ICF/DD Surcharge

Legal Authority

Minn. Stat. §256B.501. subd. 1 and Minn. Stat. §256.9657 subd. 4 (d)

Applicability

A non-state-operated Intermediate Care Facility for Persons with Developmental Disabilities is responsible to pay the State of Minnesota an annual surcharge of $1,040.00 for each licensed bed.

Change in licensed capacity

If the number of licensed beds in an ICF/DD reduces, there is no partial month credit. For example, if an ICF/DD downsizes on May 2, the surcharge on the bed is payable for the month of May.

DHS bases the surcharge on the number of remaining licensed beds the month following the receipt of timely notice by the commissioner of human services that beds have been delicensed. If ICFs/DD notify DHS by the 15th of the month, DHS reduces the invoice for the following month to recognize the delicensing of beds.

Billing

The State of Minnesota bills an eligible ICF/DD the first day of each month. Payment is due at the State on the 15th of the following month.
