When and how to make a provider report

Report the emergency use of manual restraint and other restrictive interventions and incidents

All providers licensed under 245D are required to report to the Minnesota Department of Human Services (DHS) the following:

  • • Emergency use of manual restraint (EUMR)
  • • A medical emergency occurring as a result of the use of a restrictive intervention with a person that leads to a call to 911 or seeking physician treatment or hospitalization for a person
  • • A behavioral incident that results in a call to 911
  • • A mental health crisis occurring as a result of the use of a restrictive intervention that leads to a call to 911 or a provider of mental health crisis services as defined in Minnesota Statutes, section 245.462, subdivision 14c
  • • An incident that requires a call to mental health mobile crisis interviention services
  • • A person’s use of crisis respite services due to use of a restrictive intervention
  • • Use of a pro re nata (PRN) medication to intervene in a behavioral situation. This does not include the use of psychotropic medication prescribed to treat a medical symptom or a symptom of a mental illness or to treat a child with severe emotional disturbance
  • • An incident that the person’s positive support transition plan requires the program to report
  • • Use of a restrictive intervention as part of a positive support transition plan as required in the plan
  • Reports must be made through DHS’ online behavioral intervention reporting form (BIRF) DHS-5148. Information on the reporting requirements is available online at Reporting Behavior Intervention Incidents.

    Report a death or serious injury

    Providers must report deaths and serious injuries of persons served by their program to the DHS Licensing Division and the Office of Ombudsman for Mental Health and Developmental Disabilities. Reports must be made within 24 hours of the death or serious injury, or when you first learned that the death or serious injury occured. Providers may use report of death or serious injury forms available online from the Ombudsman’s Office. Deaths and serious injuries occurring in ICFs/DD must be submitted to the Office of Health Facilities Complaints instead of DHS Licensing. The same report forms may be used.

    Report alleged or suspected maltreatment

    Mandated reporters are required by law to report alleged and suspected maltreatment.

    For vulnerable adults, reports of suspected maltreatment in licensed facilities are accepted by the Minnesota Adult Abuse Reporting Center (MAARC). To report maltreatment of a vulnerable adult, call the Minnesota Adult Abuse Reporting Center at 844-880-1574 (toll-free) or complete the MAARC Online Mandated Reporter Form.

    For children, reports of suspected or alleged maltreatment in DHS licensed facilities should be made to the DHS Licensing Division’s Maltreatment Intake Unit by calling 651-431-6600.

    Report alleged or suspected 245D licensing violations

    Reports of alleged or suspected 245D licensing violations may be reported to the DHS Licensing Division by calling 651-431-6500.
