Annuities

An MA member who requests long-term-care services must designate DHS as a preferred remainder beneficiary of any annuity that the member (or the member’s spouse) has an interest in. See Minnesota Statutes, section 256B.056, subdivision 11. See also Annuity Designation for MA-LTC Applicants (DHS-5036).

When payments become due under such an annuity, the annuity issuer must ask DHS to provide a written statement of the total amount MA paid for the institutionalized person, or confirmation that any family member designated as a remainder beneficiary meets requirements for qualification as a beneficiary in the first position. See Minnesota Statutes, section 256B.0594. See also Minnesota Statutes, section 256B.056, subdivision 11, paragraph (d).
