Renunciation of Priority for Appointment and Right to Nominate Personal Representative (DHS-8348D)
Follow the instructions for (DHS-8348D) (PDF) to show the court you have obtained permission from higher priority parties to be the personal representative of an estate.
This form is to be signed by family members, heirs, or other parties with higher priority to be personal representative of the decedent’s (deceased person’s) estate. This form is not necessary to file a probate action, but without it, those with higher priority could demand to be personal representative later.
1. Fill in the header.· Select your county name from the top left dropdown.· Enter decedent’s name on the left.· Enter the court district number in the top right. If you are unsure of your district, look up the court district. · Since you are opening a new court file, you do not need to enter a file number.2. Fill in the body.· Enter the name of the person signing the form (the devisee or heir).· Enter the address of the person signing the form at number 1.· Enter the reason they have higher priority to be appointed personal representative at number 2. See Minnesota Statutes, 524.3-203 for information on priority.3. Have the person signing the form date and sign the document.
