WITHHOLDING OF REMOVAL/DEPORTATION WITHHELD

ISSUE DATE: 03/2026

Similar to asylum where a person has experienced persecution or will face future persecution if returned to their home country but there was not enough proof for them to be granted asylum. In this case, the Immigration Judge must find that it is more likely than not that the person would face persecution if they returned to their home country. See 0031.01.09 (Asylees).

This status is NOT related to a Stay of Deportation, Order of Supervision, or a person with an active deportation order. See 0031.27 (People who are Undocumented), and 0031.27.01 (Stay of Deportation/Orders of Supervision).

  • Federal order granting Withholding of Removal by United States Citizenship and Immigration Service, Department of Homeland Security, Immigration Judge, Bureau of Immigration Appeals, or a federal court

SNAP:
People with Withholding of Removal/Deportation Withheld are ineligible for federally funded SNAP and state funded SNAP (MFAP); this includes UHFS. If a person with Withholding of Removal/Deportation Withheld status adjusts to a Lawful Permanent Resident (LPR) status from Withholding of Removal/Deportation Withheld, they are immediately eligible for SNAP with no waiting period. See 0031.09 (Lawful Permanent Residents).
