treatments as prescribed.

Corrective Action Ordered: P1 is no longer receiving services; therefore, no corrective action is needed for P1. On an ongoing basis, you must maintain compliance as required in this subdivision.

2. Citation: Minnesota Statutes, section 245D.05, subdivision 4.

Violation: For one person whose record was reviewed (P1), the license holder did not review medication and treatment issues and report as required.

The license holder was assigned responsibility for P1’s medication administration. The license holder did not complete accurate MAR reviews. Two MAR reviews were completed for the month of August 2025 on September 30, 2025, and October 21, 2025. The license holder documented on both MAR reviews that there were no medication errors found however; DHS licensors identified multiple medication errors on P1’s MAR for August 2025.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

3. Citation: Minnesota Statutes, section 245D.06, subdivision 1, paragraph (g).

Violation: For one person whose record was reviewed (P3), the license holder did not complete incident response and reporting as required.

P3 was involved in an incident that resulted in a serious injury discovered on December 18, 2025. The license holder did not conduct an internal review of the incident of serious injury that included the following information:

· whether the related policies and procedures were followed;

· whether the policies and procedures were adequate;

· whether there is a need for additional staff training; and

· whether the reported event is similar to past events with the persons or the services involved.

Corrective Action Ordered: P3 is no longer receiving services; therefore, no corrective action is needed for P3. On an ongoing basis, you must maintain compliance as required in this subdivision.

4. Citation: Minnesota Statutes, section 245D.07, subdivision 1.

Violation: For one person whose record was reviewed (P1), the licensor holder did not comply with the provision of services as required.

The license holder was assigned responsibility to provide Integrated Community Support (ICS) services to P1. The license holder maintained information in P1’s record that indicated that P1 would receive 5.5 hours of in-person support daily and 1.5 hours of remote support daily. P1’s daily log notes indicated that the license holder did not provide the hours of support that P1 required between August 2025 and November 2025.

Corrective Action Ordered: P1 is no longer receiving services; therefore, no corrective action is needed for P1. On an ongoing basis, you must maintain compliance as required in this subdivision.

Repeat Violation: In a Correction Order that DHS issued on March 13, 2026, you were previously found in violation of this same statute.

If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
