This immediate suspension is based on a determination that a controlling individual is criminally charged with an offense that involves fraud or theft against a program administered by a state or federal agency. Details of our findings are provided below. Our next steps and your options are also detailed. The immediate suspension goes into effect on October 10, 2025, at 12:01am. After this time, you are prohibited from providing Home and Community-Based Services (HCBS) under license number 1091688. REASON FOR TEMPORARY IMMEDIATE SUSPENSION Controlling individual criminally charged with fraud or theft SP1 was identified as a controlling individual on this license. On September 18, 2025, SP1 was criminally charged with Wire Fraud in United States District Court District of Minnesota through Court File Number 25-CR-00353 (PAM). The criminal complaint alleges that SP1 defrauded federally funded healthcare benefits that were administered by DHS, which is an offense that involves fraud or theft against a program administered by a state agency. Legal Authority: Minnesota Statutes, section 245A.07, subdivision 2(a)(3). YOUR RIGHT TO APPEAL You have the right to appeal the temporary immediate suspension. Your request must be in writing and clearly state that you are requesting a contested case hearing for this matter. Your request must be made before the deadlines provided below. If you do not meet this deadline, you lose your right to an administrative appeal. Your response time starts when you receive this letter. If you are mailing your request, it must be sent by certified mail and postmarked within 5 calendar days from when you receive this order.
