PEOPLE WHO ARE UNDOCUMENTED

ISSUE DATE: 05/2024

Undocumented people are non-citizens who are living in the United States but do not have immigration documentation that grants them lawful permission to be in the United States.

This includes:

People who do not have a current immigration status

People who once had an immigration status and it has expired and they do not have a new immigration status,

People who once had an immigration status but lost it, or

People who have a final order of removal from the United States.

This does not include People whose Deportation has been Withheld or People who have Withholding of Removal. See 0031.12 (Withholding of Removal/Deportation Withheld).

Eligibility

No eligibility for cash or food.

Refer applicants for food assistance from local food shelves.

  • Passport
  • Expired Visa
  • Expired I-94
  • Final Deportation Order

Likely to be sponsored?

No.

Category Code - Lawful Permanent Resident Card 

  • Explains the code on the LPR card when a person "Adjusted from" this status.

People who are Undocumented are not Lawful Permanent Residents.

Category Code - Employment Authorization Document (EAD) 

  • Explains a person's current status.

People who are Undocumented may have an expired EAD.
