ABLE Accounts
ABLE accounts permit people with disabilities to save money and withdraw funds to pay for disability-related expenses, in support of their efforts to maintain health, independence and quality of life.
When a designated beneficiary of an ABLE account who also received Medical Assistance (MA) dies, remaining ABLE account funds are first used to pay for any outstanding qualified disability expenses the beneficiary had. If the ABLE account still has funds after paying for these disability expenses, DHS recovers up to the total MA paid for the designated beneficiary after the establishment of the account (minus premiums paid from the account or paid by or on behalf of the beneficiary to a Medicaid Buy-In program).
See United States Code, title 26, section 529A, paragraph (f). See also Minnesota Statutes, section 256Q.08, subdivision 2.
