Terms of Settlement Agreement:
1. Dakota County agrees to rescind its determination that License Holder was responsible for maltreatment of a minor by neglect.
2. License Holder’s family child care license will be placed on conditional status for a period of two years from the effective date of the Settlement Agreement, or from the date when License Holder reopens her program after meeting the minimum standards required for licensure, including background studies, whichever is later. While under the conditional license, the License Holder must comply with the following terms:
a. License Holder must follow and comply with all applicable Minnesota Statutes and Rules, including Minnesota Rules, parts 9502.0300 through 9502.0445.
b. Due to the License Holder’s family child care license being placed on a conditional status, her program’s maximum authorized capacity will be limited to twelve (12) children (class C2 license). No variances to age distribution or capacity will be granted during the conditional period.
c. License Holder must complete ten (10) hours of “Practicing Safe and Healthy Child Care” training from the Center for Inclusive Child Care within sixty (60) calendar days of the commencement of the conditional license. This training is in addition to the annual training requirements as listed in Minnesota Statutes, section 142B.70. License Holder must submit documentation of completion to Dakota County.
d. License Holder will not employ or use anyone as a caregiver, substitute caregiver, or volunteer, who requires a variance granted by DCYF or the licensing county to be able to provide direct contact services, or have access, to the children receiving services from the family child care program.
3. License Holder must post in the family child care program in a conspicuous place a detailed staffing schedule with hours as well as roles and responsibilities during the conditional license period. This schedule must also be provided to her Dakota County child care licensing worker within thirty (30) calendar days of the commencement of the conditional license, and resubmitted within seven (7) calendar days of any changes made.
4. License Holder must post the Settlement Agreement in her family child care program in a conspicuous place and provide a copy of this Agreement to parents or guardians of all children in care under License No. 1041760. License Holder must obtain signatures from parents or guardians of each child attending her family child care programs indicating they have received a copy of the Settlement Agreement. Documentation that the parents received a copy of this Agreement must be provided to Dakota County Social Services within thirty (30) calendar days of the effective date of the Agreement. For new families enrolling a child in the License Holder’s family child care program, License Holder must submit documentation signed by the parent or guardian to Dakota County within five (5) calendar days of the child beginning to receive family child care services from her family child care program that verifies that the parent received a copy of the Agreement.
