You did not request reconsideration of any other citations; therefore, they are not under review. Reconsideration Determination Citation 1: The program's policy on preventing and responding to allergies did not include procedures that state the license holder must contact the child's parent or legal guardian as soon as possible in any instance of exposure or allergic reaction that requires medication or medical intervention. The license holder must call emergency medical services when epinephrine is administered to a child in the license holder's care. Your Request for Reconsideration. You stated that your Health Consultant for Child Care Binder book was not reviewed during your licensing visit. You also provided photos of pages from your Health Consultant for Child Care Binder with your health policies. Applicable Law. The license holder must obtain documentation of any known allergy from the child’s parent or legal guardian or the child’s source of medical care before admitting the child for care. If a child has a known allergy, the license holder must maintain current information about the allergy in the child’s record and develop an individual child care program plan (ICCPP) as specified in Minnesota Rules, part 9503.0065, subpart 3. The child’s ICCPP must include, but is not limited to, a description of the allergy, specific triggers, avoidance techniques, symptoms of an allergic reaction, and procedures for responding to an allergic reaction, including mediation, dosages, and a doctor’s contact information. The license holder must contact the child's parent or legal guardian as soon as possible in any instance of exposure or allergic reaction that requires medication or medical intervention. The license holder must call emergency medical services when epinephrine is administered to a child in the license holder's care. Minnesota Statutes, section 142B.66, subdivision 1. The commissioner must be given access to documents and records, including records maintained in electronic format without prior notice and as often as the commissioner considers necessary if the commissioner is investigating alleged maltreatment, conducting a licensing inspection, or investigating an alleged violation of applicable laws or rules. Minnesota Statutes, section 142B.10, subdivision 12 (emphasis added). Reconsideration Determination. During the site visit, the Licensor requested review of your records , policies and documentation, including your allergy prevention policy, from the director. The director provided the Licensor with your records, policies and documentation. The Licensor reviewed your records, policies and documentation that was made accessible on review. The director did not provide the Licensor with your Health Consultant for Child Care Binder. The Licensor noted that your preventing and responding to allergies policy did not include procedures that 1) state the license holder must contact the child's parent or legal guardian as soon as possible in any instance of exposure or allergic reaction that requires medication or medical intervention, and that 2) state the license holder must call emergency medical services when epinephrine is administered to a child in the license holder's care. The Licensor asked the director if you had any other policies, because the allergy prevention and response policy that you provided did not meet the statutory requirements. The director could not locate or make accessible to the Licensor any additional allergy prevention policy during the site visit. On reconsideration, you stated that the Licensor had not reviewed your policy book, and provided the Health Consultant for Child Care Binder. You must grant and give the commissioner access to documents and records, including records maintained in electronic format without prior notice and as often as the commissioner considers necessary if the commissioner is investigating alleged maltreatment, and conducting a licensing inspection or investigating an alleged violation of applicable laws or rules. However, you did not provide or make accessible your Health Consultant for Child Care Binder to the Licensor during your site visit. You are required to have allergy prevention and response policies that 1) state the license holder must contact the child's parent or legal guardian as soon as possible in any instance of exposure or allergic reaction that requires medication or medical intervention, and that 2) state the license holder must call emergency medical services when epinephrine is administered to a child in the license holder's care. Citation 1 is affirmed because your allergy prevention and response policy did not meet the statutory requirement. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 is affirmed. This is a final agency decision. Previously Ordered Corrective Action. In the original Correction Order, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
